  3. So, the areas we chose are:

    Orlando, FL.

    She went there a few years ago and she loved it. I, personnaly, have never been there.

    The idea of having Walt Disney World near us is something we would both enjoy.

    But after reading some comments about the area, I'm not sure it's something we would enjoy this much. I might be wrong though. I really don't know much about this area, so if you have some things to tell me about this, i'll take it!

    I've been in the Orlando area for the past 11 years and I hate to say it but I like it, I love the beaches, the theme parks.. I avoid Disney (wall to wall small children and strollers) and tend to go with Universal way cheaper (about half the price of Disney for an annual pass) and more adult themed activities and events not just rides. I might be liking it so much because I don't have children and most importantly I don't live in Orlando proper. I'm about 45 minutes outside it. Honestly I couldn't live in Orlando too many people, too much crime and the traffic is horrific at times some of the drivers don't make it pleasant either but that might be true in other areas. Housing outside Orlando proper can be very reasonable even for a new build. I will say one thing however about Florida is there's no state income tax and they (the state) could care less about teachers. There's an unpopular governor in office that gutted education, conversation and just about everything else he could get his mits into. I've found that salaries here tend to be on the low side compared to other metropolitan areas however so is the cost of living. One big benefit to Florida is no snow, ice or winter at least here in central Florida however summer time is brutal to put it mildly.

  4. I've been back and forth through Dublin to the US since 2005 the majority of which has had me going through US Customs and Immigration in Dublin. I didn't do my POE in Dublin at the time the flight (Aer Lingus) left later in the day. I did POE in Orlando which didn't take more than an hour from what I remember (it's in my timeline). Each time I've gone through Dublin I of course go through the regular security and bag weigh in. Downstairs in Terminal 2 is where I renter the US it's been easy and straight forward. Non Citizens fill out the required Customs and Immigration forms and wait to be processed by Immigration and Customs. Citizens and US Residents do Customs forms and join a (sometimes smaller) line. Once your through with Immigration Customs will do their thing and your good to go.

    I tend to always to check in for my US flight as soon as possible and get through regular security and US Customs/Immigration then wait. As others have stated sometimes that line is fairly short and sometimes you'll wait a while.

  5. Hi everyone,

    Today my fiancee had her interview at the Embassy in Dublin. Everything went perfect until they stated that she had the wrong form for her military service. My fiancee was a Captain (officer) in the Irish Army. Per the instructions on the website and what they told her in person, this is what we need:

    The problem is, nobody in the Irish military seems to know what this form is. For starters, the office that the instructions reference is no longer there. Additionally, my fiancee was an officer, not enlisted. She's an admin officer by trade and is well connected to that community... but none of her peers have ever heard of this form.

    Naturally, she explained this to the embassy personnel, but they wouldn't have it. They stated this wasn't the form they need. When my fiancee asked them what the form looks like they responded they do not know because they've never seen it.

    We're in an awkward spot and need urgent assistance from anybody who has applied for a U.S. visa that has served in the Irish Defense Forces.

    What form did you use to satisfy the above statement? Can you please post a picture (sanitized, of course) so we can give some guidance to the folks in the J1.

    I'm curious if you got this resolved.

  6. I am posting here to help my friend.

    I will make the story short without going to many details how this stupid situation happened in the first place. She married her now ex husband in Jamaica and entered U.S. on K1 visa. Her ex husband filed I 485 and let the immigration know about the marriage in Jamaica. Of course, her application for adjustment of status was denied.

    She got the letter from the immigration stating if she does not leave U.S. as soon as possible she would be inadmissible to the U.S. in the future.

    My question is if there is any waiver or any hypothetical situation that could still allow her to get a permanent residence in the U.S.?

    I'm lost here.. you said "she married her ex husband in Jamaica and entered U.S on K1 visa" You can't enter on a K1 if your already married? Filing for a K1 then entering on it while married is fraud. That alone is enough to have her removed. Since she's no longer married to her husband she's not got or really ever had a legal leg to stand on in order to get through AOS. Anyone moving to a country that not speaking your language should do one of two things, learn the language (no matter how backwards and confusing) or be prepared to be out in the cold communication wise while in that country. If I were you I'd have her leave before she goes beyond the grace period provided by USCIS otherwise expect her to be detained and removed eventually. Depending on the length of her overstay she might be barred from retry for a period up to 10 years. That is unless she hires a lawyer to find a way to remain which will be costly not to mention she'll need an interpreter. This is assuming she doesn't bump into husband number two before she's removed and proceedings are started for AOS.

  7. Cool, I will try to stop worrying. I have planned a vaccaction by mid June and then a trip back home in August so I really hope I will have done the interview by then, as I would so hate to re schedule...

    I was going to do the same next summer (go home for a trip) but decided to call it off just in case I get through this then end up waiting on a US Passport. That'd just be my luck.

  8. I've had the same issue however just filed my N400 two weeks ago. I pulled an additional report (I forget the name of the report) for 2011 reflecting salary, amount paid in Taxes and the fact there was a 0 balance carried forward. I'm hoping that should be enough I'm also willing to bet I won't get an interview until after the new year by which time I'll have filed another year's worth of tax returns. I also have copies on file of every 1040 and confirmation it was accepted by IRS since I started to file taxes here just in case.

  10. Guys, when do you think I should resend my package? USPS says it was received on Nov. 14 by Phoenix, AZ 45034 instead of 45036. First it was available for pick up in box at 45036 as needed, but delivered to 45034. It was a first class envelope with RRR, which tracking shows just acceptance and nothing else. No signs of cashing my check or notification or anything :(

    I'd wait at least a full week see if there's any movement. If the check gets cashed you should be moving along.

    Unrelated, I too received email and text notification today (11/16/16) that USCIS has offically received my application.

  11. I hate to be blunt to the OP but sounds like you got used, horribly by this 21yr girl. What age is the OP if you don't mind me asking? It also seems as if the OP wants to live in the US? If I where you I'd sit tight get your AOS over with then leave her one you have your temporary resident card in hand. Get your life moving forward if you can then hire a lawyer to get you through removal of conditions when the time comes. Worst case you get denied along the way and sent back home. Heading home is still an option to ease the damage from what seems to be a train wreck in progress.

  12. I came over on a k1 visa and have been married since 02/0315. We have a daughter 21 months old. Were divorcing, likely contested. I am LPR status until January 2018. I want to know what I can do to remain in the us for my daughter if we divorce. I know we don't meet the 2 year marriage condition yet but we may before we divorce. I have a good job here also.help... Please

    I had a similar experience a number of years ago (2009), unless things have changed since. I came in on a K1, acquired my temporary resident card and before it expired I'd left my then wife. From what I remember at the time as long as we where still legally married when we applied for Removal of Conditions all would be good. Conditions where removed just a couple of months before we where legally divorced. I'd suggest if at all possible delaying divorce until removal of conditions have occurred. If you can't I believe you can still put forward a case since you have a child and are already a LPR without obvious intent to defraud for immigration benefits. You may need to do additional research either here on VJ, I'm sure other members can assist if your divorced before you apply for removal of conditions. Worst case is you hire a lawyer and go that route.

    When does your resident card expire? If it's soon I'd apply for removal of conditions as soon as is possible more importantly before the new regime ascends to office.

  13. I'm concerned as to how my health insurance will be affected by the new president.

    Currently I receive healthcare through my work (state employee) and I picked this certain plan because everything under ACA (Obamacare) is covered at 100%. If it's not ACA then you pay out of pocket. Since I don't expect to go to the doctor for anything besides my annual checkup I thought this was a great plan (has other great things I don't need to go into).

    If ACA is repealed, what will happen? Will I have to pay for EVERYTHING out of pocket? Even my monthly medications (covered 100% by ACA), and annual check ups (covered 100% by ACA)?

    Hopefully you get to keep your insurance however I'd wait and see how much the far right destroy come next year. I'd expect the worst, the new administration will cut costs and like all right wing governments that starts with any and all benefits given to we the people which is normally redirected in the form of tax breaks for the rich or to fund yet another disastrous war.

  14. @Vegasbound, I did include the form G-1145 with my N-400, I haven't received any notification as yet but I also did form G-1450 to pay using my credit card, and I checked my CC account online and there is a pending payment for USCIS for 11/10, so I guess that confirms that they received it. I'm thinking the package is on someone's desk to be processed and as today is a holiday it should be processed and get the email and text next week. Just hold on in there, the journey is just about to begin, in the mean time just practice those citizenship questions, I found an app for Android so when I got some downtime I just run through a batch of questions, https://play.google.com/store/apps/details?id=net.cm3d.free.uscitizenshiptest&hl=en.

    Looks like we have the same filing date, location and we both used the G-1145 and paid by Credit Card. I too noticed they reflect the $680 filing fee as pending on 11/10/16.

  15. I'd recommend going to https://www.acro.police.uk/Subject_Access_Online.aspx and obtaining a police report. If you were arrested without a conviction there's not a lot report. I'd still put it on your N400 and mark the date as approximate as you can. Ideally look over you previous applications to USCIS for dates and match those on your N400. You may even want to include a brief cover letter to explain an arrest, no conviction and the fact the dates listed are an approximation.

  16. Filing under INA 319 (b) means you dont have to meet those requirements.

    I'd follow the directions on N400 to the letter. I'd wait for the actual resident card in the mail but that's me. You can submit N400 without a copy of your resident card and submit a photocopy of the I-551 stamp in your passport in it's place. I don't know if that'll trigger an RFE which it might well do and you'll end up waiting anyway. It may not, they may accept it. I'd consult USCIS by phone for clarification assuming no one else here has something to throw in. I'm sure someone else in this forum has been through your process before.

  17. How long have you been a resident and married to the USC. Are you also in the military. I believe you need to be married at least 3 years and a resident that long before you can file N400 if your non military. From what I've read you can file N400 90 days before your hit that 3 year mark but not before it. Detailed instructions are in the N400s filling instructions on the USCIS website.

  18. I've updated N400 and preparing to file however I can't seem to find the biometrics form that goes with it? Are these still used? I did notice the latest N400 doesn't require any passport pictures however wants proof of marriage/divorce/death of US Citizen Spouse? To further complicate matters they want 5 years of Tax Returns however when I checked with the IRS they only have 4 years available for download. I've got copies of what I've filed but strange I can't get anything older than 4 years from the government. Then again by the time I get an interview I might have filed my taxes for 2016.

    I stopped by the college, I've shown them my resident card and all is good. I'd no idea "illegal's" as some of you like to call could qualify for any type of assistance?

    Slightly off topic but.. I mean in Florida you almost need the blood of a virgin just to get a drivers license. They want your social, old DL, password and/or resident card plus proof of residency. Then again when buying a home here the local county tax collector didn't consider me a resident and ignored my resident card. Instead had me fill out a form making me a resident in the county (which I've lived in for near 10 years) and pay the fee. I keep coming to the conclusion that in America.. it really is all about the money lol.

  20. This was the building my Brother worked in. The company had a Chauffeur and he was outside with his daughter when the bomb went off. The daughter was killed. If memory served me right it was on a Friday evening, defective fuse otherwise the toll would have been much higher.

    Going by your logic then all attacks against coalition forces committed by insurgents in Iraq and Afghanistan are completely justified. Just because you don't agree with the legitimate government doesn't give you the right to disregard the laws. PIRA and their like were nothing more than terrorists, as indeed were the Loyalist organisations who were just as bad.

    It matters not that you don't consider Northern Ireland to be part of the UK, what matters is that it is a part and subsequently your brother has misrepresented himself by previously claiming to have never been convicted.

    As I previously said, I would be very interested to see the outcome to your situation. The US has always seemed to have a very different opinion of Irish terrorism than it has of other countries, it can only be assumed due to the large number of American citizens of Irish ancestry.

    What I and you believe is irrelevant, the facts are simple. The British occupied and plundered throughout the centuries as they expanded their "empire". What will happen in Ireland is we will take back our 6 counties weather your kind like it or not. If you want to talk about the legitimate government of Ireland lets look at the general election in 1918. Sinn Fein won the general election on a platform of forming an independent government of Ireland. With a majority in the country voting for their liberty that revolutionary government was formed. The people voted to be free and the response from the British is as predictable as ever.. violence. That violence then was met with resistance. You've some cheek to dare claim the British government have or had any right in my country as a legitimate government. You can't steal something then claim it's yours.. by what right? No I'm sorry your kind ensured your loyalist offspring in the Northeast of Ireland would have access to information, weapons and whatever else they needed to act as your proxy terrorist force in Ireland. You can't compare Afghanistan to Ireland.. They were harboring terrorists and told to give them up. They got what they deserved in the end. We had hundreds of years of occupation, genocide, murder, rape and theft to deal with form our lovely neighbours next door.

    I believe in the principle of consent for the people of Ireland. We the people of Ireland (not the British or anyone else) will choose our own path, our own destiny on our own without any interference from the outside. That's the thing about democracy.. The British didn't like that in 1919 therefore they invented the North of Ireland to keep their rapid loyalists happy. See how that worked out for you.

    The US has a different opinion than the British because they understand something some in the British establishment refuse to comprehend. Theft is theft.. you can't steal another mans land and not expect to a response. That response can't simply be called a "crime" and that's that.
