This thread has gone quiet all of a sudden.
One thing I forgot to mention was that I sent in the 12/23/16 version of I-129F form. So those who are getting rejected are most likely using an even older version, or extremely unlucky. But yes the real waiting begins. The time between the NOA1 and the NOA2 is usually the longest in the whole process.

What should i do? I will just pay for k1 visa and medical and inform the consul that k2 will not coming with us because of birth certificate issue?
That sounds like a good idea, as it is the truth. However, as NuestraUnion said, you need some sound legal advice on this one so you can know how to proceed forward in bringing the child to the USA. Good luck!

So because of the ex the case got dismissed and you couldn't correct the BC?
Interesting.
You may want to seek legal counsel to help move this along. Surprised the courts didn't require the ex to cooperate.
The court probably doesn't see this as a pressing issue. It's only one incorrect BC in a sea of many. But I totally agree with the sentiment.

What's up with Philippines and messed up birth certificates? o.O I'm curious since this comes up pretty regularly. Is that a common thing?
Very common as I found out first hand. It's a widely accepted cultural practice, no one blinks an eye. What it boils down to is an easy way to adopt. Or an agreement to take care of a relative or friends child, when they have had 1 too many. At first this caught me off-guard because in most places the BC is considered a sacred legal document. Sad part is they make it extremely difficult to correct a BC, while easy to file one with a "mistake."

I'm unsure. How can I find out? I've read something about gamma something or other in the blood and was wondering if they test and base on that. So that he can not drink for a year and apply again.
5 hours ago, CandyManby said:From what I researched the refusal was based on that he may become a public charge due to alcohol dependancy shown at the medical.
Ohh my...it sounds like the medic found something in his blood test that indicates he does drink too much. This is not a small detail. Combined with a former DUI it sounds like the CO made an informed logical choice here. Telling you to apply again in 6 months is a nice way of saying you're denied. Your husband needs to go to AA and some alcohol counseling and needs to stop drinking if he wants a chance of getting approved in the future.

Bingo! Let's not downplay the dangers of alcohol here.

Our plan of attack is to put money in savings that would otherwise have gone into paying for everything. Wedding related expenses, plane tickets etc. We also have a basic idea of the how, who what and where as far as the wedding goes. Nothing in stone and we've already told those who are interested in attending that they won't have more than a 2 week to 30 day notice. This is going to be a nice but no frills and low stress event. We do plan on throwing a party sometime down the road as a nice gesture to everyone. I think most people will enjoy that more anyways than having to dress up and pretend to act civil.
Our preferences and situation of course aren't ideal for everyone. However point being is using a bit of creativity and preparation without setting any firm dates, can save a lot of money and go a long ways.

I would recommend to go to the interview as well. Many people have been denied and felt that it was because they weren't there at the interview with their fiance. Depending on the embassy, they can see it as the petitioner isn't serious about the process or marrying the beneficiary if they aren't willing to attend the interview.
Best of luck with everything!
In other words it can be make or break, agreed! Especially if there hasn't been a lot of in person time. I plan to attend my interview no doubt. At the very least it will put my fiancee at ease. At most it will help legitimize the relationship in the CO's eyes if the evidence isn't enough already. Case in point here is a recent thread about an interview that took place in Manila, considered a very easy embassy:

The thing to learn with this whole process is never try to set firm dates for anything because you may go pass those dates. This happens all the times where people set dates for things such as flights and ceremonies, then due to no fault of their own have to forget about those dates due to delays in the process.
Very eloquently spoken!

Wow, 41 RFE's compared to 34 approvals for January so far. That seems like a mighty high RFE number. Over half of the touched cases for January are coming back as RFE's
That worries me
Fascinating....I'm thinking this may have to do more with people rushing their applications fearing what the new administration would do. And perhaps not so much to do with USCIS. In any case better to get an RFE than have a lost case file. Good luck to those still waiting!

It is possible not a guarantee
LIke a .000001 percent chance there will be a customs check. Even if there was a check coming from a US state to another it's no big deal, one look at the system would resolve it.
While we are on the subject, on I-10 close to El Paso, TX there is an immigration check booth. Why would that be any different than flying from state to state?

Just received my NOA1 today by text and email! Amazingly it only took 3 days.
It's nice to know it met the bare minimum requirements.

Unfortunately he doesn't have any of the paperwork for two of the marriages. Like I said, he didn't even remember them until I unearthed them in a background check! Yes, it is definitely a pain, but I'm plowing on!
I can totally understand forgetting dates related to ex spouses. I'm the king of that as I would soon forget than remember. But forgetting names and not even remembering he was married?? In any case the best policy is honesty and it sounds like you are. So it should be ok. Good luck!

Just out of curiosity, what happened that makes them rank so low? I took several PAL flights a few years ago. The planes were older, but there was more legroom and the food was good. Contrast that with fancy new extra-small seats in Cathay Pacific where the seats don't even recline, and the food was terrible (I'm 5'10" and not picky about food). I normally fly the Korean airlines (KAL, Asiana).
Bad customer service, poor on-time record etc etc etc Just do a google search for United airlines, there is a lot of recent negative press. Granted if you aren't a frequent flyer and are just looking for cheap prices it's probably not a big deal. But personally United would be far down my list of choices, even if going on another airline means it cost a bit more. Fortunately SEA isn't a big hub for United so It makes it easy to avoid them. And flying to Asia is easy with plenty of choices from here.

The timelines are averages, they are not specific or guaranteed.
Following the time lines will only drive you crazy.
Not to be negative also, but some people who go beyond the time lines, actually then receive RFE's.. you never know what can happen.
If you are saying it's possible to get an RFE at any point in the process, agreed. If you are saying you have a higher chance to get an RFE because you are waiting longer than the average person, not necessarily. Anyone can get an RFE at any given time.
15 hours ago, Michael & Michele said:I'm ready to cry!!! I received notice via TEXT on 1/3. Hard copy NOA1 was dated 1/11/17. That's 96 days. According to VJ timeline CSC is processing with NOA1 dates of 1/13. I just called USCIS and they referred me to their timeline https://egov.uscis.gov/cris/processingTimesDisplay.do The woman I spoke with advised me that the October processing date reflected time between NOA1 & NOA 2...at this rate I'm looking at a year process.....Anyone else have any other info? Wait with no inofrmation is agonizing...
Your file probably got stuck on the bottom of some pile. What can I say, it happens. The good news is your packet isn't lost, so you didn't lose all that time and worry. And the fact that it took so long to get your NOA1 doesn't mean the rest of the process will. Sorry you had to wait so long, but it's probably downhill from here as far as wait times go. Good luck!

Hi everyone, hope you all had a great weekend. Wanted to welcome all the new April filers to the thread. Hope the couples that are waiting for their NOA1's get a notification soon. Fingers crossed and knocking on wood for you all. It's Easter and I always find the holidays lonely when I am not spending them with my fiancé or my family. I live in Ontario and my mom and my brothers all live in British Columbia. I am looking forward to when Michael and I get to spend all the holidays together and we get to start our own traditions.
To answer the earlier question about what we are doing for our wedding. We are not traditional in the sense of a big wedding. We are planning to have a small ceremony by the Guadalupe River which we have both come to love as our serenity spot. We both have family and friends in other cities so we are planning to travel to them and celebrate with them in their cities. Wishing you all a wonderful day or evening depending where you are. 😊
Nice to have you aboard.
As you know, up here in Seattle, we are not too far from the BC border I hope to make it up there a couple of times this summer. As far as holidays go, it's very possible to get approvals before Christmas. Good luck!!

Hello all,
thank you so much for all the information, I see a lot of you has mentioned about overstaying.
Her last stay of the date would be July 3rd, as mentioned by zilchofox, and she is leaving April 17th, so this wouldn't be an issue.
and Ya, we understand that we will be filing all these paperwork for CR1 or even just the travel visa.
I am just afraid that since we didn't file any AOS like everyone else did, she just get married here and leave, would that get her blacklisted from entering to the country again.
No blacklist. It's not a requirement by law to AOS if the person isn't staying. Don't overthink this.
Although in situations like this I always question the validity of the relationship. When someone chooses family over their new spouse, you have to wonder. So be prepared for extra questioning when filing for your CR-1.

OP clearly stated they told the CBP their intention. The CBP allowed entry at that time. Thus there is no fraud because the fraud is in lying to the CBP. Once allowed in by the CBP it doesn't matter, they cannot be denied to due intent.
Does that mean that people use that to their advantage and that it's unfair? Absolutely. Does it mean that it's legal? Yes it's a legal course of action for them to take.
Isn't the action itself fraud?

Wow Delta and United are $400-$600 more expensive than Korean Air and Eva form SEA to MNL. In any case both airlines are superior in every way compared to United.

As of wedding plans : we both are not big fans of being center of attention, so no big wedding ceremony. This day should be special for the two of us and if it's just going to the court house and ending the day with Netflix and chill, we'd both be fine. 😃
@Cruise77 I'm gonna join estibaliz in finger crossing, let's see if that helps.
We are the same way, we don't want a large complicated wedding. My fiancee doesn't even want to worry about the white wedding dress. I'm more than happy as I'm not a fan of the white wedding dress either. Although we do plan to do Vegas or somewhere close to Disney or Knotts Berry Farm for our wedding. I'm knocking on wood here...

Mailed to USCIS: 3/31/17
Received by USCIS: 4/3/17
Check Deposited by USCIS: 4/6/17
NOA1 Received: 4/15/17.... and now we wait. Best of luck to everyone on a speedy turn around!
Congrats! It seems like the NOA1 is taking a few days longer than it has been. All those Feb & Mar filers perhaps. Hopefully that doesn't mean longer NOA2 times.

Hi guys,
yesterday my lawyer burdened me with. Most saddest and quite bizarre news so get this straight I applied in NYC for my fiancé visa in August 2016 (hes in kabul) and we finally got his petition approved Feb 27 2016
but my lawyer made a mistake and misled us that his interview was this April 27th so I found a sponsor I got all the paper work ready and sent to DHL in kabul then the next day my lawyer calls me and tells me wait a minute hes on an administrative processing hold so he canceled my fiances medican exam whcih was shpposed to be next week. I just dont understand how i wasnt informed sooner and accurately about his pending status.i had no clue about the admin processing i had im mind that everything was going smoothly and his interview would be in 3 weeks! My lawyer said therr wasnt a name on the interview date and mixed up someone elses case? Its his job to make sure and confirm my fiances interview? I mean this is very important how could he have missed that? My fiance has The cleanest background and works for Gardaworld a very well known security base of America in Kabul, so i dont understand why he's on admin processing about how long do you think the embassy will give him an interview date?
this is all very frustarting any advice id much appreciated
thank you
You'll want to start your own thread and not hijack this one. This is thread is for April 2017 filers and it appears you filed in August 2016.

Ok so where do I start..... in a perfect world the chart posted above is a good general guideline. However we are talking about the IRS here. So anything can and will happen, especially if the one requesting the transcript has been a victim of identify theft in the past. Trying to get transcripts on the website can also be very hit or miss. SInce the website didn't work for your husband he should make a phone call and talk to a real person. If he is close to an IRS office, visiting in person is another option and can be the fastest way to get the transcripts if available. Hope it works out!

Sorry this happened. However since he is a citizen and also in the armed forces, it's not worth dwelling on the past. However, you need to take control of your own situation. Pay the bills with your name on it. And save up for a deposit to open your own account. It sounds like your credit was affected, so sitting back and being mad at him isn't hurting him. It definitely isn't helping you fix the situation. Yes it sucks, but it has to be done or the crazy cycle will continue!
