VJ members, Any visa issued for reaffirmed cases so far in Ghana?
-
We were almost done with the procedures in NVc , when NVC sent back our case to USCIS for administrative action. Because of the death of our petitioner our petition was subject to automatic revocation. Thus it was denied. So we filed I290b(motion to reopen or reconsider) and after a wait of 3 months I290b was approved and I130 reopened. Later we got the approval notice from USCIS and informed us that the case was sent to NVC for visa processing on 4th april 2016. So my questions are?
1.How long will it take the case to reach NVC?
2.since we are already having our case number at nvc, will there be a change in the number ?
3.Do we have to go through the whole procedure again?
4.If no to the above qn(3) , from where will our case be resumed at NVC?
5.Will we have any priority compared to the other cases as our PD had become current in sep 2015 (f4 category).
6.Will our ds 260 fee be expired?
7.Do we need to submit new i864?(the previous i864 was also filed by the new sponsor).
All replies would be really appreciated. This case is kinda out of the box .. so i couldnt find answers to the above qns in any other forums. So thought i could get some insight. Thanks again .

Who can help us answer these questions? Please

No, my case did not transfer to BIA, and the officer who denied my case reopened it and approved at the same time.
Asmahan what documents did you submit? Was it CR1 visa ? because I'm in the same boat
-
Yes I answered all the points and submitted all what I have of proofs but the need something I think financial obligation between us. Anyway they said I have a chance to appeal the decision through BIA, with more evidence within 30 days.... So i need help ,should I appeal with a join tenancy deed for a home I just purchased here in the US or forget everything and start OVER ???

You can not rely on what someone else submitted, each case is different and there are varies reasons for a return.
Answer specifically all points listed in a NOID.
Eunoluwa, I answered all points in the NOIR, and submitted more proofs of our relationship, but they still denied it and requesting more, that i why i'm asking for specific evidence of genuine marriage to them....It's all about....

I was denied on 28th July 2015 and nvc received the case back in around mid January this year and forwarded it to USCIS on February. On 1st march USCIS sent us notice that they have our case back and they are reviewing it. On August 11th they sent us NOIR and we responded 30th August and they received it 31st August. On 7th September they reaffirmed the case and sent it ro nvc on the 23 September. Hope this can give you an insight to how long you will wait.that means from denial to reaffirmation is 15 months for our case
bravagreen, Please what documents did you submit to be reaffirmed? Can you help me with some clue? Mine was revoked but was given another 33 days to submit more evidence
-
Just from reading on the internet, appeals are not usually overturned and is a lengthy process. Could we have more details of ur case, if you don't mind.
dmh59, Now they sent a notice saying that the revocation notice was sent and I should follow the instructions and submit the requested materials, what is that mean? Are they still requesting more evidence?
-
What do you mean dismissed? Did you get a NOIR letter and you responded b answering all the denial post and you got denied?
Need a little more details here. Just to let you know just refiling doesn't fix anything if there are issues. And appeal how did USCIS make a mistake. You would have to show that.
dwheels76 ,Yes I got a NOIR and responded by addressing all the issues raised by the CO in Ghana, I also attached more proofs even with a sworn affidavits from her father and brothers , more photos receipts of remittances but this people still dismissed my RFE. That is why I need to know the best way forward
-
What do you mean ? You want to appeal a failed appeal ?
Did you receive a NOID/NOIR and respond to it and USCIS denied you or what are you talking about.
Details needed. Reason for denial needed.
Ebunoluwa, Yes I responded to NOIR and the case was dismissed, No letter yet to know the details and if I can appeal. Will the appeal works ?
-
I don't know any details of your case and suggest you consult an immigration attorney.
You need to post the NOID requests, the CO's findings and what exactly your response was.
Then you must overcome the reason USCIS did not reaffirm your case.
That requires an understanding of what exactly went wrong, fixing it and then proceed with whatever meets the criteria.
So Ebunoluwa can this problem be solved?

URGENT HELP NEEDED:
I just learnt that our appeal is dismissed after submitting more evidence to establish our relationship, Please can I DO NOW ? Should I REFILE OR APPEAL the decision? and what is the process of the appeal? Or just look for an attorney to face them?
-
dwheels76 ,Ebunoluwa and other VJ members, what can someone do next when the NOIR appeal is dismissed? Is it better to refile or appeal the decision of the USCIS to dismiss the case? PLEASE HELP ME
-
NVC wrote just let me know our case was reaffirmed and was in transit to the Ghana embassy. We will be notified by embassy when our interview is scheduled.
Monalisa22 ,Please how long did it take to receive this NVC letter after responding to NOIR with more evidence?
-
robinanis, I responded to their NOIR letter, and they had it, Are they gonna reply us with like NOA ? Or it's going to be another long silent wait from now?...Did you or anybody in this situation received NOA for NOIR?...We sent a lot of evidence i.e Affidavits from the family members, Photos (a lot) and some other documents....

You are welcome dear we suppose to be one another's keeper especially in a time like this I really know that it is not easy I know when I was passing through it thinking that it is not going to work but when I got my visa it was like a nightmare please don't hesitate to ask me any question or help I will try to if I am in position of doing that thanks so much I still wish you the best
norishing2007, my question is about the NOIR cover letter I'm attaching, Is there any clue about the best content of that letter or is just addressing the CO's points?
-
My dear nyala I can see what you are passing through keep pressing forward and continue committing it in prayer you are going to overcome the circumstances I really understand what it means to be without your love ones we are here praying for you that sooner you are going to join us in united states I wish you the best please don't give up your miracle is on the way
norishing2007, thank you sooooo much for your very encouraging words, you make feel better as if my case has been reaffirmed and approved .May the Almighty God listen and accept our prayers, to get pass this terrible experience.....Once again thank you my VJ member

Send the original, keep a copy and yes you can mail it in a large envelope.
Add cover letter with name, DOB, case number, A number, address and list the items you are submitting.
Ebunoluwa thanks, I just added what you suggested: DOB, Case Number, LIN #.....I'm going to amend the cover letter on monday while waiting for the rest of the documents to arrive.
-
You can include a copy unless the letter instructs you to include the original.
Ebunoluwa thanks, but their letter did not even ask or instruct me to include the original or a copy, but I think it will be better to include a copy to them like you suggested. ..Please what about using my own larger envelope instead of their small envelope they included in the letter? The evidences I'm sending won't fit in theirs.
-
Of course you send back. I believe their letter says to please put letter on top of your evidence. Just sending the documents like how will they know what to do with it.
Send the letter.
dwheels76 thanks for your advise, although their letter did not say that but your explanation make sense, so I will make a copy and send the original of 3 pages. 2nd Question: The return envelope they included in their letter is too small for the documents I'm sending ,so can I use my own larger envelope to them?
-
Then type it word for word or find someone who can post it, there is a image URL you can post with that I guess.
Ebunoluwa and others, I have a question: Do I need to include the USCIS Bar Coded NOIR letter in my response ? I just want to be on safer side...Please help
-
dwheels76 and the helpers on this great forum, I have a question for you: When responding to a NOIR , is it necessary to include the USCIS bar coded NOIR letter sent to me? Or I should just send the documents? I'm confused....Thanks for your help
-
Hi Folks we are also gathering our documents for our NOIR letter .the evidences will be ready next week to go. PRAY PRAY!!!!!!!!!!!!!!!!!
-
You need to e going over each denial point and address each with evidence. Whether its pictures, affidavits, communication. You submit for each point.
I have always told people make a cover sheet fr each listed denial and focus on that item and get your evidence.H
Having insurance and accounts together when you don't live together doesn't impress the CO's focus on the points mentioned in the letter.
dwheels76, thank you for your clear explanation, that is exactly what we are doing now, we hope this will be the final part to this long and stressful journey
Time for interview after appeal (split topic)

Hello VJ members here, My wife's visa was denied on Monday November 30, 2015, and sent back to US, I rebutted with NOIR, and It was revoked in August Last year, we appealed and won. The case was sent back to DOS for visa processing again. I called NVC and I was told that the case is already in Accra waiting for new interview schedule. What should we expect now? I emailed the consulate 3 e-mails but no response
