  1. Has anyone had any experience with a late registered birth certificate in the K1 visa process for the Philippines. We are waiting for our NOA 2, and have some concerns with my fiancé's birth certificate. It was first registered when she was 15 years old (she is now 27). We have notarized affidavits from her parents and midwife, but are having some trouble with earlier records -- no baptismal certificate and her elementary school was small one in the province and she thinks they may not have kept her records -- but we will of course try. Has anyone been approved with affidavits only? Her birth certificate is PSA, she has a valid passport and all kinds of other IDs. Also, her birth address on the front is slightly different than on the back (same city), and her parents ages are listed as being 1 year older than they actually were when she was born (as if they were rounded up). Does anyone know if this is a big deal? We are looking into getting a corrected BC but sounds like it can be a long process, and we may not have time. Thank you so much for any insight anyone can provide.
  2. We are about to file a standalone I-130. The birth place (city) on my passport is different from my birth certificate. My birth certificate is the correct one. The encoder put my city of residence when I first got my passport and just never had it corrected. Will this cause an issue and do I need to correct my passport first? Correcting my passport will be really complicated as I got married in the US, have to register it with Philippine Consulate in LA, get a PH-issued marriage certificate (takes a year), and currently living in the UK away from my husband. I didn’t have issues getting other visas (UK Skilled Worker, US B1/B2, other tourist visas) but worried this might affect my CR-1 application because it is an immigrant visa. Any advice appreciated!
  3. Hi All, I have a question if anyone has had done a K1 visa for someone in the Philippines and were able to use a Birth Certificate from a local Municipality instead of one from the Philippines Statistics Authority? Me and my fiancé had already submitted our I-129F to USCIS back in July 2022. She had provided me 2 types of Birth Certificates. One was from the Philippines Statistics Authority (PSA) and one was from her local municipality office. The reason she provided 2 versions of her Birth Certificates was because her original PSA was handwritten and it was scanned in blurry and unclear. Her local municipal certificate is a clear version and these 2 birth certificates were used to apply for her Philippines passport. I reviewed the documents with my lawyer and she advised we can submit it with the 2 copies. However, my lawyer told me we would need to request a clearer copy of the PSA Birth Certificate down the road. She believes that may be needed during the consulate interview. I agreed we should try to obtain a clearer copy of the PSA Birth Certificate and had advised my fiancé on obtaining one. The issue is that my fiancé had attempted 2 times working with her local PSA office to obtain a clearer copy. Each time she requested a copy, she requested the copy be clearer. However, each time she comes to pickup the copy, it is not an updated clear copy. She has directed issue to the director of the office there on her 2nd attempt. So we'll wait and see if the third copy is clear. However, the whole situation is a bit frustrating, because she has to pay for each copy of the Birth Certificate even though it was not clear. I am not sure what other recourse we can do to pursue the matter since I am not familiar with the process of the country. Normally, in the US, if we are unsatisfied with the performance of a government office we can report it to our congress person. So I guess it becomes more of a 2 question, do we just try with the 2 Birth Certificates from the PSA and local municipality or do we try to escalate the issue to her congressperson? She tells me her government is corrupt. So she is not too confident anything is going to happen if she reports to her congressperson. Thank You any advice will be greatly appreciated.
  4. I noticed that the DOS visa reciprocity website for France states that For persons born in France: “Copie Integrale de l’Acte de Naissance” are obtainable from la Mairie (Office of the Mayor) at the place of birth. For French nationals born in a foreign country: they are available from the Ministere des Affaires Etrangeres, Service de l'Etat Civil, 20 Allee Brancas, 44 - Nantes. For French nationals born in a French colony: they may be obtained from the Direction des Archives de France, Section Outre-Mer, 5 Bd. Barthou, BP 1056, 44035 Cedex Nantes So I do have Copie Integrale de l’Acte de Naissance since I was born there, but I am not a French citizen; of course, I have a birth certificate from my country of nationality, which mentions I was born in France (and the city), and was made at the ministry of foreign affairs of said country. I was first thinking that I shouldn't submit the French birth certificate but now that I see that they have curiously separated these three cases above, specifically talking about 'people born in France', I am a bit in doubt. Should I actually read the first line as "For French nationals born in France: ..." instead of "For persons born in France: ..." , just because of how the next two cases are written? ... One would think that the reciprocity website for a given country always concerns only citizens of that country when it comes to birth certificates, but I am not sure now. So should I submit that document (and its certified English translation, because these days Montreal CO asks for everything in English) or not? I am just worried that given what is stated above on the website, the CO and/or NVC may request the document.
