Can anyone shed how long 'average' filing waiting times are for VSC - above it says they are working on April 2012 - are they for real??? 11 months to remove conditions??????

It has been a while since logging in to VJ! Wow, although it feels good to be back! So I thought this time of my visa journey would never come! However, it does not come in pure happiness.
My ROC is up later this summer and we have enjoyed a happy marriage upto a couple of months ago. Due to turning events, we are going through some struggles and I am very concerned about where this leaves me and my options for the upcoming ROC.
We are trying to work through issues but currently it does not look particualry strong so, i am hoping for some advice on my options for ROC. I understand I can file with a waiver but with that waiver you must have the divorce decree, well in the state of NY, I have to be sepearated for a year before filing for a divorce so if he decides to be uncooperative in terms of signing paperwork and we are not divorced and only seperated by the time of filing, what are my real options?
We have a bonafide marriage, we own property, wills are made out to each other, all life policies are each other as reciepients and I have no issues trying to prove that we entered in good faith but how do I proceed???

Hi Dave
I am waiting on my interview - same day as ur medical 11th March. London know wont schedule any interview until the embassyhave recived your med results. It takes 4 working days from ur medical for them to recieve it - and then they book you in and write to you with your alotted time. My medical was on the 10th February and I have been booked for interview on the 11th March.
Dont forget u know have to pay for the visa in advance ( again they wont schedule until uve paid) and get packet 3 sent asap as it takes a few weeks for them to log it!
Good luck - any questions let me know
-
Congratulations!! I just completed my medical today and hoping for a swift interview - i will hold my nreath!!
I see your from Bristol - me too

Looks like they are picking up speed and getting July done although there are still many people waiting and the are still behind on petitions!! But all looks good right now
-
Yeah we've tried everything now.. I think we'll still call once a week but other than that I think we'll just have to wait a wee bit longer.. thanks folks..
I think it will be within a week
-
I dont understand what the hold up is but byt the looks of it they are starting to churn the rest of July's out although i really dont see why this is taking so long for yours. Have you been put through to higher escalation and also have u tried the vermont email?? x
-
Yours has GOT to be coming soon - we were rec'd by USCIS on 21 Jul and just got NOA2 today. If yours has had no issues, I'd guess your NOA2 is coming. My guess is that the holidays kinda threw a wrench in the "five months" thing. Technically we were 5 months and two weeks.
That's not to say USCIS doesn't suck -- they do, but I'd chalk that more up to the bureaucracy than the actual pencil pushers who look through our stuff. I'm sure they work as hard as they can.
Still, call them, get in touch with your congress-people, and just keep pushing for answers.
Congratulations

This is a USCIS mistake until proven otherwise!!

Hoping someone might be able to clear this up for me as i have seen much conflicting things/ ways.
Do the London embassy - ive looked in the regional posts - but need very recent - do they scheudle the interview before they have the medical results? I know that u need the medical results before attending interview ( they must have them) but will they still schedule u in for an interview date? The reason why I ask is the waiting time for interview is about 6 weeks i think if not longer and didnt want have to go do medical before I can even send my forms in and be scheduled - i.e it would make much more sense to get the interview date and then whilst waiting, do the medical??? Am I right or do they not do this?

lucy! hiya sis...just noticing this post...how does one get to talk to a senior member of staff?
The call centre only escalted to tier 2 when we called for the 4th time and was a week over due. Only then did they say they would submit a request and we would hear back within 30 days. In the meantime we were sending emails to VSC also hun x

Thanks for everyones help and posts, i called DOS this morning and NVC recieved yesterday and now has a case number. They have said it will leave NVC tomorrow
Feels so nice to have something moving

Hi Ben, positive thinking and patience are the two ingredients that will get u through this oh and more patience. Its a hard going process.
U can judge where ur peititionwill be adjuticated from where the petitioner lives? Which state do they live in?
-
You need to call USCIS and see what is going on. Technically, you are a june filer so you are out of time framebut the RFE is a slight set-back and depending what is was for and how long it took you to get back to them will depend on how much it is delayed - its worth calling and seeing whats going on - it cant do any harm.

You've been given some good links, so take the time to read them. NVC just assigns a case number and passes the K1 off to the consulate in about 3 days total. They don't put K1s in their automated system. The IR1/CR1 visa people who actually send their forms and payments to NVC will be in the system. Speak to a person. Call late at night.
If you had read Dodies link, it says this (in red even)
For the NVC:
K1's are not tracked through the AVR, EVER. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator. To get there:
1-603-334-0700
Press 2 for Non-Haiti-Related issue (Please note that this will probably change after some time)
Press 1 for English
Press 5 for an operator
About the evidence. It was just a tip to point out that London is not Manila. People always say they will take it "just in case". Well I've actually been to the interview in London and read hundreds of reports from interviews for just shy of 3 years now. Nobody has EVER been ask to show evidence of their relationship. Keep it simple.
Work on getting your immunizations done at NHS now. That will help you at AOS time and save you money too.
Ok thanks, I wasnt aware that K1 didnt go through, i assumed all would but I will check again soon. I have all my vaccs up to date ( went and got them done a while back -a little keen and hopeful I guess), got full BC and police certificate. Just need to get some american sized passport pics done and start filling in forms to get ready to send to interview.

Get emailing guys!!!!!! 1 word of advice though only the petitioner can call/email for privacy and data protection - i got told to go away and so I ahd to forward the email to Matt to then email straight on to them as they wont take enquries from the beneficiary so if like me your OH needs a kick up the butt and u do all the chasing but they are the petitioner - forward it to them first then get them to send it to vermont from there email and there name!!!
-
I used - VSC.Ncscfollowup@dhs.gov -i dont even know where i found it now - think on USCIS website some where, the email above was the second one I sent, the first one I got a reply saying go away about 6 days after, i then sent this. I gave up on the call centre until the night before approval when our call was taken by a senior member of staff. We tried all angles.
-
This was the email I sent to Vermont directly as we were getting no where with the call centre. Other than call back in 30 days, call back in 60 days and one nonce who said he couldnt even find the petition and asked was I sure I filed for a I129F!!!! I recommend emailing them directly and it took 6 days to get a response.
''The previous email was submitted by the petitioner, Mr Matthew Poletto. He has called many times to the national centre and all they can offer is a answer which 1) doesn't make any sense 2) to contact you directly, of which I am trying to do. The channels of communication for this procedure is something that really lacks any postive remarks on my part. The national centre does not know any relevant information on our petition and simply reads from the script that they are told to do. And to think, the money we paid for this is taken so quickly, yet we are still waiting after the deadline and not given one decent update. Any private business that would operate this way would be out of business within a week.
Again, I will re-iterate, the phone line that is contactable does not provide any useful information and this has now well past its 5 month deadline. I am in contact with my congressman, of which is making an enquiry on our behalf. This petition needs immediate attention. I will not stop emailing or calling until someone, of either some authority or knowledge, gives us an answer of when this will be looked at. Something of which should of already been done.
I would appriciate a response that gives us some decent information about our overdue pending petition.
Thank you
-
If u read through the July VSC forum, there is a few u will see there is still July filers waiting all getting the same response, it does indeed suck balls
-
Thanks Guys all alot of help, ive heard London doesnt ask u for proof usually but to take it anyway just in case. Also, i was under the impression that NVC do update u on thier automated line? Or so it seems as it accepts my EAC number just says we have not receieved it yet!!
-
So just tried to call NVC but they ahvent received it yet
-
Ok so lets take one step at a time lol
NVC are to yet receive the case, and i need to keep checking on the automated line to see if it is recieved and get the LDN number.
Then I will tackle DOS after I know its left NVC!! XX

Thanks for all the replies!
As for joint bank accounts, we kept them seperate because of circumstances to us, I understand many people say that once married, your money is my money and so forth but we each don't see it like that. We have a joint account ( but I think I am just beneficiary) that we use to pay bills and each keep our own sepearte accounts. I have printed and highlighted those account statements for the last 2 years where you can see our each sepearte account paying in the same amounts as each other for the last 18 months. We are both l;isted as beneficiaries on each other accounts though.
Driving license is a little difficult because even though I submitted our change of address ( after we bought the house) and DMV have not chnaged address yet!! I am also going to ask for a copy of joint lease when we were renting after we got married. I also have membership to many spouse support groups of my husbands work - that I have documents for. So I will use that. I also have lots of photos of trips together and joint passport stamps, in particular my sisters wedding this year gone int he Carribean.
I just dont have a such listed joint bank account with him or credit card because we dont use one.
I am going to gain references from many people, my sister in law, work collegues, and also our joint marriage advisor who we have seen a few times to help us through this insane process!!!
I feel like I am missing something......
