Perhaps you can have the surgery in Indonesia. If so, your sister can take care of you there while you recover.

I can not use my insurance over there.

Because she clearly wants to immigrate.   Consular officers are required to assess immigrant intent for tourist visa applicants.

It's hard to proof that she only wants to visit, I think.

Is it she a nurse or something? If you need just a família support for this period , immigration visa is not for this.

Even if she was applying for any other visa (not tourist) Will not take less than 1 or 2 years.

Sorry for that and I hope you get better soon.

She's not a nurse. I will need help to grab this and that  after the surgery. I dont need her to immigrate, i just want her to visit when i need her since tourist visa always fail, i just think F130 might work but i was wrong i think.

Nope.  She cannot come to the US to live via a sibling visa  until the visa is issued...in about 20 years.

what??? man, that's too long. I need her soon as my health condition is bad and i need help from her. I tried tourist visa but failed.

N.O. . There is not adjust of status too, just for you to know. She cannot live in the US without a property Immigration visa.

Do you have a Joint sponsor? Will your spouse be the one?

Yes, my husband will be a joint sponsor.

You can file without regard to sponsorship ability, because it will be TWENTY (20) YEARS before a visa number is available to your sister, and obviously your financial situation will be completely different then.

what is that mean that visa number will be available in 20 years? but she can come iASAP once they approve the petiton, right?

    1. If you are a U.S. citizen, you must file a separate Form I-130 for each eligible relative. You may file Form I-130 for: A. Your spouse; B. Your unmarried children under 21 years of age; C. Your unmarried sons or daughters 21 years of age or older; D. Your married sons or daughters of any age; E. Your brothers or sisters (you must be 21 years of age or older); and F. Your mother or father (you must be 21 years of age or older).

    2. If you are a lawful permanent resident of the United States, you must file a separate Form I-130 for each eligible relative. You may file Form I-130 for: A. Your spouse; B. Your unmarried child under 21 years of age; and C. Your unmarried son or daughter 21 years of age or older.

she is the sister of the USC

Do you have it in writing that he gave you permission to permanently move his children to Indonesia?  Or do you just have a verbal agreement that he may at some point say never happened?

I find it hard to believe that he gave you permission to permanently move his children to Indonesia and give you sole custody when he will not consider giving you a divorce.

    Just verbally.

Under US laws, you will need to file in Maryland where your husband lives for a divorce.  You can try to file by yourself or hire a lawyer to help you.  Indonesia has nothing to do with him.

The rules may be different in Indonesia.  Since he is a US citizen and lives in the US, an Indonesian court has little or no power over him.  You may be able to divorce in Indonesia but the US does not have to honor any of it.

    Thank you for the answer.

What is gonna happen with the kids you had with your husband plus the one on the way? Did he give you permission to take them out of the country?

Yes he did. I dont mind he takes away the kids if he win the custody.
