  1. Here's what I've been hearing. Overstay will be pardoned when married to a US citizen. So yes, that is an option, in fact that is probably your best option right now, cause if he leaves he'll be banned as squirrely said. So take a look at I-130, I-485 and see all the work you'll have to go through. ;)

  3. Well I think everyone here was referring to the child that's already in the US.

    Also I'd like to point out that there's no need to get upset about anything, people here are trying to help to their knowledge, if you think you know everything already and you're positive that this hypothetical case would be approved cause the mother has disappeared then tell this hypothetical couple to just go ahead and file and don't listen to what nice people are saying to help the case.

    I was just tracking my packages and they were both delivered yesterday! I am ever so excited! I guess now it all begins.

    Besides that I'm a tad worried cause now that I'm done with preparing the package I've started reading the site a lot more and noticing things that I didn't notice before. For example that I was supposed to send both packages (I130 &485) on the same envelope. I sent them on the same date, same office and they were delivered same time and together, but on different envelopes, is this wrong? :bonk: Can this lead to any problem? (like them losing stuff or not being able to put stuff together?)

    Also where it said which office are we filing at in form I-130 we didn't write Chicago, IL instead we wrote the office nearest to us, is this also wrong?

    I am freaking out *just a little bit* over this things. :wacko:

    Your USC spouse will file an I-130($355)and you will file an I-485 ($1010). You will assemble each application/petition package separately (including separate fee payments) and submit them together in one envelope.

    That is correct. Make sure you get a vaccination record from back home if possible, and you'd need around $200 for your medical where you'll get a blood test for syphilis and TB test. If you have a vaccination record, no vaccines, but if you don't vaccines may add up another $200.

  6. I would recommend a lawyer CharlieandLaura, either that or getting married and filing for CR1. As people repeatedly said I don't know which state you're at but were I am I can't go to state college until I get a Greencard and it's pretty boring, also I can't work or drive. So this hypothetical woman would be supporting a child and a husband (above poverty line) for a good amount of months while the paperwork is filed and you get an interview and such, not to mention that there'd be another child living in a different country.

    I guess every person has a reason to do things the way the do them, so this kind of decisions are very personal, but I'd be thinking a lot about the children. Other than that as everyone here said. The wife should file I-130 for husband and one for the child, husband would want to file I-485 together with working permit.

  7. Kitty, I was surprised at how quick things were at my CS. I had printed the I-693 myself but he didn't ask for it. He asked me to fill out a chart with my details (that he later on passed on to the form he printed out himself). He introduced himself asked me to sign the I-693 and date it, which I did (His copy, not mine), checked my vaccination records, wrote them down. Then he drew some blood and he did the TB test. He gave me my vaccinations record back and told me to go back in two days and get the results.

    When I went back two days later he gave me a sealed envelope and a copy of the sealed envelope so I could see the results.

    It was painless and a much better experience than I expected. Hope it goes great for you!

  8. Then what's her last name? I'm really confused. :P I'm from Uruguay and I have 2 names and 2 surnames (My dad's and my mom's). So I wrote my First name as first name, my middle name as middle name and both surnames as last name, cause that is what appears in my passport and my birth certificate.

    If you're using any of this to apply I would change the forms to match that of the birth certificate/passport. But I don't know if what you're doing is incorrect, it might be just right.

    * E-mails sent to a common friend dating from 2006 establishing relationship around that period.

    * Facebook messages and pictures establishing frequent contact.

    * Postcards I sent to my husband from over-seas while traveling.

    * My month roster for the months of May and September when I flew to New York and Toronto respectively as Flight Crew, and met with my husband; Highlighting the dates I was in said places.

    * My husband's e-mail confirmation for trips to New York and Toronto to meet up with me in May and September.

    * Electronic ticket reservation of our flights to Uruguay in November (His departing from the US, mine departing from Dubai).

    * Boarding passes of my trips to the US in February, March and May.

    * E-mail sent from my e-mail address to my husband's forwarding our bus ticket reservation for a weekend in New York, in May 2010.

    * My In-laws marriage congratulations card.

    * Our friends marriage congratulations card.

    * Cards received from family and friends who live over-seas, sent to the address where we live together.

    * Hotel reservation for our wedding night.

    * Affidavits sworn by family and friends.

    * A selection of our pictures from 2006 – 2010 and of our wedding.

  10. I suggest you call the place where you want to enroll and ask them what documentation you need in order to do that. Rules vary depending on the College and on the State. Here in Virginia I can't attend college until I have a GC, I called to the university I'm planning on attending once I get my GC and then said in order to be enrolled I needed it. So the best answer to this is just call and ask. It doesn't hurt. :)
