  1. Good morning all :-)

    Could anybody tell me if i really have to send a new AOS form with my checklist response, even there was nothing wrong with it? They only requested the 2013 tax return again for my son´s case.

    It would make things sooo much easier. I could just send it right away, without having to wait for my husband to sign a new one and have it mailed to me. :clock:

    For checklists, you only need to send back what was wrong/missing. If your checklist didn't mention the I-864, then no, you don't send another one.

    my husband (USC) and I discussed agents.....agreed that none should be it but that I should be the one doing the main contact, but I'm rethinking this and wonder if he's the one doing the paying of bills that he be it. What are your thoughts on this?

    anxiously awaiting to have this entire process done....10 months at uscis was brutal!!!

    Doesn't matter who you choose as agent. If NVC has both your email addresses on file, then you'll both get correspondence. Most people choose the US petitioner, but honestly, it doesn't matter.

  3. I'm getting a little ahead of myself but am just wanting to do as much research before I get to the point where I have to send our documents to NVC. I see there there are two options for sending the documents and once you select a method, you can not switch it later, is that right? Which method is preferred? The email or actually mailing it all in?

    Electronic Processing (EP) is only available to a few specific countries, Tanzania not being one of them. Your only option is to snail mail packages in.

    Thank you for responding - I will do just that. It's a bit of a pain as we are in Ireland and the joint sponsor is in Florida, but not as much of a pain as getting a checklist from the NVC, I'd say :)

    I'm not sure 100% if you'd get a checklist, but in this case, since a checklist costs 60 days, it'd be better to fix it now.

    If you trust your joint sponsor, you can always send them your documents, they can then add their documents, then they send everything to NVC from Florida. Might save some time ;)

  4. Hi everyone, sorry to jump into the thread however I figure you guys will know the answer :)

    We are sending our I864 in the next week or two, however the one from our joint sponsor was signed back in May... we got a bit ahead of ourselves - do we need to get another one or is it ok being a few months old?

    That's more than just a few months. That's nearly an entire year old. I'd definitely get a new I-864 form signed (and updated if anything has changed in the past year).

Hey does anyone know how extensions work for filing taxes ?Is there a criteria ?and if it can be done does my husvand take the extension letter with my AOS form I sent to NVC with 2013 being the previous year or do I update it with 2014 being the previous year with a estimated amount in there since I wouldn't be filing ?

    I'm not sure what the criteria is (look on the IRS website for that), but yes, you can file for one during this process.

    You would still leave 2013 as the most recent year on the I-864 forms (you can't put an estimated amount), and then just bring a copy of the extension letter to the interview (if it's after April 15th). Anything before April 15th, and 2014 taxes aren't required.

  6. Thanks for your quick response Saylin, so how will they count my household member? My i-864 count me and my wife ? my parent count themself with any dependent they have and me and my wife? Do they count we all together and we need the income that qualify for all of us?

    Your household size will be 2 (you and your spouse), unless YOU have dependents, then it'll be more.

    On the joint sponsor's I-864, the household size will be at least 4 (themselves, their spouse, the immigrant, and you [since they claim you as a dependent]). If they have any other dependents, then the household size will be more.

    Can someone help me with question regarding i-864? I believe someone in this forum may have same situation as me. So I am the petitioner, I filed my own 1040 but with very little income. So i need to borrow my parent income. My parent file tax return jointly and they claimed me as their dependent on the tax return. We also live in the same address. So I am so confuse now if I need to consider my parent as joint sponsor to have one of them file their own i-864 and another file i-864A OR I need to considered them as my household members and have them both file i-864A? Very appriciated if someone can hep me clarify this. Thanks so much!

  8. Saylin you have been wonderful with you guidance .Thank you!! I was married in 2014 to my wife in the Dominican Republic and our CR-I is currently under review at NVC. I filed my federal taxes mistakenly as single status 2 weeks ago and included that transcript with my AOS package that I submitted on 1-31-15 to the NVC. After reading Your NVC Process Wiki tonight (re: tax filing status) and realizing my error, I filled out the Tax Amendment Form 1040x, to change my status to Married Filing Separately as you recommended. I will mail this to the IRS on Monday. I would just like to verify that this is my best course of action, and I seek any other advice to minimize backlash or interview repurcussions from this. Thank you very much.

    Just make a couple copies of the 1040X and bring it to the interview to hand over.

    If for whatever reason, you end up getting a checklist for the AOS, along with the checklist response, include a copy of the 1040X as well.

  9. Hi! My wife sent the I-130 with paid fees and all necessary documents via USPS Signature confirmation on 12/03/2014. Since then we still haven't heard anything!

    As I've gathered from VJ, we should receive NOA1 by now, right? . Only thing we have is USPS delivery confirmation stating that the application is received by the USCIS on 5th December! signature confirmation indicates that D Van Arsdale signed it....

  10. So, we just sent our AOS & IV packages on 1/29. They arrived on 1/30. This afternoon I got this checklist. I called NVC and they told me they didn't have my documents yet, but my package arrived is now in their mail room as of today and is yet to be scanned in...

    I'm betting this was generated because you completed the DS-260 at the beginning of last month and they hadn't gotten your packages yet. This is standard from NVC, so nothing to worry about :no:

  11. Perhaps a stupid question.

    When we submitted the I-130, I had got all my ID except my passport swapped over from my maiden name to my married name. I sent in evidence of this along with the I-130 and filled out the I-130 in my married name. After that, I got my passport in my married name. My new passport is what will be used for everything.

    Get to NVC and everything they're sending us is in my maiden name. I called and asked about this and they said it doesn't matter and that attempting to have it fixed at NVC level will result in a supervisory review and add up to 42 days to my wait time. All ID is now in my married name (aside, of course, from birth certificate) and I am still concerned that they will attempt to issue my visa in my maiden name when the time comes and I will have to have it reissued. Is there anything I should do or will they actually take care of this?

    The visa is issued in the name on the passport, and the green card is issued in the name from the visa. So, if your passport is now showing your married name, that's what your visa will be printed with. You don't need to do anything on your part; the US Consulate will do this automatically.

  12. Very true. Although it has def failed at handling increased call volumes. Waits are only increasing. And I was kinda thinking this could be interpreted as either one re-vamp or two seperate. First being adding nonimmigrant visa cases which they've done. And secondly, putting in new phone infrastructure. Who knows maybe they just need to increase the staffing of reps to keep up. Either way the panel that is represented asks a lot of the questions that many people ask on this forum so at least the issues are being presented to NVC in some way.

    "Beginning in early 2015, the NVC will begin fielding telephone inquiries on nonimmigrant visa cases. The NVC’s telephone infrastructure is being revamped and should be in place by midFebruary. The new infrastructure will allow the NVC to handle the increase in call volume."

    Although I agree the wait time apparently hasn't decreased much, they did revamp the menu options. But, it was just implemented and unfortunately NVC has had some closures due to holidays and weather, so I'm thinking the call volume is up because of that. So, hopefully we'll see better wait times when calling over the next few weeks (if the weather will be kind to NVC, haha).

    Some of the statistics were pretty surprising like the amount of post going in and out. And the amount of congressional inquiries. The article also says the phone system will be re-vamped in mid February although I won't hold my breath! Also says they are pushing to have all countries with electronic processing pending a software rollout in late 2015. I imagine that would eliminate a lot of issues (lost documents etc).

    The article said it'll be completed by mid-February, which it already has. It was done in January. So, they actually kept their word on that ;)

    I'll have to read the rest of this once I get home. I should be working :whistle:

    I'm not self employed. I did not mark self-emplyoyed in form I-864.

    I only submitted IRS tax transcripts to NVC. I didn't submit any schedules even though I have filed Schedule E with my tax return.

    Is that OK or will I get a checklist from NVC for that ?

    In the instructions for I-864 (page 6), it says to submit schedules only if we are self-employed.

    If you're not self-employed and you didn't file jointly, then tax transcripts are sufficient.

    Not sure what a Schedule E, but does it not show that information on the tax transcript?
