pushbrk, if one has income in the US and overseas for any particular year, does the income from overseas become also taxed? or does the 80k rule still exempt the overseas earned income?

Ahhh... good point. I doubt three days (dec 27 arrival) is enough for this. :bonk:

You do not need the SSN until you file, actually about 2 weeks before you file if you do so electronically. You can get an SSN right away. Alla got hers the next morning after she arrived.

Getting married before the end of the year is like having a kid at the end of the year for tax purposes--you get to claim the deduction for the whole year. You will need the SSN for when you file the taxes and depending on the SSA office near you that may or may not happen, but as long as you are getting a refund or pay the taxes due you can file for an extension until the SSN comes in.

I am planning on getting married the 30th of December as it is one year after I proposed. The Fiancee is arriving this Sunday so I cannot wait. And I will be filing my taxes as married filing jointly as it reduces my taxes by some $8500. I would check out the difference between filing single and married filing jointly for you tax bracket, but you are going to find that filing as a married couple will benefit you finacially, plus it is one more piece of evidence for the AOS packet.

It does NOT depend on the SS office, If she arrives the 27th she can get an SSN on the 28th. Actually she could get it on the 27th, but SS uses the SAVE system which records legal entries into the US which is updated every night so you have to wait until the next day. DO NOT accept NO for an answer.

You only need the SSN when you file taxes. Don't need it to get married. I don't know where people get these strange ideas.

The thought is that you need to have a SSN before the end of the year in order to file taxes for that year. But as many have pointed out, this is incorrect. Even if your spouse has not yet moved to the US, but you are legally married, you can still claim her on your taxes for 2010. If she is here and you have a marriage certificate dated before midnight December 31st then you can claim her.

I remember "Registration" at City Hall means a permission to be married in 30 days. So the point may be that getting registration and being married before 2011. Generally speak in your case if you file joint tax, you will save a big thousands.

Hey all, my finance is coming to the US from the PRC on Dec 27... the original plan was to get married sometime in February but then she suggested maybe it would be a better idea to visit city hall on December 31 to register our marriage and get a nice tax break. Since she has no taxable income in 2010 I thought, by JOVE, maybe this is a good idea?!?!?! Any insight on this guys? Is this a good idea? As she is an immigrant will I still get the same tax break??

My wife's POE date was 29 December 2009 and we got married 31 December.

Yes you get the tax break.

I had her apply for the SSN only 5 days after we married and the SSA screwed up

because they claimed she was eligible when she applied but they never sent the

card and didn't at least give her the "refusal letter" which is required for getting a

temporary tax ID. We got her the temporary tax ID and then she got her SSN after

her AOS. Many recommend that it's better to get the SSN before you marry but I

say go ahead and marry anyway because the tax benefits outweigh getting an SSN earlier.

It would be better to get her the SSN# BEFORE you marry, even if it's Dec. 30 or 31.

Remember, you usually have to wait ONE DAY from getting the marriage license

to having the ceremony (in NY) or else you need a special dispensation from a judge.

Make sure the marriage license is applied for and in hand at least a day before December 31st.

Don't know what state you are in but those are the rules in NY. If you want to get the license and

ceremony on the 31st, you have to have a judge give you a waiver on waiting 24 hours to go through with it.
