  1. We use skype every day, phone calls, text messages (I can text international for free). We always say and know that this wait will be worth it, once we are together we will never be apart again. Here I try to organize and sort through things, make room in the dresser and closet. Sometimes I get a little down...We support each other. We both exercise, which helps to relieve stress. It is hard for me, I do not find myself enjoying outings with friends, etc....always thinking of my fiance and wishing we were together. Sleeping at night is becoming more and more difficult. Nothing like insomnia, but waking up a lot, not solid sleep, etc. I know this will all soon end and I will sleep like a baby. I know this will make us stronger.

  2. I'm not trying to pick on you. Sorry if you feel that way, it wasn't meant to be a personal attack upon you. Everyone who has told this person not to pay the rent is wrong. I am simply saying what I know to be a fact. I have been in the Real Estate business for almost 30 years. The advise to stop paying rent is what most people think is the fair thing to do. But is not the legal thing to do. Let's avoid giving people advise based upon what we think is "street justice".

    The last thing a person wants is an eviction on a credit report and non payment of rent is a sure fire way of achieving that. Then try to lease a new place to live.

    I do have one question however: If he (or she) can't "find the landlord" how have they been paying the rent up to this point?

    If in fact they really can't send the rent, they should attempt to send it to the place they were sending it to and then when it comes back, keep the check and the envelope along with the checks and don't spend the money. Get a new place to live as soon as you can.

    This is not a real estate matter, this is a legal matter. It is NOT against the law to send a certified to the owner stating intentions and to deposit money into an escrow account instead of paying it to the owner. If the owner does try to claim an eviction, it will be 30 days until the court hearing is scheduled. At that time, the tenant can bring all the evidence of letter sent, foreclosure, proof of funds in the account, and state the concerns about security deposit (the security deposit by LAW should have beendeposited into an interest bearing account by the owner). The judge will then make a decision, and the decision will NOT be to give the owner all the rent money....it will be less the security deposit if he orders back rent to be paid.

  3. Thanks LADUQUE13 for sharing that with me... that was really helpful. To tell you the truth, I don't know whether these condos have already been foreclosed or is up for foreclosure... I need to talk to my neighbor who got the letter to ask for sure what the letter said. I'm going to take your advice and look through the court system database just to make sure!

    So are you saying that after we get a notice on the door, that we only have 2 or 3 days to move? I spoke with an attorney and he told me that we would get a 90 day notice to leave, but I'd rather hear from somebody that's been through it.

    No problen. You should have plenty of time before the notice is on the door. The bank probably is unaware the property has tenants. I ended up not paying the rent and having enough money saved to secure back my deposit. What KIRKIT posted is exactly the process, great post!

  4. hello! I live in Florida and went through this before I purchased a home. I was renting a house and one day got a notice that the bank was filing for foreclosure. I did have a year rental contract, and I was only four months into it. I stopped paying rent at that moment and send the owner a certified letter that I will not be submitted payment to him as I do not know wether he has the security deposit. I instead will deposit my monthly rent into an escrow account until further notice. I also stated I would be looking to live elsewhere right away. Since the paperwork stated the mortgage was 9 months behind, he had rented me the property knowing he was not paying the mortgage an the property would go into foreclosure. He would not return my calls at this point. The fridge broke down and he refused to fix it...so I just kept a log of everything. Then a realtor came knocking on my door saying she was hired by the owner to do a short sale and if people could see the property. Lovely, huh?

    If the house was foreclosed on, they bank would have put a notice on the door stating 2 or 3 days to vacate the property. You should have plenty of time and notice before it gets to that stage. You may be able to find out a lot of public information online with the owners name through the court system database. I even contacted the foreclosure lawyers and let them know I was renting the property and they included me on any further communications. Here in Florida, foreclosures and taking months to process, so you may have a good amount of time to save money and deposit on another place. In some situations, the banks are actually drawing lease agreements with the current tenants. I am not a credit expert, but I do not think the owner can put anything on your credit report.

  5. Once i had all my documents together i punched the top of every page with two holes and used things we have here called "file fasteners" they individual fasteners that you bend out at the back to keep the pages together.

  6. Our K1 interview is now scheduled for Dec in Bogota (yeah).

    If we wanted to travel outside the US after POE entry, but before the K1 expires/marriage date, from reading here it seems that you have to apply for an AP (?) upon entry.

    This would allow the K1 recipient to exit/re-enter.

    Reason I am asking is that we are unsure if K1 child will come immediately, or to follow.

    Does anyone know how long it takes to get the re-entry permission?

    I agree with baron555, your fiance will not be able enter into the US again, until you file after you get married and cards are issued.

  7. We sent the documents to the USCIS on July 22nd and they recived it on July 29th, but the case is still in initial review.

    What is NOA1 and NOA2?

    The NOA1 you received stating USCIS received your petition. NOA2 is received after your petition is approved and sent to NVC. You can find more details of the process in the Guides Section here. Please update your time line. Thanks.

  8. Does anyone know if an immigrant has to pay out of state tuition fees? I can't seem to get a straight answer from anyone locally, so I need to be able to argue the point in our financial favor! :devil:

    Yes, unless you have state documentation (usually a valid DL) for more than the residency requirement. You may want to look into talking to the financial aid department to see if there are any grants or other financial aids available. Good Luck.

  9. I have a question … Im traveling this weekend (by plane) within the USA ..

    i dont have my Green card yet or any type of ID … (Only my Visa pretty much)

    My question is … Will that be ok to travel with ? or do i need some type of state ID , showing that i live here ??

    I know traveling within the usa you dont need a passport .. if im correct , So can i just use my canadian drivers license as a ID ?

    just not sure really on what to use haha..

    can anyone help ?

  10. Hi everyone! I 'd like to bring my sweetheart from Ukraine to over here some time next year and have a question. Will a possible denial of a visitor's visa affect the decision for K-1 when I apply later? She wants to travel to US to some distant relatives of hers to participate in a baptism ceremony of their child and other things related to that. They will be sending the invitation and doing the rest of paperwork for that trip. Is it still the grounds for denial if my name is not there? Being eventually with me far outweighs in importance the trip to the relatives so is it worth the risk, if there is any? Thanks in advance!

    Denial of a tourist visa does not have any weight in the fiance visa decision. Best of luck.

  11. My fiance came over on a K-1 Visa. We were married yesterday and are now filing the AOS in a hurry (Visa expired 11/26). Our petition included his 9 ear old son whom we placed on "Follow To Join" status in the Dominican Republic which meant we have up to 1 year to get him and bring him here with us. Now that we are married and we are filing the AOS I know what I need to file for a basic AOS but do I need to file all the documents for my step-son as well...especially being that my step-son is in DR still?

    HELP PLEASE!

    It's my understanding that the AOS for the son is to be filed when the son is here. If the son was here then you can file the AOS for your husband and son together. Congrats and good luck!

  12. ..So I made an account for case updates right (when was it last touched..) and before that I checked for our case status using our receipt number from NOA1. So far, we're only on the second circle which is "Initial Review". and this is what it said:

    "On November 5, 2010, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283."

    Anton, (my fiance) filed for our K-1 visa September this year (Vermont Service Center) So I was wondering, how far along are we? What decision are they talking about? - for NOA2? There are many stages and sometimes it can be overwhelming. Would appreciate any insights. Thanks.

    Hello! I'm not sure why they received the petition on Nov 5th if he files in Sept....it's about 5 months from the Nov 5th date. Yes, the decision would be the NOA2. I'm not sure how long it takes your embassy to schedule interviews, but if you click on Portals up top here on VJ you can check out all the information people provided about your embassy location. You fiance will have to come to your country for the baby delivery. Also, under the K1 Guides area thee is a helpful time line so you can see al the phases in the process. Congrats and good luck!

  13. So I just want to make sure I'm following along here. If after Nov 23rd, I'll file the I-129F form to start the K-1 Visa process. This cost should be $340. After the I-129F is approved, it will be sent to the embassy in London where they will schedule and interview with my fiance, correct? He will have to pay approximately $350 in fees as well as a $200 medical exam fee with Knightsbridge, correct? Once that is approved and he is able to fly over here, we will get married. Once married, we will file an I-485 form which the new fee will be approximately $985 and a biometrics of $85, correct?

    Does that sound about right?

    I'm starting to think I need a flow chart!

    This is a complicated process.

  14. Hello - I'm new to the forum so please forgive me if I'm not in the right place or need to be pointed somewhere else. My fiance and I area about to start the K-1 process. We are getting our I-129F package together, but I have a question about the fees. I know the current fee to send with the 129F is $455. And I know my fiance (from UK) will have to have a medical exam in London and possible vaccinations. But is there a fee he will have to pay in London at the embassy for the actual K-1?

    And after the K-1 is approved and he comes here for us to get married, we will file an I-485 correct? Which is at this time $1010?

    But I'm trying to figure out if there are any other costs or forms with costs? I just want to do a tally of all the $$ we'll need :)

    Why do they make it so dash darn expensive??? hahaha

    Yes, another $350 for the actual visa to be issued at the embassy. The 129F fee is going down to $340 if you file after Nov 23rd and AOS is going up $55.
