    I called yesterday and was put through to "level 2". After being on hold for 1 hour and 10 minutes the phone went dead.

    I am certain this was a mistake, however with my work hours I will not be able to be on an elongated call for the next week and half.

    As I have heard nothing from USCIS I am concerned that my petition may have been lost.

    This process has been stressful, as I am certain you can imagine and any information you can give me regarding my petition would be very welcome.

    The posted processing time on the www.uscis.gov website indicates that at least one case filed within that timeframe has moved to "active processing" at that office. This means that at least one case filed in the posted timeframe has been moved to an adjudications officer's desk for review. This does not necessarily mean that a final decision has been made on all cases received within that timeframe.

    I just wanted everyone to know that they do respond to email. vsc.ncscfollowup@dhs.gov was the email address I used.

    I sent a similar email to that VSC email....and 11 days later I got the EXACT same response. Well not exact, they replaced your name with mine. I suspect they never even looked up my account at all...funny how 'Officer Jason' responded to me too. Meanwhile I have a service request in with VSC via telephone, I contact two Senators. One Senator sent me a generic letter saying they contacted USCIS on my behalf and I will hear back in 30 to 45 days.....the other senators office actually called me and said they called USCIS were advised to call back in 30 days...but the lady at the senators office said she knows I need my fiance here and she will call every two days until they give her an 'application is approved' response.

I wonder how your fiance would feel about that....AND all of your posts calling people names and cursing. I was gonna start having those T-shirts made in bulk and send them to my friends...let me know if you want me to send you one too!!

    You can be straightforward without being rude, disrespectful, calling people names and using profane language. When the interview comes I will be the happiest person in the world....but since Peru is a 5 hours direct flight for me....I may hop on a plane tonight and have a spectacular weekend. Besos!

  3. ITA agree with the poster on page 5 who said that I think people here should be allowed to vent their frustrations. If not here, where? If you see a post that is clearly a vent and you don't like it, don't open it.

    SO true. I want to be having an engagement party, going to look at venues and cake tastings together, and all that fun newly engaged stuff and CANT. awesome.

    You know exactly what I mean. People all handle this situation differently, some are calm, some are upset, depressed, frustrated, some have mood changes by the hour. If people feel the need to vent here on VJ, I don't mind at all. Whatever makes everyone feel better....but when YOU make statements like

    That is an insult to VJ, all people that come here for help, and all the people that have been through the process completely but still come on here to help people who are new to the process. I would hate for a new person to come here, read your statement and decide to never use VJ because they think this is what we are about.

    People turn themselves into monsters...not VJ. So if you want to nitpick that you can't delete your account...you can message Capt Ewok with the request, you can delete it from your favorites, you can turn off your email notification or stop refreshing threads so often.

  5. They get how many petitions a day? Not just K1's, but many, many others, too. Is there enough time in one day to process a thousand applications hat come in each day?

    If they were able to complete all applications that came in from a day in one single day.. then I'd wonder. But they can't. Plus, they aren't open on the weekends so there is no one to process those. So even if they got all the applications from one day done that day, they'd still be getting a backlog of two days for every week.

    If you hate dealing with them so much, pull your application. They are going to work on your paperwork. Be grateful it is only five months instead of like.. three years.

    AGREED!!! I am hanging in there by thinking...ok, it's been over 5 months....so the finish line has to be in sight B-)

  7. This is wrong information.

    VJ says that you can call after your DATE RANGE has passed. However, my estimated adjudication date came and went and I wasn't even at my five month mark yet. Calling USCIS wouldn't have done anything for me.

    Only call when you reach your five month mark, which I believe the OP has. Even then, it may or may not help seeing as people are waiting nearly six months and they will likely be told to call back in 30 days.

    That timeline is solely based on other VJ members getting approvals. Don't read too much into it.

    Wrong information?? Did you look at rickrocks NOA1 date?

    Jan. 11 is past due, according to your timeline.

    rickrock, like joyjoy is saying, you were past due on Jan 11th, you can call the uscis now to inquire if you choose.

  9. Has your fiancee' gone for his physical yet and do you have the date for his interview. By what you said I figure he will get the interview in Feb 2011. Here is one thing my wife got her Visa issued on 26 Feb 2010 and the visa was good till 24 Aug 2010. So if no physicals or interviews have been done yet you can do all of it at once and be within the 6 months this also gives you a very good option to bring hig him right away is bos son at the same time, everything will be done without more trips and paperwork. There are many benefits of bringinth of them can adjust at the same time, and lets not forget about you there is adjustments for you too :yes: . The other question I have does the son have a passport so that the K-2 Visa can be put in it or will it be in father's. Like I said in a previous post we waited till he was finished with the college there I wanted both of them to be here at the same time so I waited, and my wife was not going to let him stay there alone even though he is 17 and the own the apartment :lol: Like Jim said you can setup classes for his son and his father will be able to help at the same time while he waits for his EAD (never know how soon USCIS will get done with it). I'm sure you know how from one day to the next the processing times can change for the better or worst. There is a lot to decide but I know the 2 of you will figure out the right way to do it. :)

    Thanks for the support :) No physical yet, but all the certifications have been gathered and legalized. Yes,the son just got a passport. I have also been wondering if we do get the K2 now and use within 6 months for the son, is it possible the son travel with another family member for POE or must he be accompanied by the K1 or petitioner?

  10. Your questions are more about "what would you do" and less about the technicalities of the immigration process, so I'm going to offer some personal opinions. :blush:

    I think you should bring your fiance's son here at the same time your fiance comes. It's actually a good thing that your fiance won't be working for a few months. He'll have time to spend with his son, and help his son acclimate to the US. If his son speaks little or no English then his son can enroll in English immersion classes, which will give him a little head start before starting school.

    Personally, I think it will be enough of a shock having to move to a new country. Getting tossed into a summer camp shortly after arriving would be twice as hard. The more time he has to ease into his new life, the easier it will be for him.

Yes, I was looking for what would you do and what others have done, etc. Also I was looking for opinions regarding the K2, as far as when we should obtain it if we still go with the 'will follow' route. Initially we were going to obtain it with the K1 and use it within the 6 month period allowed, only to avoid having to go to the medical, embassy, last minute plane tix twice.

    I could not find any situation similar to mine here on VJ, with the child immigrating with the father. Great idea about the immersion classes, I will look into that. Right now we have the rosetta stone english for him. All the schools here have the ESOL program, with may instructors/students speaking spanish...so I am hoping that will be a little easier for him vs no one speaking his home language.

    No, I would not include it. It is not considered evidence. I don't think there is a way to prove the attempt was to visit you. The denial will not have any bearing on the fiance visa decision. Peru is very difficult for tourist visas if not married and a not a lot of money in the bank, home ownership, etc.

  12. Physical and visa fee would still need to be payed for him. What I meant there is no additional charge for son when you filed I-129F. K-2 Visa is good for 1 year, just checked to make sure. Every AOS has different timelines all mine is being done in Kansas City, MO and I believe it was 72 days approval for EAD and AP for my wife and stepson, My stepson is 17 so filing AOS for him was full price just like his mother, but if he was under 15 I would have had less cost on his AOS, so that means you have a advantage over what I paid. You would already be married so applying for K-2 after can not be done so do the K-2 with fathers K-1, like I said his son has 1 year to follow K-1 Visa.

    I forgot to ask is his son listed on the I-129F? Or did I miss that?

    Yes, he is listed on the I-129F.

  13. Hi Sundrop and Nadila & Eric. Sorry for not giving more info before.....I am the USC-Female, my fiance is the beneficiary-Male. Currently my fiances son lives with his mother but he spends a great amount of time with his father and stays with his father some of the time also. He would prefer to live with his father, the mothers household situation is not ideal. There has never been any formal child custody arrangements and the mother has agreed to give the father full custody for the boy to come live with us in the US. This paperwork is being processed now.

    My fiance wants to be the provider and contribute to the household financially, but he knows he will need his work auth papers first. We of course would like the time alone together, but mainly we had decided to wait to bring the son so my fiance can adjust and get himself situated. Also since school starts here in August, we were thinking of going back for him in July so he can relax get used to the new environment for about a month before school starts. We will both be working so arrangements for summer camp/etc can be figured out by then also. The additional fees for the AOS aren't as much as a concern for us as the additional trip to Peru will be. We have time to rethink and change plans, but if we stick with the same plan the main current concern is that my then husband will not get travel papers in time for July...so he will be stuck here. If that happens we will need to decide if ...I should go for the boy, possibly arrange for a family member to escort him here, or wait out the travel papers....it's my understanding the K2 has validity of 6 months, so should we get both the K1 & K2 now, or wait and get the K2 when we can go back to Peru.

    Nadila & Eric-When you say 'no additional charge for the K2', do you mean it is not an additional $350 at the consulate?

    Looking for advice. I think I know the best route but I wanted to see what others think or have done.

    My fiances son will be obtaining a K-2 to follow. We are hoping my fiance will have the K1 next month (Peru consulate interview is about 1 month from NOA2 date). We would like to bring my fiances son here in July and so he can start school in August. We are thinking it would be best this way so my fiance has some time to adjust, find work, etc.

    My question is about when to have the K2 issued. Initially I wanted to have the K1/K2 issued together, but I believe the K2 will expire in 6 months. I really wanted to avoid going for the medical twice and the embassy twice and waiting on the visa to be issued twice and not being able to schedule plane tix until the last minute twice. We would like to use the K2 within the six months, but if my fiance does not have travel papers, we will be waiting on that to visit Peru again..... unless we can arrange for a family member to escort the boy here ( he will be 9 yrs old then).

    It seems like I need to wait to have the K2 issued and follow procedures <_<

The first person I talked got basic information from me was about to fill out a service request (It was obvious he was not looking at my information on my case.) and then I asked to speak to a higher manager. The higher manager was looking at my information and that is when he apologized for them being behind. I asked about putting in a service request and he said he could not do it. He said the request would only have someone like himself look the file and that is what he was doing right now so there was no need. I am not sure if this is true or not and I may call again if I find out from someone else here that I would benefit from it. I feel like we are getting close but I have only seen one approval in the last two days and Monday is a holiday.

    I wonder if what he said is accurate? I thought a service request was sent to your service center and it wasn't possible to talk to your service center through calling the uscis line. If what he said was accurate then you got done what they told me would be done in two weeks with a service request. :bonk:

    Anyone here know?
