  1. I applied for the fiance visa on July 29.

    On January 31 I received an RFE for my divorce decree from my first marriage.

    On February 11 I sent the divorce decree and was received by the USCIS on February 16.

    I think I did a mistake that may cause a mess. I called the USCIS and filed a service request, thinking that my evidence had been received which was not. So they resent me the same RFE again on February 17. and the service request was denied because they thought I never received the first RFE notice.

    Now the latest update on my account is RFE requested on February 17.

    I have the following questions

    Will I have to resend the divorce decree again when I receive the second RFE?

    Will the USCIS be smart enough to just approve the case once they see the divorce decree I already sent, and it is over?

    I called the USCIS again, and they told me to disregard the second RFE notice, but I am still worried though. Besides, they told me I can't file another service request again, or inquire again before 60 days. This is how long it takes them to review the evidence.

    Is that true I will have to wait another 60 days? How long any body think will vermont center approve my case?

    I have seen some people's timeline, and they are actually complaining that they sent their RFE almost 4 months ago. Why would it take that long for them to get approved, and still nothing.

    Is there a certain way how VSC handles RFE? I mean is my file back on the shelf collecting dust again? or should it have priority?

    Please advise me. Sorry for the many questions. Please advise me

  2. I have an update that an RFE is coming on the way. Most likely to provide proof that we met in the past 2 years.

    I forgot to set my camera to add the date to the pics, and just sent them the way they are. How can I fix that? I don't think I have to go back all the way to Egypt just to take more pics with the date on them. would I?

    I have passport entry stamps, showing I have been to Egypt in the past 2 years twice, but they are in Arabic... Do I need to translate the passport entry stamps?

    One last question. How long would it take to process after I send my requested evidence? will I go back in the line again?!!

  3. I just called USCIS today, and I got an RFE which is fine with me. At least I know someone touched my file.

    I am originally Egyptian, and so is my fiancee. What if we get the approval notice with the situation that just started in Egypt? The US embassy now is closed, and no body knows when it is going to reopen again. The whole country's future is uncertain?

    How will this affect us? What would the NVC do? Where would they send the paperwork?? How can we complete the process?

    Anybody knows?

  4. I talked to USCIS several times, and they always refuse to escalate my call to Tier2. How did you convince them to escalate your call?

    My second question is

    Did the first level of customer service tell you your case is still pending, then when you talked to tier2 they told you, that you are approved? I don't understand this part.

  5. After months of wait, things seemed to finally be moving. We started seeing few approvals every day. Now since the 14th everything seemed to be on hold again!!! That was too short.

    Anybody knows what could it be this time? My thinking is once the USCIS announced Jan 18th as the deadline for TPS applications probably there was thousands of last minute filers, and now we have to wait for their applications to be approved before the USCIS turn around and start processing !-129F.

    Does anybody know if my conclusion is right or wrong? Anybody with any info?

    No, You can't apply for citizenship based on marriage once you are separated or divorced.

    Yes, you can still apply for citizenship not based on marriage. You just need to wait 5 years instead of 3 before you are eligible. If you stay married you can apply after 3 years.

  7. I filed form I-129F for my fiancee and my NOA1 was on July 29th of 2010. My tax return for the year 2009 wasn't enough to be a sponsor. However, in 2010 which ends in few days I made almost $35000.

    The year is almost over, I didn't receive the NOA2 yet, so obviously we will get it in early 2011, and the interview will be in 2011, too.

    My questions are

    Will my application be denied because in 2009 didn't make enough money?

    If not, and my fiancee goes to interview, which tax return would be go by? The new one for 2010, or the old one of 2009 since this was the one available when I filed?

    Will I need a sponsor? I do have one, however, I don't know what form do i need to send him to fill out

  9. Thanks for your update. Very nice effort from you. However,being nice doesn't necessarily mean they are telling you the truth. The whole thing is crystal clear and it doesn't need any explanation. Numbers talk. Just a quick look at the charts on the USCIS website itself shows you how many TPS applications have been processed in the past few months. In the meantime, K1 visas declined dramatically because of that.

    Second thing, I don't even believe a single word of the VSC people, because every day they have a different story. One time they say they are currently processing July 11th applications, then they say they are doing the 10th!! I really wish you get in 6 days. I wish myself the best of luck, too.

    However, the only thing I am hoping for is that the number of TPS application has already declined, and the holidays will be over soon. So hope things will start moving again in January..

  10. You could try calling your senator. I tried calling my congressman and one of the senators of my state and they didn't even respond to my inquiry. So I contacted the other senator, and their office was willing to help. I am still inside my 5 months so they didn't give me any more info than I already knew, but said to call them back after the 5 months and they will help me. It's all about calling the right people, which can be difficult to find.

    Senator Lemieux didn't ignore you. His term is already over. There should be another senator taking office January 3rd.

  11. I am from Tampa. I got my citizenship back in April 2009. At the time, I did my biometrics just one month after I filed my N-400. I was so happy for he speedy process. However, I still got my interview 5 months later. So don't worry.

    Sometimes, the delay is for so many reasons. Either your name was a hit, and it needs more time for a background check. May be there is too many applications ahead of you. But anyways, there is one more thing that I don't really know if it is affecting N-400 filers. That is the USCIS is currently putting most of their workforce towards TPS visa applications (forms I-785,and I-821). I know for sure it is putting family based petitions on hold, so may be it is the same thing for naturalization applications.

    So just chill out and relax. Don't worry, it is coming.

  12. I don't really mean to disappoint you. It doesn't really mean anything, and it is very inaccurate. It keeps changing all the time, not necessary change forward, but backwards too. like you will see it one day saying August 16, then the next day it changes to August 10th for example. So don't really pay too much attention to it. I think it is more accurate to check the Igors list.

  13. well, my father applied for a tourist visa back in 2002, but he never traveled to the US. Then in 2010 he applied for a visa again. They asked him why he never traveled the first time. He told them that he just changed his mind. So they put him on administrative processing just to investigate that he really didn't travel the first time, and that he just wasn't hiding anything because it is a little unusual that someone gets a visa and just don't travel.

    Once they found out that he didn't travel to the US for real, they approved his visa.

    So, I think it is just about something they want to investigate further more about you, once they make sure that there is nothing wrong, then everything should be ok... or you would have been denied from the very beginning. How long would it take, of course no way of telling that. It all depends on the nature of what they are looking for...

  14. I notice that for the past 30 days Vermont Service Center has gone very slow processing K1-visa, or I can actually say it is at a complete stop.

    I don't know if this information is true, but I heard that some employees have been transferred to process other type of visas.

    I this information true? Does anyone has any updates when can we expect the VSC to start processing petitions the same way it did before one month ago?

  15. I do think the USCIS should be blamed for all this delay in processing. I don't think anybody would mind paying extra fees for them to provide a better and faster service. Hire new employees. Invest money on improving their system. The thing that I do believe that the USCIS is not fair when it comes to a first come first served policy. You will see people who have applied probably 2 months after you and got approved while you are still waiting. There is no such an explanation for that other than you bad luck put your file on someone's desk who doesn't really care to make your life like hell staying away from you loved ones. Take his time, take vacations... etc

    Those people need vacations, because they are human beings after all, but in that case your petition should be assigned to another IO and goes into the right order where it should be according to the date on the NOA1. It is very simple stuff but it makes a difference and it should make every body served fairly.

    I do believe they should first look for petitions that are 5 months old already, before looking into newer ones.

    Waiting is too frustrating, and the worst part is that you can never know till when. On the top of that you have know one that you can talk to tell you any specific details about your case!!!

    I do understand that sometimes USCIS needs to take further look at petitions due to high fraud cases, but let me give you myself as an example. I am originally Egyptian, my fiancee is Egyptian, I am 35, she is 28...I have been to Egypt two times already to see her. A very crystal clear case. No criminal records, or any other problems of what so ever... and we have been waiting and waiting and waiting!!!

  16. My NOA1 was dated 07/29/2010, and I filed with Vermont Center. I still have not got my NOA2 yet. I check the updates, and it has stopped at July 25th for the past 3 days. The last touch to my case was 10/03/2010

    If they get to 07/29/2010 Does that mean that they have to start processing my petition?

    I am sick and tired of waiting and waiting...

    Any help?
