Very good, thanks! Just making sure that bit of extra information didn't change your previous response.

Just to make a quick follow up. By "extra information" I meant the actual service center in the back of the conditional green card stated Missouri Service Center, which I wasn't aware of during my original post. And that's what I ended up using. But really, USCIS has all the information and I doubt any of these responses really matter.

For anyone curious this is what I ended up writing on the form. The actual service center we applied to and the location of the USCIS office for the interview. There was no interview for the 10 year green card.

    Part 3. Processing Information

    1. Location where you applied for your immigrant visa or adjustment of status - Missouri Service Center

    2. Location where your immigrant visa was issued or USCIS office where you were granted adjustment of status Los Angeles CA

Anyhow, there was no need for any biometrics and we got the renewed greencard today 17 days after we did the online application. Very easy and quick!

As I wrote before, in my opinion, application was made in Los Angeles.

My first GC has no indication of what service center processed it, and for my I-90, I answered Chicago for both questions, since that was where I interviewed. I doubt this answer matters. Put down what you wish.

Very good, thanks! Just making sure that bit of extra information didn't change your previous response.

The city the LPR lived in when I-485 was filed:

The USCIS office with jurisdiction over the LPR at the time I-485 was approved.

    no

If the LPR lived in Los Angeles, yes.

I have no idea why uscis asks these useless questions. Or why USCIS does not simply the answers on the GC like it used to.

Thanks so much for your reply!

I looked at her conditional greencard and saw that the location was MSC

Does this mean I should put Missouri Service Center for question one?

For question 2, I'm pretty sure it was the Los Angeles field office where we did the interview.

It's strange they bother to ask these questions, especially since the online I-90 application asks for scans/photos of the greencard.

    Thanks again for your help!

  4. My wife needs to renew her 10 year green card which will be eligible for renewal at the end of this month.

I'm having trouble with Part 3 of form I-90 , specifically these questions:

    1) Location where did you applied for an immigrant visa or adjustment of status

    2) Location where your immigrant visa was issued or USCIS office where you were granted adjustment of status.

We did an interview together in Tokyo for a K-1 visa, but this was a non-immigrant visa and I assume it doesn't apply here.

Is #1 above where we mailed Form I-485? And #2 where (the USCIS office) we did the interview for the conditional greencard? Or something else?

Does form I-751 (Removal of conditions) fit anywhere here?

I have copies of most of the forms I filled out for the K-1 visa, greencard, and removal of conditions, but I don't remember where we mailed out the forms. Or the address of the USCIS office where we did the interview.

We filed from Los Angeles, CA. Is there any way to know what actual locations we used for the above? Or should I just get the addresses from the forms' instructions?

I just noticed these in my timeline:

    Adjustment of Status
CIS Office :     Los Angeles CA

    Lifting Conditions
CIS Office :     Vermont Service Center

Is it as simple as Los Angeles CA for both #1 and #2?

    I'd appreciate any advice.

  5. How necessary is it to punch holes into the documents when submitting the I-130 packet? It says “appreciated” in the instructions, but I am afraid I will screw it up or punch the wrong documents. Do we have to hole-punch every single paper? Is it just 2 holes at the top?

Don't hole punch anything. There have been contradictory instructions on this topic. It's best to just use binder clips.

  6. I've made a few posts about this topic in the past. I attended the interview along with my wife at the Embassy in Tokyo.

The interview was very short and the interviewer called me and asked me some questions as well, so I definitely participated in the interview process.

Considering one of the two requirements for the K-1 visa was having met in the last two years, it made things much easier. We were given the approval right away and got the visa two days later.

Here is my Tokyo Embassy Review:

April 20, 2011 Embassy Review : We arrived at 7:30 for our 8:30 interview.
We were let inside at 8:00.
We emptied the contents of our pockets into baskets and went through metal detectors. We didn't have any electronics with us so we didn't have to leave anything with the staff. The staff was extremely polite and the experience was very easy.
We were greeted by someone at the front desk. She gave us a folder with instructions specifying what order to put our documents.
We went in and got a number (#001). When called we gave the packet.
I definitely overdid my I-134 docs since it felt more like I was trying to support 10 people!! (50+ paystubs, tax transcripts for 4 years, etc)
About 10 minutes later, we were called again and my fiancee had to give fingerprints. Then they gave a bulk of my I-134 docs back.
About 30 minutes later, we were called again and we had the interview. I knew I wasn't allowed to do the interview with her but I went up anyway. The CO told me to go back and he would call me if he had any questions.
    He asked her the following:
    What's your fiance's name?
How and when did you two meet?
    Does he have any siblings?
What is his job and where does he work.
Then he called me up and asked me about my work. He asked when will we get married and I answered.

He had commented that since I visited Japan 10 times I probably spoke better Japanese than he does!

Then he said "Congratulations, your visa is approved." It took me a couple seconds to understand what that really meant but after that I had a giant smile!! :energy:

We left the Embassy about 9:30am. Overall a very straightforward and easy experience! We got the visa two days after our interview! smile.gif
  7. This is an interesting question and unfortunately I am not an expert on the matter, so I can merely give you my opinion.

When a couple has a joint account, it usually means they both are equal owners with equal access to the account. It does not mean that they both have to concur on the usage of the account for every transaction.

Therefore, I think the answer to your first question is no, the I-864A form is not needed. If you did go with that route the assets would be counted twice as you found out.

  9. It was a little more than a week ago when my wife and I were looking at the list here and wondering when we would be approved. For some reason I felt inclined to reassure her that we would definitely get approved on Friday. It just felt like it would be our day.

On Friday we were in the Chicago museum of science and industry as part of our weekend trip to Chicago. We were sitting down and lightning and loud noise were being generated up above as part of a demonstration.

As the lightning struck, I got a text message. It was from the USCIS. Our petition was approved. Friday turned out to be our day after all.

And now we wait for the actual card to be in our possession. Then we can make our travel plans to Tokyo for the end of the year without any worry. This will be my 19th trip to Tokyo in the last decade, which is amazing to me since I never imagined I would visit Japan let alone so many times.

Once we get the new card it will be the end of our USCIS journey. We've decided that my wife will keep her Japanese citizenship which will allow me to get a Japan spouse visa in the future, in case we ever decide to move to Japan.

Lastly, best of luck to everyone still waiting for approval. I hope everyone's petition is approved as quickly as possible.

  10. I would think, if you want to change your last name, you'd have to change it with Social Security first and have a new SS card issued with the new name. Then get your driver's license updated with the new last name.

My wife went with making her maiden name into a middle name. It's up to you if you prefer the hyphenated last name. It might be easier to finish the I-751 first and then change your last name.

My wife also registered our marriage with her koseki and updated her status with the LA Japanese consulate and her new Japanese Passport has her new last name (my last name).

  11. Again, thank you all for your considerate replies to my original post:

I know the smartest and simplest decision I can and should make is to remain in the U.S. and miss the conference. The dilemma is that I'm nearing the completion of my Ph.D., and attendance to international conferences like this one actually constitutes part of the job interviews with my prospective future employers. I will continue to think about this issue. Maybe flying using mileage (so I can book even a few days in advance) may be another option should my AP arrive before I leave the U.S.

I've done my research, and the answer is: DO NOT LEAVE WITHOUT AP. So I'll take this into serious consideration. Again thank you all.

Even WITH AP it was difficult for us to come back to LAX from Tokyo. My wife had to go to secondary processing for additional questioning.

  13. This is just my opinion, but if your lawyer doesn't even know the proper place to send the petition, I would highly question his abilities throughout the rest of this process.

If you have a pretty straightforward case, you might not even need a lawyer. But I don't know your situation and certainly can't give advice one way or the other, but I've read on here about lawyers screwing people (and a lawyer gave my husband and I bad advice in the early stages - we were stupid in following that advice).

I hope USCIS forwards the petition to Chicago and doesn't reject it. Good luck! :-) I don't know if you should cancel the check, you may have to wait and see what USCIS does first?

I completely agree with this. I wouldn't trust the lawyer's abilities if he doesn't even know the correct place to send the petition. And barring any complex situations, you are much better off without a lawyer. The process can be lengthy but is usually very straightforward.

Also, there is no need to cancel the check. Either the petition will be accepted and forwarded, or it will be returned with the check.

  14. After we married, he wants me to have a new credit card and adds me to his bank account. I was like," hmm, Baby, I already have 4 credit cards, what am I supposed to do with those?" He was like," we'll see but you still need a new credit card here, laughing.gif ". I don't think he really answers my question!innocent.gif

My wife still has her Japanese credit cards and we still sometimes use them (when ordering from Amazon JP). But really, having credit cards is easy (I have 10+) it's paying the bill at the end of the month that's the issue. laughing.gif

  15. Hi everyone! Congratulations to all the approvals biggrin.png

We received an RFE letter today. I knew it!! Hahaha

It is dated February 10th. (Can somebody update the chart for us, please? smile.png )

Gar, let us join the team RFE wink.png

We are going to call and ask them what we can provide, because we don't have any of the things they listed.

We don't have a joint account, we don't have any car payments, the lease and all the utility bills are on my husband, we don't have any children at this point, we don't have joint credit card.

Only thing we can think of right now is to have our neighbors to write a letter.

Or just tell them that they are always welcome to visit us, and schedule an interview with us?

Anyhow, not having the things they listed is just how we are, so we will have to see...

Sorry to hear that Neko! But at least it wasn't a completely surprise!

Did you by any chance register your marriage with the Japan consulate? I think it was called konintodoke or something similar. That's one evidence you can include if you have it.

  16. Advance Parole was not easy to use for us. We had to use it about a couple weeks before our AOS interview and coming back from a week long trip to Tokyo it was a mess having to convince the airline staff what the AP really was. Then my wife went into secondary processing upon return to LAX. You'd think that leaving for one week and coming back with Advance parole and all supporting documents would not be cause for trouble, but that was unfortunately not the case.

While extending the AP may be possible, it will not be an easy process, not would it guarantee re-entry. You may indeed be better off cancelling the current petition and reapplying again in the future. Unfortunately I do not know the extent of the ramifications for this.

  19. No. Not legally. Any lawyer who claims to make the attempt is only buying time for the K-1 visa holder. In the end, all is denied, dis-allowed, as

his entry on a K-1 visa has no other movement - either marry to the petitioner, file the AOS or go home before the I-94 expires.

I say, since he not pay any attention to the outcome of your research, prior, that he's not going to listen to any input you will have for his future life.

Employer cannot 'flip' a visa type. Is possible to get another visa, but visas are issued outside of the USA.

Finally, I'll say - the brother has an interesting lawyer - who apparently knows how to suggest to folk other means to remain inside the USA whilst waiting for adjustment of status casefiles to be filed. He probably knows all of the tricks that delay adjudication, so this K-1 visa holder will remain in USA whilst the lawyer's paperwork sits in the queue, gets reviewed, an RFE kicked back, another lag, then another lag, then improper stuff filed for the RFE reply, then a denial, then a motion to reconsider, etc etc etc, all keeping said K-1 visa holder in the USA for 2 years + whilst USCIS figures it out.

During that time, he'll be working illegally on something his brother cooked up. He will not be able to adjust status in the USA without marrying you and YOU signing an I-864 for the adjustment of status casefile. There are no loopholes around this, and the lawyer knows this as well.

That brother is a peach ! How very brotherly of him to have a backup plan for the K-1 visa holder.

This pretty much sums up what will most likely happen.

Anyhow, the bottom line is, as others have said, DON'T SIGN ANYTHING.

  20. O.M.G guys, I received a couple text messages, saying to check case status due to an update. Here is the message I saw.

On January 17, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I knew we would soon start seeing approvals, did not think I would be among the first.

This is excellent news!! So it has begun !!!

When coming back from Tokyo a couple weeks ago we got a few "this card is going to expire in a few days" comments and even showed the one year extension letter to the airline staff in Narita.

We're REALLY looking forward to getting the 10 year card so we can avoid this.

Of course this was nothing compared to the nightmare of using advance parole. That time they separated us and my wife had to go through questioning in a separate area.
