My fiance is now scheduled for his consulate interview. There's been a looming question that I have just not wanted to ask but I suppose it would be better to know before our interview. My fiance was a realtor for 21 years but in the housing crash, he lost his career, his home, his family...everything. Then he went into home renovations, fell, was severely injured and had surgery but has not recovered. He is living on Canadian provencial disability. He will be immigrating here (Seattle) and his "work" will be to use his marketing / sales skills and experience to help build / market my business (I'm a public speaker / consultant / published author). My salary will support us ($58,000 yr), I've filled out the Affidavit of Support, and I've supplied him with my last 3 years of tax records.

So here's my question: Will the fact that he's disabled automatically mean they won't give him a visa? We have no plans or need for him to collect disability here, but will they deny him because he collected it in Canada (i.e. will they consider him a risk and deny because of that)? Or, is the fact that I sign the Affidavit of Support sufficient for an approval. I read somewhere about geting financial sponsors - do I line someone up now and have the documentation with my fiance for his interview, or wait to see if in the interview they tell my fiance that we need a financial sponsor?

12/27/2011 - He proposed to me on China Beach (Vancouver Island) and was nearly swept away by a big wave!

12/30/2011 - Filed I-129

1/5/2012 - NOA1 text received

1/7/2012 - NOA1 letter received

6/15/2012 - NOA2 approval letter received

7/?/2012 - He got packets and sent them in (sorry...I didn't document the dates!)

8/16/2012 - He took his medical

8/30/2012 - Paid MRV fee - Consulate interview (Vancouver) will be on 10/1/2012

10/1/2012 - Approved for K1 Visa (after very brief interview)...HAPPY DANCE!!

10/27/2012 - POE (Port Angeles, WA)- Zipped through with ZERO problems!

10/28/2012 - Got fiance moved & U-haul unloaded...THANK YOU GOD!!

11/30/2012 - Wedding date set for Nov 30th...counting the days!

Timeline

It will have no effect on the K1.He will become your financial responsibility. You will be signing a contract with the government via the Affidavit of support I-864 when you adjust status from K1.. (I-134 for K1 then I-864 for AOS)

He will not be eligible for any disability here.

As a side note, you are not adjusting status yet as you have in your profile. You have filed for K1 at this point according to your timeline.

The only way it could affect the visa is if his disability means ongoing medical bills; in such cases, the CO at interview may request proof not only of the usually 125% poverty line affidavit of support, but also that you can pay his medical bills (have arranged for health insurance etc).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks so much for the replies. It sounds like we should be fine then. I already have medical insurance that will cover him, so I think I'll give him documenation / proof of that for him to have with him in the interview.
