I got an RFE yesterday! booo. They are asking for proof that my sponsors are American citizens. Is that something I was supposed to send it originally?? I don't remember reading about that. Anyways, I'll send off copies of their passports and birth certificates today and hopefully it'll move right along

Do you mean in question B?
It asks to state your spouse and ALL your children, so yes I would assume that you would include them. After you do, theres a box to check yes or no if they are filing with you.

Mine still says unavailable.....I did call that number that is on the website. Of course when you punch in the numbers the case comes up as unavailable and they tell you to try again. So what I did was chose the option that I didn't know my case number or had lost it and got to speak to a person. I couldn't understand a word she was saying because she was talking so fast. Finally she said that she would transfer met to customer service. I spoke to someone there that looked up my case and said that it was pending the biometrics which I had the day before but weren't in their system yet. She said that there is a glitch in their system and some receipt numbers never work. So don't be alarmed. If you just want to check on things do what I did and choose the option that you have lost your receipt number and you will get to talk to a live person....Unless someone knows an easier way :-)

I suppose its not reallyyy necessary to check it haha it just makes me feel better. I have my Bio appt. already so I'll just be patient till then and then I'll probably start to get anxious about calling

Yeah I didn't get my NOA till today either. I didn't think I'd get my appt. letter so fast. I'm glad you got yours too!

If she comes here on the VWP with the intent to get married and then you try to Adjust Status, then she'll have technically committed Visa Fraud and your application could be denied and I believe, but don't know for sure, that she could have a ban placed on her. I wouldn't risk it! If it worked out so well then everyone from VWP countries would be doing it that way instead of staying apart from their fiances. If it worked out to do that, then I wouldn't have been apart from my fiance for 9 months! Just go about it the proper way.

Anyone else having problems seeing their case status on the USCIS website? I put in my receipt number and it just says that my case status is unavailable. I got my NOA1 on the 9th and my biometrics appt. letter was sent on the 13th. I would think it would be available by now!

I just got my Biometrics Appt. Letter in the mail! My appt. is for the 30th of this month. It came soo fast! They issued it only four days after issuing my NOA1. I loveee how this is going so far

You should have no problem. She just doesn't know what she's talking about. What if you just go back and try to speak to a different person or ask to speak to her supervisor. If they won't allow you to, then just do what someone else said and email or call them. I changed my name with no problem with just my marriage certificate. Sorry you have to keep dealing with her!

I would go talk to a lawyer and figure out what the next best step is. No one on here is a lawyer, nor are they God. They have neither all the information or the right to judge. Good luck on whatever you decide to do!

I agree with the above post. Wait a few more years till you get citizenship. It will make it so much easier for you, going back and forth. While I think it would be possible for you to do as you're saying, I personally wouldn't want to risk losing my greencard.

Ok, well final answer I could get out of them is that I either need an EAD or Notice of Action (I-797 Approved Petition). However, I'm assuming that that isn't the NOA that I am currently waiting for in the mail, which just states that they are accepting my application, but one they send that says my application is approved. At least the EAD will only take a couple months

In CA they have a DMV service where they keep your place in line. Once your turn they call you back.
Haha yeah thanks, I chose that option. Their just dimwits and don't know how to transfer me to their supervisor without hanging up. I'm waiting for them to call back again

It is possible to test and obtain an Ohio drivers license without the actual green card. Your husband would be required to provide a valid foreign passport, I-94, the USCIS document I-797c with case type I-485 (application for permanent resident status) and social security card if ever assigned a social security number.
I hope I have answered your questions. Please let me know if I can be of further assistance.
Would they take it away after his I-94 expires? I couldn't say. Would the person at the desk agree? I anticipate a struggle, as in all things.

Actually, my wife did get permanent DL in California this year almost immediately. If it helps, here is a timeline:
1) Arrived April 29th.
2) Got married May 4th and changed name
3) Got SS# on May 17th
4) Applied for AOS NOA1 May 25th
4) Written test - June 6th
5) Behind the wheel test - June 17th
6) Permanent DL in hand with 2016 expiration - June 30th.
7) Got green card - July 28th
However, she already had Russian DL in hand for many years.
Do you remember what she used to prove her status here, or did they even ask her? I've had my CA DL for 5 years

Book the tickets to match your passport and then carry your Marriage certificate in case you have to prove the name on your greencard when you come back in.

On the DMV website it lists that a Canadian passport is acceptable....as well as my NOA. So could I just print that off their website and show them?

Well I already have my SSN, they allowed me to get that a few weeks after getting married. I don't really want to give up my CA one though, so I will just wait.

yes there might be an agreement as each states have these kinda agreement with various countries.
But it seems OP is not going that route and is just going via a normal process to get DL.
If you go via the CA DL route she would only get a 6 month US DL, after that she will have to go back with her GC and get new DL with longer expiry time.
Would I have to give up my CAD drivers license? If that were an option, wouldn't they have told me that when I showed them my CAD license?
