  1. Called again, asked for an Immigration Officer. She was much nicer, not scripted at all. She was saying that they'll just ask me for more info. I said that I was worried it would be outwardly rejected, and she said, "While I can't promise that, so far, it doesn't look like anything is wrong with your petition. Give it another month, and if you don't hear anything then, give us a call back." So she was suggesting that they'd probably just ask for more info as opposed to outright rejection.

    Course, until it's done, I'm going to worry... I guess I'll keep you guys posted and check my texts, emails, and snail mail every single chance I get!

  2. I just called them and got the typical scripts. "If we need more information from you...." and "Some reasons for a rejection would be an incorrect fee, no fee, or no signatures." So it was kind of encouraging to hear that, but I don't count on all that info being correct. Should I call again and ask to speak with an Immigration officer?

    It's been since September 14th.. if they were going to reject it, would they have done so by now?

  3. Well, I have been visiting my fiance since August and I was planning on staying till January 22 (I have already booked plane ticket home). I am Canadian, and he is a US citizen. Though we are engaged, we have been trying to figure out how to get me down here since he doesn't make 125% above poverty line ($18,213). We have no friends or family that are willing to co-sponsor. To make matters worse, I recently found out I am pregnant (definitely accidental!). I don't believe in abortion, but I want more than ever now to be with my fiance so we can raise the baby together. Yet again, we have no one to co-sponsor us, he doesn't make enough (even though I've been down a few times, and he's always been able to support me). The reason he doesn't make enough is that he's a full-time student at College, and he works as much as he can (allowing time to study, etc.). I didn't ask for this, so please no negative comments. What's done is done. Please help me figure out a way to raise the baby with my fiance in the US. As I keep coming down here every 5 months or so, I haven't had a job in Canada so I can't even sponsor him that way (and yet again, no family or friends to co-sponsor him to Canada). He wants to continue schooling and I am proud of him for that. I have nothing to offer the US as I only have a high school diploma, nothing more than that (I have spent all my time trying to prove our relationship is legit by traveling every 5 months to the US for 5 months at a time).

    We've been engaged for over a year now, have dated for the past 4 years, and now are 1 month pregnant. Please, help us find a way out. Abortion and Adoption is not an option. We want this child. Thank you and God Bless.

    While I can't help you with your situation.. I just gotta comment: I wouldn't say the baby is 'accidental'. My mother always called me a 'surprise'. She defined the two for me, saying that a surprise is something you'd do again if given the choice, and and accident is something you wouldn't. :) (Congrats!)

    **Edit - yep. I did a search for "RFE" in K1 and Embassy places and while I got some hits, it's usually for discussions about the AOS stage.

    I know people get requests for more evidence at the interview but that's the visa process and isn't really an "RFE".. i mean obviously it fits the term but an RFE is typically something mailed to you. I think they call it a blue slip or something if you get an RFE at the interview (I don't think Aus do colours..)

    Maybe someone else will chime in and tell me I'm an idiot (totally possible and lets hope so) but most RFE's I see are for adjustment of status and stuff like that... within the US.

    So no one gets an RFE between their NOA1 and NOA2? I'm still confused. I already got the NOA1 with my Receipt Number.

    How do you know if your file has been touched or forwarded , etc etc.. I sent my K1 petition forms in 11/20/2010 and i still havent got word back, no check cashed.no touched. NOTHING WHATSOEVER!!..I checked the deliv. confirmation and it has been received...so im a little concerned as ive checked more then a dozen members status and 9/10 they have been received and touched on the same day or the next!..wondering why MINe is taking so long! ;-(

    You sent it in on a Saturday. And the next week was a three day week because of Thanksgiving. Not sure anyone's even returned to the office from Thanksgiving yet! Patience. :)

  5. ADVICE...call them right away, we filed last february and did the same thing you did because we don't know what to do and we don;t have guidance...We did not get any RFE...we got REJECTED! So we wasted 3 months of our time and money! So we refiled last JUNE...if we did not commit that mistake, we are already done now and maybe I'm with my fiancee this moment. So call now and tell them what to do before they reject it. Don't waste your time, do it asap!

    This is what I'm afraid of... Especially since they won't tell me til Feb-ish. I'm going to call them tomorrow at 8am, but from what I'm hearing, I won't be able to send anything in without an RFE, and it seems I might have to wait til Feb to see if I get rejected or an RFE. Right now, I'm just praying for a big RFE. I don't mind setting the case back 2-4 weeks for an RFE... I just REALLY don't want to have to start again. I'm so worried... Worried that even the phone customer service won't be able to help me with this one. :(

  6. Lets pray for just an RFE... instead of a "You suck, DENIED. Refile." Cause that would have lost me so much time... I'm hearing "RFE, RFE, RFE" all over the place, but one person who did what I did said theirs was outwardly rejected. And others saying "USCIS won't do that, they'll just send an RFE." So I still don't know. I'm going to call them tomorrow for sure!

    I don't think I've ever been so worried about something in all my life! :(

  7. So I wasn't even thinking.. I read the directions for the I-129F and thought that all the stuff they were asking for was to be brought to the interview. It was only recently that I realized... they wanted all that stuff with the form!

    I just sent in the fee and the I-129F form. That's it. I have all my paperwork, such as divorce papers, Statement of Intent, G-325A forms... Now I'm waiting (not patiently) to call them on Monday. I need to see if they will let me mail in all my stuff to add to the form I mailed in. If not, I'll have to wait to be denied, then re-file, which will cost me more money.. and most importantly, more time! Our petition is schedule to be reviewed in Feb. I got my NOA1 saying the form was accepted on 9/14/10 and is due to be reviewed.

    Does anyone have any experience with this? Will they let you mail in the information and just add it to your form? Seems like more work for them to deny it and then make me totally reapply...

    .. Boy, I feel so incredibly stupid. Anyone have any advice at all? (And please, no telling me how stupid I am.. cause I already feel awful enough as it is..) :(

  8. September filer here, too. Got our NOA1 on 9/14.

    I'm a little concerned cause I was stupid and only mailed in the I-129F form. I thought the rest of it was supposed to be given to them at the interview! I know I'm going to get an RFE. I just wonder how much that's going to set us back. I'm hoping to gather everything we need before that, so I can return it the same day I get it. Either that, or if they'll let me mail the stuff in early... I'm going to call them on Monday and see if I can do that.

    This wait is just agonizing! And knowing I may have set it back a bunch cause I'm stupid... well, that doesn't help either. No chance that anyone knows approx how long an RFE sets a petition back? :(
