Ebonoluwa, I just received the NOIR from USCIS today and would like some clues about the evidences to be submitted, The letter is not specific about the evidences especially when one spouse lives in the US and the other resides overseas. So I need help about what documents can help reaffirm our case...

It means they are actively working on your case, can't say if it is negative or positive, just means they are working on it.
I hope and pray that it yields something positive for us. Fingers cross. AP in Ghana is a HELLLLLLLLLLL

Yes you can. They will likely only answer the senator's inquiry and not your emails but nothing
wrong with you trying.
Ebunoluwa ,there is another update to my case today July 19, this is about 5th update since November 30, 2015 without me contacting them. Is that something positive?

Nothing else you can do except for what I suggested. When you have done that then all you can do is wait with occassional
inquiries. You just have to wait out the long process of return and re affirmation of about a year.
Ebunoluwa, can I still send my inquiries to the Embassy in Ghana although the Senetor is also on the case?. Is it Ok to do that? because I want to send some inquiries now

Ghana does their own thing. It is not normal nor should it be. Ghana operates that way, sorry.
You would have to try to get your senator to ask detailed questions to get an answer and request that it will be send out
as soon as possible. Not saying that works but it's worth
1. Why is the case still there
2. What date will the case be returned
3. What is the diplomatic pouch number that it was returned in (if returned already) to keep track of the petition.
Ebunoluwa, Thank you sooooo much. I'm so frustrated about the whole issue. don't even know what to do next or where to go .....but we are still hoping that something positive will happen.

No one can say how long AP will last, a certain pattern can emerge and is embassy specific but in most cases each AP
length is different because there are many different security and background checks and name hits.
Ghana is notoriously slow in following up after AP is completed or even getting the case to the right agencies to begin with.
We were in AP for 16 months, denied and re filed and were finally approved. Others have been waiting for years, one member here
for 10 years but that is rare and not typical. Weeks, months, years.....nobody knows.
Just send the embassy an email every month or every other months and let them know you are still waiting for a status update.
You likely will not get an answer at all from Ghana but keep at it. They will contact you when AP is completed.
The unknown and lack of transparency and no updates is the scary part, I can relate.
Ebunoluwa thanks for your statement. the surprising part of our case is that, the case is still in Ghana according to USCIS when my senator contacted them, so my question is: Is that normal to keep a case there for more than six months? Because the visa denial Form 221g says 6 months. Any explanation to that ?

OMG!!!!!!!, This is our 7th month in AP ,no news from neither USCIS nor the Embassy, It is scary. Is AP takes that long without response?

My kind advice for you is to take your mind off the case processing issue and keep your self very busy .... As for my own very self putting down this note, I've come to love the slow process system of Embassy and USCIS it makes me and my wife feel stronger each passing day. My second advice! Contact your Senator and congressperson they will help you contact your local emassey and make inquiring on your behalf regarding your case if your case is still with the embassy it need to get to USCIS as soon as possible so you too can start counting your own 180 days who knows USCIS might answer you before the 180 days it happens to a friend of mine so the same thing might happen to your own case because cases are different.... Again, go through this site very well you will see lots of other people from your country that goes or going through the same thing as you so you can learn from them too. I wish you all the very best....
blessedchild thank you sooo much. I have already contacted my Senator and they wrote to USCIS to inquire, is that normal? They sent me a copy of their inquiry to USCIS. and that it takes about 30 days to hear from them...I hope it works

Hi Nyala62 husband has his interview on 04/27/2014 they keep his passport and even did fingerprint then in 08/21/14 embassy give him his papers back and told him that case was going to be send back to USCIS. I keep calling the embassy to see what can I do but they told me that I need to wait for enogh cases for them to send his paper work so long story short case was send to USA on 12/21/2015. first it was send to NVC they received my case on January 14, 2016 because i call ans it was send later to USCIS (01.22.16). then i received an email and text

I call to see what i need to do on my end they told me to allaow 180 before contacting them again about my case so here i am waiting for Agoust 1 which it should be my 180 days and meanwhile keep acumulating trips phone calls and everyting that i can to make a good case.
gtrimino, Infact I'm confused and disturbed about the whole issue. My case is still on "Administrative Processing" since Nov. 30, 2015, three updates already but no changes in the context, It still says:"............The process takes several weeks, and if we need something we will contact you....etc"

Folks, my spouse is on AP since November 2015 and updated twice so far, is that a good sign of good news?...Has anybody got approval from this AP thing in Ghana?

Your case is not in AP checks (even though your online ceac says AP) but was said to be returned and you have to wait about a year.
I mentioned before the steps that will happen for you with the NOID/NOIR letter.
I also said what to do immediately to try to keep your case from being returned.
AP means administrative processing and is not always security and background checks but in your case indicates the petition return to USCIS.
They should say 'returning petition' but they say 'AP' with the online notifications.
Your senator can request the location of your case, as in has it been returned yet or is it still sitting in Ghana. That's it.
It won't help or hinder your case but lets you know where your petition is.
Ebunoluwa, Following is what the ceac AP says: " Your case is currently undergoing necessary Administration Processing. This process can take several weeks. Please follow any instructions provided by the CO at your interview. If further information is needed you will be contacted, if your visa is approved it will be processed........." Is that the normal and standard context of APs?, Kindly clarify for me.

Ebunolowa , Dwheels &Folks, I'm seeing my senator about my over 4 months case still in "ADMINISTRATIVE PROCESSING", Do you guys think that may help the case in any way? Normally what do the senators do or say to the CO?..
When I called the NVC to check the staus of the case ,I was told the case is still sitting in the US Embassy back home, since November 2015, Is that normal?

Once in a rare while it is kept for a second (or third) interview at the embassy with the help of a senatorial request.
They will usually just ignore your email requests.
Some of those are approved and some still returned.
It helps when the petitioner would be at the interview if granted and bring the evidence needed to overcome the CO's doubts,
again, it helps to know the reason for refusal.
You can try contacting your senator/congressman and request a second interview with you there and additional evidence.
Don't be disappointed if it is not granted.
Ghana likes to sit on refusals for many months before returning them to USCIS and in that case it may help to request through a senator
for the petition to be returned within a decent timeline rather than collecting dust just sitting there.

It likely means that it was processed to be returned or has been returned. Or the section chief signed off on it for the return.
So is there any chance of keeping the case there at the Embassy? by any means to fix the problem? Or the case will definitely be returned regardless?

There's nothing to do really but wait. It's taking at least 4 t 6 months for petitions to even leave the embassy and USCIS is taking now about 1 year before they contact about petitions. So its a waiting game now. Sorry.
dwheels, thanks for your quick response, but my another question is: What does AP status updates mean, as my case was updated thrice since the interview on 11/30/ 2015, and yesterday 03/29/16 was the third. Is that mean anything positive?.....Thanks

What exactly does the 221g say and what box is marked. Either you are in AP waiting for background checks or your case has been returned
to USCIS, which is it ? Please be specific in order to get specific answers.
Ebunoluwa thank you , The 221g says: " Dear Petitioner, We are unable to issue a visa in the above mentioned case because the applicant has been found ineligible under section 221(g) of the immigration and Nationality Act (INA)..............We will return the above case file to the NVC, which will then transfer the case to the USCIS.....
I can not write all what is in that white paper.
So now can I call them? and what is the number to call ?Or should I wait for the USCIS to contact me....I'm desperate

Yes because they have to transfer my case from London to Accra since I was living in London when we started the process and so many checklist etc.but to God be the glory.I woke up this morning around 8 am to check my case status and it was already issued.wishing you the very best.

yes that's normal. You are over 7 weeks away. They usually won;t send over 30 days away. Probably 1st or 2n week in November it will go.
