  1. Hello,

    I am trying to fill out my wife's Form N-400 and I am using an Apple Pro Laptop

    For some reason the form doesn't fill out the Alien Number automatically in the rest of the pages once I put it in page one like it normally does. I tried to manually put in each page, but won't let me do it this way either

    Anybody knows how to solve this issue?

  2. Thank you Jay-Kay for your reply. I am still confused about including my daughter in Part 4. The confusion is because in the instructions for I-751, it says the following:

    "If you were granted conditional resident status through marriage to a US citizen, use this form to petition the removal of those conditions. If you have dependent children who acquired conditional status on the same day or withing 90 days thereafter, then include the names and Alien registration numbers of these children in Part 4.of this form in order to request that the conditions on their status be removed as well. If you have dependent children who did not acquire conditional resident status on the same day as you or within 90 days thereafter, or if the conditional resident parent is deceased, then those children must file form I-751 separately to have the conditions of their status removed"

    Does this mean that I should not include my daughter in the list since she is not in a conditional status?

  3. Hello Guys,

    My wife came to the US on K-1 Visa. Her conditional green card expires November 2nd, 2013. She is currently in Egypt for her brother's wedding, and returns to the US October 11th. We have one year daughter who was born in the US, so she is a US citizen. I have the following questions:

    Question One: How late can we mail out the I-751 package? The reason I am asking is that I heard there would be a biometrics appointment and I am worried if I mail it now that, the USCIS sets up the appointment on a date when she is still in Egypt.

    Question Two: Do I include our daughter under Children in Part 4 of the petition, or not?

    Question Three: How much should I pay in fees? $505.00 plus $85.00 for my wife's biometrics only? Do I use one check for the whole amount or do I send 2 separate checks?

    They applied initially and were turned down due to ineligibility. But then a few days later somebody from Medicaid called them??? Just out of the blue? I think it's more likely that the OP called Medicaid first to appeal the denial, then got a call back. Once the deny a case, the government doesn't call applicants to discuss it further.

    Why would the OP persist once denied the first time? Basically, he knew they were ineligible, but kept going and was approved (knowing full well he was not supposed to get it, thinking "maybe the government screwed up in our favor once").

    Unfortunately, whether you knew or not that you were ineligible (you admitted that you did know), you accepted the sevices, so you are now responsible for the money that was paid for treatment for your wife. The thing with government agencies is that even when it's their mistake, we are still responsible.:angry:

    Things didn't go the way you say. We submitted the application. Got denied for not being a Citizen. We didn't call or pursue it any further sir. I was getting ready to send my wife overseas where it costs a fraction of what it would here. Then we get a call from this worker and she asks me why I didn't send her the proof of citizenship she requested in the notice. I told her again my wife is not a citizen. I asked her if there is other options available. She said send me whatever docs you have and I will see what I can do. It started from there.

  5. Hello everybody. I finally got to talk to a very helpful employee at the medicaid office. She told me that she appreciates the fact that when I found out that they have made my wife eligible for this benefit by mistake. She said that she agrees that this was their mistake, and that they have nothing on their record that shows that we ever claimed that my wife is a US citizen. She said she will have to have to check with her supervisor before she can send me a letter or a statement that there was no wrong doing on our side. I told her I need this statement for immigration reasons because I don't immigration service to assume and accuse my wife of falsely claiming to be a US citizen to gain a government benefit. So I am praying that her supervisor agrees to that, because I really need it.

    She told me that even this was the agency's mistake, I still have to pay this money back because this is tax payers money which I don't mind. She said that the total amount won't exceed $10,000 (exactly like couple people mentioned earlier in this thread) and I can still reduce it as this amount includes the bill for labor and delivery which should be covered by emergency medicaid if they find she was eligible for it at the time of the emergency. She said that the whole matter has been transferred to the benefits recovery department and they should contact me soon.

    I asked her if emergency medicaid can be applied for the entire pregnancy as my wife had a high risk pregnancy. She told me that Emergency Medicaid only pays for labor and delivery. The only exception is when the patient has to go to the hospital during pregnancy for something that can be life threatening to her or the baby if not taken care of immediately. This is determined only by the physicians not the DCF.

    She told me appreciates the fact that I called in and reported this mistake even if this affected me negatively. However, as I mentioned earlier my final amount that I have to pay is not as huge as I thought in the beginning because she told me that Medicaid has its own negotiated rates with the provider. That's why the bill won't exceed $10,000.

    I hope this information has been very helpful to everybody. I just wanted to mention couple of things. I appreciate the fact that lot of people here tried to help and give their advice. Some of it was correct, some was not. I just didn't like some comments from people who rush into judgments without carefully reading what I originally posted. I never assumed my wife is eligible for this benefit. That is why I applied, to find out. They told me NO she is not, then they turned around and told me YES. We found a way that makes her eligible!! From my point of view I did the right thing. If people should know if they are eligible or not from the start, then there is definitely no reason for the application.

    Some others blamed me knowing that I knew I am the one sponsoring my wife, and now don't want to pay for it. First of all, I never said I don't want to pay. I just want to pay what is reasonable. The only reason I applied in the very beginning was when we first started was when I started getting all kinds of bills asking me to pay $400 for doctors visits that never lasted than 20 minutes and all what the doctor did was making us listen to heart beat of the baby!!! I did the maths and I found out that if things are going into this direction, then my final bill will come up to a huge number. So, that was the only way why I started thinking about Medicaid.

    Regardless of me signing form I-864 before, I still blame the system here. What kind of sense says that we immigrated to the country through legal channels, work hard, pay taxes and we are not eligible. On the other end, others come here illegally, overstay, don't pay taxes... they don't pay a penny from the start to the end. I have met at least 10 people in recent years who just came to the country to give birth to their children, make them US citizens, then just leave their big mess and bills behind, and then we tax payers have to pay for that..!!!

  6. The Medicaid fees are close to nothing, I'm sure it's less then 10k in total. Every hospital has a sliding scale fee, which depends on your income. Also what kind of hospital was it? Catholic charities? Government owned? Non profit? They can't force you to pay all at once, you could even pay $5 a month.

    Don't know if it government owned or not, but it is Tampa General Hospital in Tampa, FL

  7. Hmmm my first thought was, how can you get medicare for your pregnant wife?

    surely you would have to earn x amount in order to bring her into the country on a visa, thus rendering you ineligable for medicare.

    Secondly, your wife is not eligable to be a burdon on the state that is why they have a stipulation of earning x amount ayear to support the non citizen.

    Third, did you not have a medical plan through private means or work related?

    which with her added could have helped.

    Do you have the confirmation paperwork that says as a GC holder your eligable to be covered?

    if so then see a lawyer to fight your case, good luck.

    I think medicaid limits of eligibility are much higher than required by the affidavit of support. I recall it says if you made less than 185% of poverty line, you are eligible

  8. I would be surprised if the bill is higher than $10K for total pregnancy if it was paid under the medicaid umbrella

    Are you sure medicaid reimbursement to providers are much lower than the actual bill?? because every visit we went to was at least $400... over 9 months, then labor and delivery...

    It is just too good for me to be true but I hope it is..

  9. I do see a judgment here, twice - "you're looking to not pay for something you got." That's not how I read this. He didn't know if she was eligible. He DID ask, and was told no. He accepted that and was looking for alternate methods when *they* contacted *him* to say oh you're in luck, we found a way to get you covered. He thought, "oh, thank goodness" - not knowing that the way they did it was to falsify a piece of information that he clearly gave them *accurately*.

    Now, the issue is that if he had researched alternative ways, he would have gotten *assistance* with the situation, as someone in need of help because he did not have coverage. Anyone who has ever had a lapse in coverage knows that medical providers will work with patients of lesser means to assist them in meeting their obligations. Typically, they charge them quite a bit less.

    That didn't happen for OP, because medicaid told him he was covered. So his wife's care was billed at full price.

    Whatever you might think about the fact that different people pay different amounts for the same services, it's a fact. And the fact is, OP would have been billed less for everything had he used alternative resources to pay for the pregnancy.

    So now OP has been billed at the "insured" rate and is being told he has to pay back at that rate. When it's not his fault that he was billed at that rate - he was honest and legitimately believed he was covered. Now what he has to pay back is way more than what his bills would have been had medicaid stayed with their original judgment of turning him down.

    That is, in fact, not fair to OP, as it was Medicaid's mistake.

    He's not looking not to pay for the care. He's looking to pay what he *legitimately* owes - which is the reduced rate offered to under- or un- insured patients. There's nothing wrong with that.

I would really make sure it is paid - because if they leave US citizen mark there, you'll have much bigger problem with being accused of your wife falsely claiming US citizenship (whethere she did that or not) - which can results in a deportation and lifetime ban with no waiver possible. Being you would really make sure it is all resolved and there is no trace of it.

    Also, you should have known that your wife is ineligible not being US citizen and think about healthcare costs before she got pregnant. Not sure what you are complaining about - did she received the service ? Yes. Was she eligible - no. You'd have to pay this anyway, so what's is really your problem ? You're looking for a way to not pay for something you've been given ?

    Listen sir, before you rush into judgements you need to know that we clearly stated that she is not a US citizen. The medicaid worker called us and asked us to fax whatever documents we have and she will find out what she can do and if there is anything available for people in our situtation. Few days later we found out that she approved us. We don't know the law. All what we do is apply, be honest, and that's what we did. The decision was made by her not us.... so it was her mistake not ours. The only way I found out was when I went online to add my new born baby to the household. That is when I found out a check mark has been placed next to my wife being a citizen.

    Luckily, the medicaid account still shows the original application that we submitted, and it clearly say NOOOOOOOOOO to the question asking about my wife being a citizen..

  11. I don't know.... I don't feel too good towards about this....

    this employee screwed up our life!! I know if it was a hospital, it would have made payment plans and reduce the payments, but the problem is that the government already paid for all medical bills for the past 9 months, and prescriptions!! we are looking at tens of thousands of dollars....

    when dealing with the government it is different... what kind of payment plan would they accept!! to pay all this money back!

    the guy told me over the phone whether it is your fault or ours, you have to pay it back... this is unfair!

  12. Hi, My name is Hatem. I am a US citizen, my wife is a green card holder. She got her green card a year ago, through marriage to me. She was pregnant. I applied for medicaid for her so it covers her pregnancy. I said on the application that she is not a US citizen. Our case was ineligible.

    Few days later, a Medicaid officer called us told us about our case. I told her my wife is not a citizen. She asked me to fax her the green card and all other documents. Few days later, we received a letter saying that her medicaid has been approved, and it they make it start from day 1 of pregnancy till delivery.

    Later on, when my baby was born, I got online to add my baby to the household, and I found a check mark next to my wife that she is a US citizen.

    I called them and told them to correct it, and now they closed her medicaid, and they say they will make me pay for all the bills they paid, even though I never said or submitted anything claiming she is a citizen!!!

    What can I do now? We are looking at thousands of dollars!!

  13. My mother in law who lives in Egypt, just got the visa to come visit us in Florida. I am so worried because she doesn't speak a single word in English and she doesn't have any experience travelling. She will have a layover in London. Then head to USA. Most likely she will arrive at JFK, then have to board a flight to Tampa.

    Don't know what to do?? I am afraid this language barrier cause us a big problem like missing her flight or getting lost or so..

    Anybody have an idea what we can do?

  14. I strongly recommend that you reconsider this whole relationship. I don't understand, what are the odds of someone falling in love twice in such a short period and in both times it is a USC!! This is an exact online hunting, at least for me. By the way, I have been to Morocco for six weeks before in 2006, and I strongly agree with the previous post that the main concern for youth in internet cafe is how to hunt a foreign girl online, play the love story on her just get out of Morocco.

    However, I have some very good Moroccans who really loved their wives, and in fact they chose to live in Morocco, so they were not seeking a green card. I just don't think this is the case here. There is lot of red flags in your story.

    I don't buy his story of not knowing what a k1-visa is. Trust me my dear, he knows exactly what it means. I don't understand, what does he mean by not knowing what exactly was going on when he received his interview packet? Does he mean his ex surprised him that she is petitioning for him, or may be trying to fool him make him sign paper work and suddenly find himself on a plane heading to USA??

    Besides, I don't buy the story that he cancelled the petition, because simply he can't. Only the petitioner can. My explanation to that is that either things didn't work out with his ex in the last minute, or may be he met you and you are a younger good looking girl or so.

    As for not knowing what the term Fiance meant? How come? Everybody in Morocco speaks French, and the word is the same in English and French!!

    One more thing I would like to mention to you. I am from the Middle East, and men in this part of the world have a different way of thinking. They rarely marry a girl who is older than them. In fact, I will go even further, and tell you that men in the Middle East don't just look for you a younger girl when it comes to marriage, they even want her to be virgin. As I see from your story, his ex was much older than him, which put a big question mark.

    Regardless of all the previous facts that I mentioned, I don't think CO in Casablanca will buy his side of the story. Casablanca is known being very tough.

    I strongly advise you that you side down for a bit, and start thinking about the whole thing again so you don't regret it later.

  15. If you set up an account in I-129 Petition for Fiance(e) https://egov.uscis.gov/cris/Dashboard/CaseStatus.do of course you can check your status each day.

    Example your number is EAC1190276990 I just checked EAC1190276971 which shows completed and they are now working on EAC1190276972 and up... so each day you can track others peoples status and see where your status is..

    Really not cheating - just a way to track your visa application better..
