  1. Well I am also in a same boat (which I almost started to believe a sinking TITANIC until this morning. I am June filer and my 5 month frame period is very close to pass. I called USCIS and luckily I was able to reach to reprentative and he told me that transferring case to other service center does not affect 5 month period, it does not add up more months and you can always call back when you are certainly out of stated 5 months period. He also told me that reason for this transfering is that now Texas office is processing special cases which may include finalizing process as well (although his first words were I AM NOT SURE BUT......)

    Which may prove good news for us..

  2. Checked uscis site, my case is without changes. I think it is good sign that yours transferred. I heard that when VSC was overloaded they sent bunch of petitions to local offices and CSC and these people got approval very fast. Now i am worried

    If it follows the pattern of when VSC transferred a bunch of applications to texas, then it is very good news. Quite a few people received their NOA2 in a matter of weeks rather than months.

    Hope this is true this time as well.

  3. I'm wondering if anyone got the notice I did. My petition was transfered to Islamabad, Pakistan. I think this is good new, praise the lord.

    How on earth is this possible :unsure: your consulate is Moscow, Russia. If it needs to go somewhere other than US is Russia and not Pakistan i am confused :bonk:

Today marks the 1 year, 3 months, 8 days, point for me sighhh, I can't get anywhere with USCIS , I spent from July 24th 2009 in California service center, then they transferred to Vermont and told me my 180 day wait gets to start over again. And in December of this year, the 2nd set of 180 day waiting will be over

    They should just approve me , and realize how they are hurting 2 married people that have tried so hard. Where is the compassion? I'm starting to feel as if its discrimination

    From the underline comment above, transferring doesn't seem a good news to me :( . But still crossing my fingers. I think they have done mass outsourcing of I-130 today that's why a lot of I-130s are getting transferred to Texas.

  5. was just notified that my cases were also transfered to texas. Message I recieved:

    On November 1, 2010, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to our TEXAS SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283

    Got the same message. I hope its good. Surprisingly my I-129 is still at CSC or it might not have been updated yet.

    The first problem, however, occurs if they age out of the petition, meaning they turn 21. Since I don't know their age at this time, it's anybody's guess if this will happen.

    The B1/B2 will not be invalidated, and in theory any immigrant petition should have no adverse effect at all. That said, every time a tourist enters the U.S., it's at the CBP agent's discretion to allow them to enter, or determine the duration of their stay by issuing an I-94 accordingly. You just never know what's going to happen, just like in real life.

  7. If you enter India on a Tourist Visa you cannot re-enter India for a period of 60 days from your exit of India.

    In other words, if you entered on a Tourist visa from the USA, then left to Thailand, you will not be able to come back to India from Thailand for 60 days.

    There are two exceptions to this 60 day rule.

    1) Get special permission to re-enter India from the Ministry of External Affairs

    2) Get a PIO or OCI Card. Both these statuses have no 60-day restriction. Only Tourist Visas have 60-day restriction.

    It will probably be much easier for your husband to get a PIO card, this can take less than 20 days to receive at the Indian Consulates in the USA.

    Actually she has one more option. I am assuming that your husband is of Indian origin. If he does not want to get PIO or OCI card he can apply for entry visa. India has now stopped giving tourist visas to person of Indian origin.

    The two month gap rule only applies to tourist visa and not to "entry visa". I have been through this problem myself didn't know any better and didn't have time to go through OCI route so decided to get the "special permission". At the end i got the "special permission" but it was such a pain to get this because they wanted confirmed tickets to Mauritius (that's where we went for our honeymoon) from India before considering our request. I wrote a letter and pointed them out that on your own web-site u guys have wrote to not book flight before obtaining visa then how can i buy tickets when i am not even sure if the permission will be granted. But they didn't want to hear anything finally i decided to buy tickets and send it to them. The whole process took 1 and half month i got my US passport back after probably making 20+ calls and at one point i even told them that next week i need to leave for India for my wedding and i don't want to get the special permission please return my US passport back but they finally decided to grant one just two days before my India trip. Also i had to register in India and i was asked about this at all the immigration counters and airline counters. Trust me it's pain. My advise would be to get "entry visa" or PIO card, because u don't have time for OCI now. The first thing i did before leaving for India was to apply for OCI and already have it so no more "two month" rule for me :dance:

    But he is in USA and I am not sure if USA has a separate Islamic law for Muslims. He is seeking legal advice not religious.

  9. I flew Virgin Atlantic, Emirates and Air India. Out of these 3, Air India Direct flights (JFK-BOM, though air India has canceled that flight and now only option of direct flight is JFK-DEL) are the best. I would pay any price to avoid a stopover at London Heathrow (The worst airport in the world). For me, nothing beats Air India.
