    I am trying to get an input from anyone who could help me here. I talked about it a little bit in a case report forum.

    We had our interview last week, on Thursday. Wasn't a horrible experience at all. On the contrary, it was much easier than I would have anticipated. Here is a quick review

    We got there 15 min before the appointment time only to be seen at 9am instead of 830am. The IO swore us in and said " I apologize for taking you in late, I was trying to go over your file. I just wanted to let you know that we are going to proceed with the interview but I won't be able to make a decision today. You sent too much documentation and proof with your file and I didn't have time to sort through all of it"

    After that she asked us the usual questions, the ones on the I130 and I485, how we met? how long we have known each other? the evolution of our relationship....

    As she was about to conclude I asked her if she needed stuff like tax returns and other proof of financial co-mingling that we couldn't obtain before we filed, she took it and said she really didn't need more "proof" as we had sent a lot of docs already. Glanced at the pics and handed us the paper saying that she couldn't make a decision at the time but that we will hear from her if she heeded something more or when they make a decision will receive the welcome letter in the mail

    She then proceeded to explain about how the ROC works, and said to pay attention to that. At time she would say if you get approved, and other times was just talking like we were approved

    It has been a week yesterday and no words. No RFE ( not that i want any), no letter, it is almost as if nothing happened.

    Is it too soon to start thinking about an info pass?

    I have looked at other cases and usually when they can't make a decision right away they at least get some sort of communication within a couple of days or a week.

    Anybody has been in a similar situation? I have heard of not enough proof but too much?

    Any input?

    About I-94, do not worry so much. My officer never explained ROC and she almost forgot to collect I-94. I asked her "don't you need my I-94"? Then, she said "Oh, I often forget to collect it".

    My interview was the last of the day. Soon after the officer started the interview, the secreatry visited and asked her when our interview would finish. The officer was really in hurry to finish our interview. I think your officer was also in hurry. as long as she explained ROC to you, your situation is much better than me.

    FYI, I did not submitted so much evidence. I only submitted leasing agreement, joint bank information and some photos without my parents. My RFE is not related to bonafade marrige. It is related to my visa.

    it helps a little bit to read that. Yes she seemed to be in a hurry. The appointment was at 830 we got there 15 min before and she took us in around 9, because she said she was looking over our file, but it was too much. We were out of there by 915 if even that.

  3. Yeah the whole experience was a little strange. She did not ask to see my passport at all. Sometime I wonder if I should have found a way to show it to her, maybe when she asked how I came in, with what type of visa etc...but didn't think about it at the time and I thought it was normal procedure to take the I94 if they are going to approve you. That's what scares me a little

    She was fairly tall for a woman, middle age, blonde.

    I spent my eve and today looking at my phone expecting an sms or a mail with an update, to the point that I couldn't even study. I just made the decision to put it in the back of my head, after all there is nothing we can do now, but just wait and worrying is just going to intensify the pain...

  4. That's very strange, but at least you have your EAD and can afford to wait a little longer, although I'm sure its getting tiring. Im still surprised that she said you had too much evidence. May I ask, what you originally sent? You would think they would review it during the adjudication phase prior to your interview. sigh.

    I find it strange indeed. I don't know if she took the time before today to look at the file, it didn't sound like it. Because she apologized for making us wait in the lobby for long, she said she had to go through the file and try to thin it out. She got started but it was too much

    I basically sent the usual proofs.

    We didn't have a joint bank account so I sent the first page of my bank statement dating about a year back, highlighting every transaction that reflects a transfer between our accounts ( which is 99% my hubby to me)

    A copy of a list of furnitures and item from the moving company that moved my stuff from one state to the other when I was relocating

    Health, car , life insurances

    Costco membership

    Couple of bills showing that I get mails at the address

    Pictures

    Copy of his savings, retirement and investments account showing I am the beneficiary should something happens

    Tax transcript returns for the past 3 years to show that I was paying my taxes when I was working

    All the evidences from hubby related to the I864 ( tax transcripts, letter of employment, recent paystubs)

    Receipt of purchase of rings

    Affidavit from the witnesses at our wedding

    I think there was a little bit more but I can't think of it right now, But I thought that was the basics

    You are right it is a good thing I have my EAD and recently got a job offer so between that and school I hope it will keep me busy enough to allow me not to go crazy, but it will be nicer if i can hear from them soon enough

    She didn't even ask for more evidence, I had to ask her if she needed stuff like joint tax return, joint credit card statements that we didn't submit before. She took it, barely look at our pictures. She didn't take the affidavits from friends, saying that they are not strong evidence, and that if we didn't have enough evidence she could have needed it but we had more than enough

    She did not ask for my passport nor my I94, so I still have that with me( which worries me a little, since I noticed that they usually take it when they are going to approve you right?)

    She also asked us the usual questions and then how we met? ...

    The interview in itself was more like a conversation more on the friendly side, but professional, short and straight to the point

    After we asked her how long it would take for us to hear from her she said, she doesn't know but if we don't hear from her in 120 days to contact them

    And she gave us the whole removal of condition speech and concluded the interview

    The waiting game continues and it sucks but we are trying to stay positive

  6. I received nothing yet, Kat. She didn't even tell us that your case would be reviewed further or something like that. After I submitted everything I got, she just walked us to the door. Apart from the fact that I messed up with my dad's name, everything I told was the truth. I really hope she wouldn't hold it against me. Otherwise,I would be screwed :((. I would blame it on her accent and my ears !! Everybody got approved so easily but me :(. Anyways, I'll keep you guys posted. I'm expecting for the worst now .....

    Just wanted to cheer you up by saying that you are not the only one that did not get a decision right away. We had our interview this morning, this experience in itself was not bad. She told us from the get go that she would not be able to give us an answer right away because we sent too much stuff with our file and she didn't have time to sort through it

    She barely wanted to take additional evidence but I gave her some anyway. She didn't not ask for my passport nor I94, so unfortunately the waiting game continues. I know it sucks big time but just trying to believe for the best and a quick follow up!!!

    I have to say I have heard of not able to make a decision because of not enough evidence, but not the other way around!

    I don't know exactly how to qualify the interview experience. We were in there for less than 20 min. She started by saying that she will not be able to make a decision today because we sent so much proof that she didn't have time to sort it out! I have to say it is the first time I hear of something like that

    She asked the regular 485 questions and then how we met, how I came in this country and then ended by reminding us that she need more time to go through our file

    After my husband asked her how long it would take for her to make a decision she said, she couldn't tell as of right now. She said if we haven't heard from them in 180days to make an info pass, but it shouldn't take her that long.

    She didn't want to take the additional proof, and just took the updated credit cards statements(2) and the joint bank account statements.

    After that she proceeded by talking to us about the whole removal of condition deal and how it would be important to remember to do that as they don't send a reminder.

    She didn't ask for my passport nor I94.

    So I don't know what to make of it, the interview was more like a conversation , not scary not overly friendly,

    I guess we are still in the waiting game!

    I was wondering what changes for me if my fiance and I applied for my status change while I am still on my F1 visa. My fiance and I met while I was going to school. I have 1.5 years to go on my program. I am paying international student fees right now however if my status changes what would I tell my school? On top of that, I have been living in California for more than a year so would I become a CA resident? Do I pay in state fees or international fees still? Would my working status change? Any links or personal experience with this would be greatly appreciated.

    Sorry if it wasn't clear enough, we are getting married soon so we are looking at next steps of sending in the AOS pkg but would like to know what we need to tell my school.

    Just to add to the above answer, some school will let you pay as resident while your application is pending, provided you give them at least a copy of the NOA1, showing that you filed and actually have a case pending for adjustment of status. They might also required a copy of your marriage certificate. However, schools that do this require that you update them as your case advances especially after the interview, because if your green card is not approved, they will revert you back to the status of international student. So, your DSO is your best source of information. Most of them are well informed, unfortunately some don't know exactly how the system work. The school website might give you a head start too

    On February 9, 2011, we mailed you an appointment notice for an interview for March 17, 2011, at NATIONAL BENEFITS CENTER.

    Yay! Any idea why its NBC and not CSC or something?

    NBC is simply the national benefit center. The appt is at the local office, but the letter issued from the NBC.

  10. Im all set with all the forms and documents, except for one..the I-864.. :(

    My sister is a co-sponsor and a week ago she requested for her tax incomes, w2 from IRS. To be exact, weve been waiting for 1week and 3days already and havent recieved any mail from IRS.

    I was planning to file everything last January 31st including I-130, I-485 and I-765 etc. But i failed, coz i had to wait for my sister's I-864 to be completed. I dont wanna file everything without the required docs for the I-864 coz if i do i will surely get an RFE and it will make it worse and delays the process.

    So i guess all i have to do is wait! ;(

    Check this website http://www.irs.gov/localcontacts/index.html, if your sister lives close to one of these offices, she might just go there and grab it. It took me less than 15 minutes to get my IRS tax transcript from the local IRS office

  11. Received my interview letter yesterday....still no updates online, or nothing about my EAD or AP.

    great for the interview letter! Looks like you are the first among us. Time for me to start stalking the mailbox :). Especially since someone from my area, a late Nov filer, got theirs already

    Hopefully after the snow storm that affected the region where the NBC is, is over and they resume work tomorrow, they will start sending us EAD's

    Fingers crossed and time to start getting ready for the interview

  12. Thank you both!! :)) I cannot wait to be finished. I really hope he gets his EAD soon. I know the next month and 10 days will fly by before our interview. I'll definitely let you know how it goes bbutterfly since we're in the same area. Also, I'm so anxious to see if your walk-in biometrics will help you.     1month! It is just around the corner. By the time he gets the EAD and start on the job hunt he will have the GC in hands! :)

    Definitely keep me posted. As far as how the walkin affects he EAD is still yet o see especially with the RFE that I had. From what I understand they halt the process while waiting for the response. If that is accurate, who is to tell when they got back? :(. Seeing how fast you got ur appointment, I am inclined to focus more on the GC itself for job hunting purposes

  13. I gave USCIS a call on the afternoon of the 20th to double check that they received the response to the RFE. I already saw from USPS website that it had been received and signed for but wanted to confirm my theory that I had an LUD only after I talk to them the first time. The lady told me that she doesn't see anything yet, but to give them about 3 or 4 weeks o process it, as they handle a big load and can't confirm right away if they receive a response or not.

    Sure enough, the next day, my case was updated acknowledging receipt of the response to the RFE

    Now crossing my fingers for the EAD and interview appt soon enough

  14. I see you got a touch since the 18th! Yay! I haven't, and I had my biometrics appt last week (scheduled)...hmmm....I really with it would update, just for sanity's sake :)

    I wonder if that touch happened after I talked to them asking for more information about the RFE

    I have officially stopped looking for updates. It drives me insane.

  15. I was worried we would get an RFE for the translation of birth cert and also the I-864 supporting docs. I also sent in the return and W2's but thought I missed something. Of course I can always get an RFE still! I'm thinking in your case, I'd probably just send in the transcript. It's the same information and it's acceptable. Is there a number you can call to double check? And yes hope you and my hubby get EADs soon!

    We finally decided on getting a transcript. My husband went to the IRS office this morning and he was in and out in less than 10 min.

    Just to be on the safe side I called the customer service line , as it says if you need clarification about the RFE to call. Wow! what an experience!!! The first person I talked to spent about 10 min just reciting from a script, part of it was exactly what I had in the letter, then telling me that I have to wait for the hard letter ( which I have already) and proceeded to tell me, there is no way someone can help me over the phone, giving a website for Pro Bono legal advice and how to make an info pass......Long story short I had to cut him off( gently :) ) and asked him to connect me to a tier 2. Waited in line for about 30 min and the person I talked to was really helpful:

    Birth certificate: the IO reviewing my file probably just overlooked it, so send the copy back with a cover letter explaining where to find the translation and possibly highlighting it

    Tax transcript from IRS carries more weight ( his terms) and it is easier to handle than tax return and supporting docs)

    So we are all set an sending it in the morning!

    Wish I could just drive by and drop it off :)

  16. I saw in your timeline that you had a LUD on the date you did your WALK IN .... But in my case I DIDN'T :( .... I had no updates after 19th Nov :'(

    I am almost in the same situation with you. did a walk in on the 28th, no touch since the 18th, original appointment is tomorrow

    Today I got to talk to someone( other than the 1st line customer service rep). I was originally calling to have some clarifications about the RFE I received, and asked him if he could check my records to see if they have my biometrics. He said yes it shows that I was there on the 28th and they recorded everything. He told me there is no need to go tomorrow, however in some cases, if the computer doesn't pick up that I was there, it might generate a letter, saying that I missed the appointment and reschedule another one. He insisted on telling me that that was just a generic letter and it might not even get to me because the person mailing the computer generated letter , might pay attention and not mail it.

    But he say to be on the safe side, to keep my stamped biometrics letter (aka receipt), and if I receive a letter, send them a copy of the receipt with the letter and it will fix the issue

  17. I basically had the same RFE, if you have the W2's then why don't you just send them? Getting a transcript from the IRS takes at least a week when you could just respond to the RFE ASAP and move on.

    Thanks for your input. My husband's supporting are much more than W2, and it will take him a few days to get them together. Whereas it took me 10 min at the IRS office that is just 20 min away from our house, to get my tax transcripts. That's the reason I was leaning toward the tax transcripts.
