Diversity and K1 Visa

Timeline

Can a person apply for a Diversity Visa while waiting for approval on a k1 Visa? My petition has been in RFE status for 7 months. My fiance lives in Ecuador and wants to apply for Diversity Visa since this is taking so long. Can he?

Yes*, just bear in mind that applying (or more correctly, entering the lottery) now will be for the draw in May 2017, and those selected will interview between October 2017 and September 2018, depending on their DV case number rank. In other words, first interviews a year away, highest case numbers closer to two years from now. You'd presumably get the K visa granted before then.

*I'm also assuming he was born in Ecuador, or another country eligible.
