  1. Even though you petition was expired they still approved you the second time around.

    I contacted my congressman and he told me that he can't just make a call and get answers to everything. He was a big help to me but not as big as I would have liked. I guess I should contact the senator now. My petition will expire 7/28 so I would like to be notified of something before then.

    Kay you needs to find out why the visa was denied, getting married is not the fix it all solution. There are married petitions that are being denied out of Jamaica as well. Two such couples just this month has posted they were denied visas.

People please stop comparing your experiences with what the Jamaican embassy has already establish presidency with, "The Jamaican Consular understands the facts and conditions that are happen in Jamaica, therefore that is why this question about your involvement with drugs is asked at the medical. The medical doctors have been trained to asked this questions and relay the responses as it would apply to the Jamaican embassy standard.

    Therefore what happens in Germany, the DR, Mexico and others are not the same standards that have been used in Jamaica.

    Yes, right now a lawyer will have no barring at the interview, so yes it would be a waste of money.

    In Jamaica the test does not need to be postive, he has admitted it and it will be written in the medical report. Question' Did the patient admitt to drug usage? check box yes or no. The doctor will check the box that say yes, the CO will see the yes check box, and they will use this as reasion to deny. I have seen it many times......

  4. hi vj, i'm just devastated right now, just finished my medical and one of my sons admitted during his medical, trying cannibas once a couple months back. i'm so hurt and disappointed, he is only 14. i had no idea of this, until she gave the paper to do the urine test on him. the lady in the lab told me he wil only be denied if his test comes back positive which will mean if he had any in the past six months. is this so? have anyone been admitted to trying weed and still get their visa?

    YES he can be denied, they will deny him and give him the opportunity to re-apply a year later with evidence that he has not done anymore illegal drugs. In Jamaica they do not take this lightly. So be prepare for the worst and be surprise if he is granted a visa.

  5. Everything else was approve all we had left was the interview. we had a simple wedding she and I and 2 witnesses. My wife interview was May 6, 2011 she told the interviewer the witnesses nick name then i got my interview on june 21 and i told the interviewer their real name I gave them phone records, money transfer receipt and pictures.

    Have the witness to write statements to atest that they were at the wedding and have them to indicate their nicknamr along with their legal names. Have the witness to notarized their statements.

  6. Sorry about that, did you'll figure out which question you'll answered differently? You will now have to wait ubtil USCIS send you a letter acknowledging your returned petition. I seems as if the time frame in which you had your interview, doesn't aid you to be able to ask to have your petition to stay at the embassy, so you'll could correct the problem. So you now must wait for the letter. Was your visa application a K3 or a CR1, if it was a K3, then you may still have hope on your 130. Your 130 could still ganish you another interview.

    2009, 2010 and 2011, were any of these years above poverty level, if not were they all below poverty level greater than $5000.00?

    You said you could submit 1.5 years of bank statements, does your savings show a steady progression of deposits?

    The checking is going to be strange, because it should show money being moved in and out.

    If you are self employed, how will you show evidence of being able to provide Health Insurance/care for 2 elderly parents also Health Insurance for your family.

    Remember the CO looks at the big picture, not just a small moments in time picture.

  8. My original I864 listed my account balances and I sent 6 month statements at that time.

    The current account summary that I sent in the interview listed all transactions in past 1.5 years.

    ATPEACE: The money is in my checking account and I filed my taxes as self employed.
    I would like to hear from someone who actually had the same case or has the exact knowledge of this kind of situation.

    I am however planning on emailing the local embassy with my last 6 month statements.

    That is the crust of the problem, the money was not considered to be stable, and the CO looks at the money as if it is intended for the usage of the business, therefor it could not be counted on to be used for the purpose of day to day living. Therefore , the CO has requested that you obtain a cosponsor.

  9. He is from Morocco and has never been to the US, so they have not lived together. She takes trips there as often as possible but not being rich and having health issues that require regular medical care she cannot stay there all the time. Yes, she did have lots of evidence but it was only the kind that prove two people love each other from far away (and this is because he was not granted a VISA so....what exactly is she supposed to do about that??)She has also offered to send other evidence but has not heard back. She did send more than just web chat records, I just didn't feel like listing them all here.

    We are not a rich family, so I cant travel there as I also have a husband from another country that we save our funds to visit. She cant stay there permanently either, because of both limited funds and health issues that require regular specialized medical care. So, no I have not traveled with them. I have spoken to him on phone and web came, he calls me his step daughter, we all share news back and forth and plans for the future and he has even intervened to be a peace maker in family feuds from across the world. In short he plays an active role in our family, which is one of the ways in which I know that they are a geniune and deserving couple, the reason that I would like to speak up for them.

    You feel the question was jaded and all I asked was do you have any other evidence than what has already been supplied to the embassy. The letter you wish to write would have been something you should have supplied at the second interview, the embassy is looking for concert evidence. That's what you'll should be trying to put together, that's what I have listed in my question. This is a 5 year relationship and you'll don't have some of the things that the embassy would be looking for.

  10. I emailed them today in hopes to get a response soon I will contact my congressman if they don't get in contact with me in a reasonable amount of time. I have known my fiance for 9 years and we have been together for 7 we are only 2 years apart so age shouldn't be a factor in our case. so I guess now I will wait and leave it in Gods hands. I don't like being in limbo.....

    Yes, there could be some concern as to why/how you would be able to support your finance if you just started a job last month, have you been in school, were your finance able to explain the finance situation? There are so many variables that could be going on here, you need to talk to your finance and get a complete account of what happen from the moment he step foot in front of the embassy until they told him he was deferred.

    Please note, there are cameras all around the embassy, out front and inside and you are being watch from the moment you step in front of the embassy on the side-walk. Since you didn't go with him it is hard to get a clear picture of the events for the day. TALK TO HIM

No one is suggesting entering on VWP and trying to AOS here, what some are saying is given the circumstances of him being out of the country and the additional waiting time, that he enter on VWP, file the CR1 and kill some time in the US while that process plays out then return to the UK to interview, similar to what some folks do on K visa's .

    Not sure if that will work because the Passport now has a K VISA stamp in it and that is going to be something CBP will notice and inquire about.

    This whole post by OP is dubious in light of the previous post, none of it is consistent or makes sense.

  12. Faith/Andz, all you have stated is well and good, but the OP in this situation needs some immediately resolution. The OP is without a job, she has a child to care for, no family support(this was stated by her) and she needs $10,000 to give to a lawyer just to take her case.

    For deportation she has no ties that she is aware of back in Nigeria, a home country she has not been to since she was 7 years of age. The OP needs to link into the Nigerian community here and develop some linkage that will be able to assist her if and when she is deported back to Nigeria. She needs to re-connect with her immediate family here in the states because she have some Hugh choices she will have to make regarding her daughter.

    As far as media attention, I could probably pull up too many cases that have tried this avenue, and all it has gotten them is some more public sympathy, but there has not been any laws changed as of result of their media circus.....

    Do anyone know of a good/cheap lawyer she can call?
