  1. Thank you all for your patience and responses as we are very new to this. I did hear before that she would require a Waiver so thank you for confirming this. We just want to thouroughly understand the process so we don't jump into this endeavor to find out she is banned for 10 years. I have bookmarked all the links provided and will be doing a lot of additional reading and posting. I heard that the Waiver process could take anywhere between a few months to 3 years, is this accurate (I assume that it would be much longer if the Waiver is denied for any reason)? It sounds like not all hope is lost as it will be possible to go through with the petition; it would just take longer, include more steps, and its a lot riskier in our situation. When it comes to contacting an attorney, does anyone have any advice (where to look, questions to ask, etc.) on how we should go about looking for and selecting the appropriate legal rep who is experienced with situations like this?

I want to thank you all again for providing me with the links and all the information you passed on. My family really appreciates it.

Laurel Scott Legal counsel at the link that was provided to you, gives free on-line summary advise every Wednesday. The folks over there would best best to answers any additional questions you may have regarding your situation.

The folks over there will be you and your wife on the correct path.

    Good Luck.

  2. One of my friend advised me that I will need to earn enough to satisfy the affidavits of support...but as per this forum advised, it doesn't matter even I'm a student and don't have enough money to support them as long as my aunt(my moms sister) will file for I-864 and I will file for I-130, right?

For my siblings are they allowed for F2A visa? by the time i file my petition for my parents my brother is 19 or 20yrs old and my sister is 18-19yr old.

I really want my family to come all together,
even my parents don't want to leave without them :(

    This will not be possible.

  3. Yup im aware of it and that's what i'm worried about...After I filed for the petition for my parents how long does it take for approval? How long does it take before my parents can receive their GC? After receiving GC can my parents petition my siblings? for how long if they're still under 21? are there any ways that we can do so we can petition my sibling fast and not wait for 2 decades?

They can petition for them as soon as they receive their GC, but it will still be anywhere from 11 to 23 years before a visa is available. So, are the parents willing to leave the children behind in the Phil, until they are adults?

I don't see the value in doing this, but I am not you.

  4. Also as a added note, The embassy will not issue a visa to a unborn child, nor will they issue a visa to grant a unborn child privileges to obtain USC citizenship at birth due to being born on US soil.

The Birth of the child will delay the issuing of the mother's visa.

The pregnancy will be noted during the medical, if your next question would be ;how will they know she is pregnant.

  5. This is how it will go:

Father will be able to petition his daughter after delivery of baby

Father cannot petition grandchild ( is the father a USC or LPR) so this answer could be different depending on status

Daughter will have to petition her own child as a LPR.

    Daughter will have to obtain the father of her baby permission to migrate the baby;

That cannot be establish until AFTER birth of baby

As a LPR it will take 4 to 5 years TO MIGRATE THE baby.

All of the above processes will have to take place.

  6. The wife can not adjust her status within the US, because she has NO status to adjust from, she came here illegally. The folks over at http://immigrate2us.net/forum/forum.php can give you a better idea of how the entire process should be handle in situations such as yours. They are all dealing with this same situation.

  7. Get married to do what, neither the poster nor her boyfriend are USC. So please don't get married in haste, because getting married won't making finding a job sponsor any easier. To be fair to you, your field is a not a field that has a shortage of individuals with the required skilled set to hire within the US.

  8. I'm sorry, but you guys didn't get it. I understand that stuff. That's not what the question is about. I thought I was specific enough but it must not be clear. Let me put it this way. If a particular line of requested information is Not Applicable, and the line contains several boxes/spaces for different pieces of information (employer, occupation, dates from and to) pertaining to that job, do I put N/A in all the boxes/spaces or just the leading box/space (the first box/space on the left)?

All of the boxes, leave no box without a comment.

  9. Hi

My husband is a Jamaican who is now a US Citizen since October 2010. We filed April 7, 2011 for a green card for his father who is in Jamaica and according to the USCIS website he was approved and a letter was sent July 1 with additional insturctions.

WHile we wait for the letter I am curious if anyone else is doing this or has done this and could tell me more about the next steps a potential time frame as we really want his father here by Dec 17 (my husband gradates college).

    Any information is greatly appreciated.

  10. You have been so helpful through this with me that first of all I just want to say thank you very much. I have several questions for you. I just came back from Jamaica on the 20th of June. I was there since the 8th of June. I stayed at my husbands house with his family. Do you think it would help if each of his family members that was with us was to write a letter to confirm they were with us and witnessed our relationship. Do you think I should go to Jamaica and stay for a while to help with the verification of our marriage?

You are most welcome, yes letters from his side of the family wouldn't hurt. If you can go and stay for a while it would help, but make sure someone is getting your mail so you can respond to any request quickly.

Who interviewed your husband at the embassy? Look for patterns and descriptives in answers. Have plenty of pictures, add him to any accounts that you can without him being present in the US. You have children, how have they responded to your marriage, neg or positive, minimize the problem.
