  1. Don't shoot the messenger. It may make as little or much sense as it will, the rules are still the rules. If your mother couldn't help, you would have to pay a USC to help or work it out differently.

    I guess both consular agents broke the rules the 2 times she told them she was coming to help out while i was finishing school then! Because she was honest with them and they still gave her 6 months each time. And no, my MIL will be here, i have never sent my kids to day care before they were at least 4 months old. I have been blessed in that regard. I would love for my Mom to be here again for that time period, rather than my MIL because she just got back from spending a few months with us.

    The first reason given about "intent" makes perfect sense to me and I am glad it was mentioned because I did not think of it. As far as taking a job from an American Citizen, I will not be doing that regardless of whether she can come or not. I am not looking for an "illegal" way to take care of my kid

  2. The advice given us correct.

    However, she may still apply for the tourist visa, no harm in trying.

    For the baby, you will need to find a legal baby sitter or you or your husband could negotiate to take unpaid leave. Your mother cannot babysit while in a tourist visa.

    Once again people she is not baby sitting. She is helping nurture her grand kids. I am not paying her. Billions of people here do that every day.

    She has been here before and told the the consulate in my home country that she was coming to help me with my kids as it was hard for me to juggle school and family and they gave her a visa. Yes, that's the reason she gave and they gave her a visa several times

  3. First of all you can not use tourist visa to have parents come and take care of your baby. That takes a job away from an american person.

    Second to get a tourist visa you have to show strong ties to your home country so they can see you attend to come home.

    With a pending application to move over there there they will see the intend to move and not come back.

    The second part of your post makes perfect sense and I didn't think of that. But forgive me to say that the first part does not make sense. I want my baby to be taken care of by family, I am no taking a job from an American citizen. It is well known that it is more beneficial for a baby to not be in a day care situation until their immune system is strong. There is a reason why maternity leave exists and more states are fighting for more time for maternity and or paternity leave. I am not paying my mom to take care of her grand kid. It is a family raising a child together as it has been done for thousand of years by citizens as well as non citizens. We are not talking about a trying to save some money for day care here, I will spend more than that on a plane ticket

  4. I am hoping someone can help me with this situation

    I understand this process of bringing our parents here can take a while. My question is this one, if the case is not completed yet in a few months can my Mom apply for a tourist visa? She has been here several times and has always gone back on time. I had hope (and still do) that her case will be approve soon, but I ma also trying to weigh my options. We are expecting a baby, and I was informed that I will not be able to take more than 4 weeks of maternity leave. Husband can't take more than a week either, so I am trying to see if she can obtain a Tourist visa to help for a little bit and then go back home when things are ready for her

  5. I've just received my oath ceremony and as i feared, it is scheduled for when I will be out of the country. Unfortunately, I can't reschedule my trip at this point. Already changed travel plans around this process and it's too late now to change them. I leave the country next week and my oath is scheduled for the 16th. The instructions say to mail the notice back. However, there is no mailing address. Do I just mail it back to my field office?

    I've just done some research here and it looks like the best option is to get an info pass and bring it in person. I tried to do that but it looks like the link to make an info pass is broken on their uscis web site

    Where do I go from here? Any advice?

    My research has also yield that sometime you get put back at the bottom of the line, other times it can be rescheduled within a month. Looks like it is very much office dependent. Anyone has an experience with the Kansas City office?

    If I can't make an info pass can I just show up at the office? I leave Tuesday morning and apparently KC office doesn't have info pass on Friday.

  6. It depends. Sometimes people are able to get their oath reschedule in 30 days. If your travel date can't be changed, then you have no choice left other than getting it reschedule for future date.

    Thanks for your reply. I understand, as I said earlier that I have no choice then to reschedule it and I was expecting that. I just want to have an idea because I might have future travel plans within the next 6 months. I was told unequivocally that it will be a long time and a hassle to get back to where I am scheduled again, but that was juts one's person opinion. I figured this forum has a lot more diversity and experienced people.

  7. I just received my oath letter scheduled for July 16th , as I feared I will be out of the country at that time. I am about to return the notice with my plane tickets information indicating why I can't be there!

    Has anyone ever done that? If yes do they take a long time to reschedule you? Someone told me that you basically get put at the bottom of the list. There is nothing I can do about it now, I can't cancel my flight, but I just want to have an idea. I will be away for a month

  8. I can relate to your situation, Been waiting as well. My interview was May 5th placed inline May 11th. And nothing since then. I have been a tiny bit worried because a few people around me that have about the same interview time are already scheduled for the interview and my local office is known to be fairly fast, so I am imagining a scenario where my oath letter is lost and by the time I realize it they've already closed my case or something! I know it's rare, but can't help to think that way

    My case is further complicated by the fact that I will be out of the country and if it comes when I am not here I don't know how to reschedule it

    Oh well! I have decided not to worry about it for now

  9. I have a question for the more knowledgeable on this site. How do I go about rescheduling my oath of it comes down to it?

    I had my interview on the May 5th, was placed in line for oath on the 11th ( I think). Looking at the calendar for oath ceremonies in my district one : May 7th, May 14th , June 18th, July 16th , August 20th etc.... According to the IO, she had told me that they usually give send you the letter at least 2 weeks ahead of time, which means that most likely I am not making the June 18th one. Now the problem is that I will be out of the country for a month starting July 1st. Looking at people that got their interview around the same time as I did, they have already taken the oath or taking it in June, which means that most likely I will be scheduled for July

    Scenario 1: the letter comes when I am still here, what is the procedure to reschedule it? do they need proof that I will be out? do I need to do an info pass or send it by mail? ( I want confirmation they have actually received my request to reschedule that way my application is not considered abandoned)

    Scenario 2: The letter comes when I am not here. Then what? Can I make an info pass to USCIS office before I leave and tell them ""I will not be here please don't schedule me for another month?". I could have my neighbor check my mail for us , she usually does when we are not here, but her husband is sick and with a lot on her mind, i am afraid she might not pay attention to USCIS letter and/ or not communicate with me on time etc...

    suggestions?

  10. Today I received an email from USCIS stating -> "We scheduled your oath ceremony for Receipt Number NBC*00558****. We sent a notice with the date, time, and location of your oath ceremony to the address you gave us"

    I'm so close! :D

    This is music to my ears! lol! I have been waiting to read this update from you! now since i am usually less than 1-2 weeks behind you, I hope they don't break the cycle!!!!

  11. I usually don't comment on threads like these but this thread is a reminder of how entitled we feel in this country. Every single "rights" we ( immigrants, and native) get is actually not a right, it is a privilege! Administration (s) do not owe us a thing! They don't have to grant our loved one a status because we chose to get married to someone from a foreign country and want to bring them here. It is a privilege! It's not like there is a scarcity of people to get married to inland!

    Secondly, having had family members and plenty of friends and relative that came here through different administration, one will be foolish to blame any of these issues on a specific administration, and/or political party/ President! As said repetitively here, they will say and do anything to get re-elected. If they really wanted illegal immigration to end it would have been done eons ago. They don't because it cost them too much either financially, politically etc...Let's not be naive! We are talking about a country that has the ability to build a wall comparable to the Berlin wall if they want to! ( They've always had that ability, didn't start 8 or 16 years ago). It is obvious that there is some political and/or economical gain in this immigration game, and once they get up there in that chair, they realize it.

    Sometimes i visualize the outgoing president with a smirk when the incoming make promises about how they will do this and that about some of these big issues ( immigration, health, offshore jobs ...) and they just think to themselves: " lets just wait and see what you will do when you get up here, you just don't know what exactly is at stake yet"

    Until we get some congress and president ( and real news outlets, not cable news, because they need viewers and ratings), that care more about real issues than politics, let's keep playing by the rules, hope for the best, do our research in such away that if given the opportunity to influence a sensical change, we will be in a position to do with open minds. But of course that too is wishful thinking on my end

  12. Last update : after calling several times, the lady handling my case finally called me back and first question was " I see that you left notes for me to contact you. What is going on?" ( All sort of thoughts are going through my head at this point as: you'd think you know why I am calling since it has been several months now since I applied with no concrete feedback). Didn't say any f that and decided to play nice, so I calmly explained the situation and my questions. She asked me a couple of questions about my kid and I replied. How long has it been since you've seen her dad? Why? Are you sure? Then said well that matches her previous file ( she had a passport before he disappeared in thin air, he had signed a consent ), but not what you said in your written statement . She said she was going to issue the passport but discover some inconsistencies. I explained again ( read back my statement no inconsistency, the question she was asking what written down black and white, as I have a copy of it in my computer, dates she said didn't match match to the T). But again I decided that there was no need to fight , so I asked gently what did I need to do. She said write another statement explaining it exactly like you just told me and reapply and I will issue it

    I told her no, I can't really again. It has been way pass the timeline that your agency gives, I provided everything you asked, followed up, and I really need it since I did all I could to apply as early as possible to have it in time for the trip. I asked for a fax number and she finally agreed. Drafted the letter and faxed it before the end of the day. Couldn't call her back to verify she had received it because the phone number she had called from would not allowed incoming calls. So all I could do was wait and pray for the best. A week later I got an email notifying me that they were done processing the application and 2 days later the passport was in the mail.

    Thanks for all the replies, I have a question regarding Tax--Did any of you who went for interview take any Tax document with yourself.

    Did the Officer ask any Tax documents from you?

    I was supposed to bring 3 years worth of Tax, brought 4 ( just because), but was not asked a thing! My guess is that it varies per officer and per case, as they already have the tax documents that you sent when you applied. But to be on the safe side, I would bring everything that's on that checklist. Paranoid that I am, I had in my car my whole immigration file and more proof than one could possibly want to see, so in case I met any difficult situation, I'd have been able to just run out to my car and bring any applicable document :)

  14. I had my Interview today, it went pretty smoothly as expected. My interview was at 10:25, I got there 15 minutes early, and got called in almost on time. Before starting the official questions, the officer asked about my job and where I work. Then he started with Reading/Writing test followed by six civic questions:

    • What is one promise you make when you become a United States citizen?
    • What movement tried to end racial discrimination?
    • What did Martin Luther King, Jr. do?
    • Where is the Statue of Liberty?
    • Name two national U.S. holidays
    • Who was the first President?

    Then, he reviewed the Yes/No questions and finally asked me about my Birth certificate, I told him that I was not asked to bring it to the interview but I had submitted that when applied for my GC. He said it is okay.

    He gave me couple forms and papers and asked me to sign them, when I reached to the last page, I realized that is my case approval letter! He said do you have any question? I asked when will be the Oath ceremony, he said 2 days from now, May 7! Then he asked me to wait in the waiting area until they give the Oath Ceremony letter.

    Whole process took about 1 hour.

    Just two more days left!

    I could not remember the questions I was asked today during my interview, but I find it interesting that from 2 different offices, we would have the exact same questions on the same day!

    Thank you for sharing this information. I do have same situation in traffic tickets. Last one I got in 2008 for which I can obtain the documentation but any tickets prior to that, I have contacted the DMVs and courts but none of them have any records since it has been over 10 years. I have obtained the drivers license record for those state which came out clean. I am planning to mention it during the interview which I am not sure when that will happen :)

    That was my attitude going in. She didn't even let me mention the rest, even though i told her that there were at maybe 2 prior to 2008. She kept saying as long as it has been resolved. Also she took note only of that one in 2008 and took my driving record to add in in my file. Only paperwork she took actually. I had brought everything else from the checklist they sent with the interview noticed. But aside from passport, green card and that driving record, she didn't ask or look at anything else

    Question---You answered no and you stopped her on 23 so sort of confessed you did not provide the correct information(don't take me wrong). I have checked yes and my interview is on 1st June and i have been scrambling to collect certified disposition letters from court.--Maybe its a complete waste of time --just my driving history from the state should suffice. Any thoughts?

    One more question--were you given multiple choice in the civics test?

    Thanks. When she got on question 23, and she asked the question I said: "I would like to make a correction, because I realized after the fact that I had forgotten to add.." and she cut me off and said " speeding tickets?' I said yes and explained the situation.

    I am not an expert and maybe every IO is different, but from what I saw on this forum as well as the attitude of my IO today, it seems like they want to make sure that you don't have any outstanding ticket. My thing is just be honest and do the best you can, including your driving record which should show if there is anything not resolved. If they really want they can check it in no time!

    She seemed to insist mostly on verifying that I had paid and/or resolve each ticket.

    About the civic questions: she said i needed to get 6 out 10 and once she got to the 6th question she stopped because i had gotten all of them right. No multiple choice. she asked a question waited for the answer and moved to the next

  17. Had my interview this morning and it went well. Recommended for approval. Appointment was at 930 and I got there at 915. Was checked in and seated by 920. Got called at 940 and back in my car at 10am.

    After the IO swore me in, she had me read a sentence and write down the answer. Who were the 1st people in the U.S. And " Native Americans lived here first "

    I remember only a couple of questions! Lol! Who was the first president and where is the Statue of Liberty located

    Then we went through my application. I stopped her when she asked about question 23 since I had answered no. I told her that I had speeding tickets with the last one in 2008. She asked me for the dates, I told her that I did not remember I tried to get my driving record to get information and got a clean record without any ticket. I showed her the driving record and she said she'd keep it. The. Gave her approximate date of the last ticket being in 2008. She asked where, and said any ticket prior to that they wouldn't care, I guess because it'd be more than 7 years, as long as they were resolved and closed. So she wrote down only the one from 2008.

    After all that I signed at bunch of papers and she told handed me the letter with congratulations and we started chatting about other things

    Now just waiting for the oath letter and will be done with USCiS forever

  18. i talked to 2 people who got there interview letters from same office, and i am still hanging in limbo. i did my bio on 2/25 since then no news at all. i think my case is the same as yours. but i haven't got any re-bio letter.

    Never had a ticket or problem in my application, single, no kids and very simple and straight forward case but still...

    Get on my nerves when people apply after you , get interview letter before you in same office.

    well let the wait game going on, it will end one day.

    Same situation as both of you... I can't get a record of my old tickets and I haven't kept receipts from over 10 years ago... I had no idea that I would want to become a citizen back then. My driving record doesn't have the tickets on it because they are dropped after 7 years in Texas. I'll mention them on the N400 (best I can do is month and year) and I'll show a copy of my driving record. I hope that'll be enough, but I've read about cases where the interviewer insisted on a document from the municipal or local court in question stating that no record was found. I'll have to wait and see, but I'll definitely push the fact that the guides and instructions say that no proof has to be presented for minor infractions... if the interviewer insists, I'm willing to spend a few months escalating the issue, because I'm not going to run around Texas looking for 12 and 13 year old speeding tickets.

    Hopefully we'll all end up with interviewers who are aware of the rules and won't ask for evidence... there are many such cases.

    The lady at the DMV told me about the 7 year-rule as well. So I thought at least the one I got in 2008 or 2009 would show! I guess the lawyer was right then when he said it was not going to go on my driving record! Never thought I would want to see records of speeding tickets so bad! lol!

    Let's just hope we all get IO's that are understanding

  19. I have a quick question for you guys:

    I am one of those who did not realize I had to disclose my traffic tickets ( misread the whole thing and though I should only disclose them if the fine was more than $500). Long story short, the speeding tickets I had were in 2008, and 2009 and another one I think in 2005 or 2006. The one in 2008/09 were in a different state. However I have maintained the same driver license number/state since I got to the US in 2003 ( Missouri driver license). the tickets from 08/09 were dismissed via a lawyer and I can't find the information anymore. ( Still looking, can't find it yet).

    I am planning on mentioning this during my interview, but I was trying to get proof of payment and dismissal. So I went to the DMV to get a driving record, that way I could get at least the dates when I call the different courts to see if I could get any proof of payment/dismissal. My driving record came completely clean. Nothing shows up. Would the tickets that have been paid, and the ones dismissed would have shown? Was I supposed to ask for a different type of driving record? When I asked the lady at the DMV she just said no tickets are showing

    After I left the DMV office I started wondering if she meant "pending tickets", as in tickets that have not been resolved yet. So I guess I am trying to ask if a tickets that have been resolved one way or another would have shown, or is there another way to get that information so that I can get the dates in order to call the courts
