Same sex marriage as a matter of civil rights. Unfortunately, it is often a lawsuit that changes things.
Brown v. Board of Education (1954): African Americans suing for the right to attend the same school as whites. One of the biggest cases in US history. Would you suggest to Justice Thurgood Marshall that he "wast[ed] state resources on this when it's obviously" not allowed for black children to attend the same schools as whites???
Loving v. Virginia (1967): Yes. In 1967, it was illegal for an African American to marry a white person. This case ruled that prohibition on interracial marriages violates the US Constitution. Would you suggest that it was a waste of state resources to overturn a discriminatory law like this which prohibit two people from marrying????
Are you suggesting that same sex couples should not sue for the right to marry and accept the laws as they are even if the laws discriminate against them??? Are you suggesting they not exercise a right and give in????
So suing for a civil right is often the only tool to achieve justice.

While I understand your sentiment, I do not think that it is inappropriate for one to leverage what is afforded to them to protect their rights.
It may be your opinion that they should not do this, but it would be the choice of the OP with regards to what she wants and if she is willing to do what has to be done to get it.
It was not so long ago that african americans did not have the right to marry (THAT was law too).
I say this only to iterate that just because something is the law does not mean it does not need to be changed. Not every law written is appropriate.
And if there is no equal protection under that law, then it is simply wrong..
Its not like we are suggesting she go find an ambulance chaser and sue for some cash so she can go buy a 50" plasma and a new RV..
We are talking about what should be a simple thing. Love.. Marriage.. Companionship..
I respectfully offer this as my perspective on the matter. Nothing more..

What is this supposed to mean? Deportation affects many people from different backgrounds, including young adults who were brought to the U.S. by their parents before even being able to talk.

So this article is about "new deportation guidelines the Obama administration detailed a week ago" and appeared this morning on the CNN website. It contains information about how the policies are being implemented, as well as first hand experiences on the issues.

A person can enter the US lawfully on a number of different non-immigrant visas, then marry a US citizen and move on to adjust status. All that as long as there was no "intent to immigrate" at the time of entry as a non-immigrant. Provided that no immigrant intent existed at the time of entry and the couple meets all other requirements for the foreign spouse to immigrate, that adjustment of status will work ou just fine. That precedent exists and has existed for quite some time.
The only issue for this particular couple is that while legally married in the US, their marriage is not recognized by the feds. This couple doesn't have equal rights. Yet. All else being equal, a foreign spouse in a hetero marriage would not be subject to deportation but would be able to adjust status. I take it that you then support this foreign spouse not being subject to deportation either?

Not only this is irrelevant to the topic, but also very weird. You do know that Obamacare appeared looong after the problems with healthcare developed and that very little of Obamacare is in force by now? May be you live on another planet
The issue with this guy is that he is gay and that is why he would be facing deportation. Was one of the couple a female or if the federal law was changed to recognize gay marriages, he'd be home safe. He did not enter illegally and he is married to a USC. The only thing standing between him and a GC is that fact that he's gay. So he should get to stay, otherwise this is a case of discrimination based on sexual orientation, which is already banned pretty much everywhere in the US.
Illegals should be deported, although I'd like to see a more humane system than ICE detention when it comes to non-criminals.

no human being is 'illegal'.
"illegal" is just the label these people have been given so the majority of americans know who to hate. just as long as america isn't pissed at the puppet masters.
when it comes to human beings that were brought over by their parents - without consent - full amnesty. nothing less. if you want countless human beings, who have done nothing wrong but live their lives, uprooted and dumped in a country where they have nothing - then i hope karma brings you everything in life you deserve.
and amnesty for these human beings does not have to ENCOURAGE more people to bring their families here without permission, it can be something that concerns the current population and we can move on from there with better border control.

There is a little thing called the principle of justice in America and a punishment that fits the crime. Dream Act Kids by and large did not come here of thier own volition they should not be punished by the act of thier parents.
You sound like a Big Government Republican, ready to pull out the checkbook and build more prisons, hire more TSA and ICE and on and on ad-nauseum. So we take some folks who cost us virtually nothing working in minimum wage jobs and put them in Jail and pay the prison guards $7.00 an hour to watch them. Brilliant , nothing is produced and that giant sucking sound is money draining from our wallets. And at a time of all time high unemployement and fiscal crisis you want to vacate millions of apartments leaving landlords holding the bag?
As for costing states and municipalities millions... if I set up a hot dog stand and put a sign up that says "free hot dogs" should it really piss me off that people show up and take me up on the offer?
Since you will never stop migration from South America and Mexico any more than you will stop it raining or snowing it makes sense to do things in the most practical way possible. If an alien has significant equities like a US Citizen Wife and US Citizen children how does it benefit the US to make the US Citizen suffer or move outside the country?
Not going after non-criminal aliens with US Citizen ties is Humane and sensible Immigration Policy.

The telling your kids excuse might be good for a week or a month but 2 years ? It looks like she married him to let him stay in the US and then they each went about their separate lives. I would suggest heading to immigrate2us.net as they specialize in problematic cases and your friend is looking like he won't be staying unless there is a bundle of evidence like family vacation pictures we don't know about. If they intend to keep visiting I would highly recommend against overstaying past the 180 days. Canadians are considered Duration of Stay but border control wont give a ######. If you don't have tons of proofs that you arn't going to do it, I doubt you will get back in.
However if they are in the process of immigrating, the Duration of Stay does not count against you and you are not automatically banned 10 years based on the current memos at Montreal.
This is just our experience with it. The Interviewer didn't care at all that my wife had been in US for over 2 years before returning to Canada.
However, when we reached the border, the first person at the car booth began to question us about it, even though we had the US visa in hand. She made a bit of a fuss regarding it, and she most definitely would have been denied crossing without a visa in hand.

Why would anyone agree with COs returning a petition on a gut feeling after meeting for 5 min.with the beneficiary ? After refusing to look at 15# of evidence, having asked for it ? This happens all the time with or without so called flags at certain posts. Clearly it was not said to the one who considers himself to be in a genuine relationship who sailed through an easy country with the bare minimum.
Such smooth flow of words would not come from your mouth if it was you who went through hell and back with singed hair still smoking from the heat....if it was you whose petition was returned due to a gut feeling but knowing your relationship was bona fide .The government couldn't possibly have it wrong right? Nothing could ever be broken if it works for you right?
It is so amusing to me to have someone respond and say....it was not hot...I never felt the heat in my igloo, therefore no heat exists. How can anyone not having gone through what some experience just poo poo it away by saying oh well, if the CO reacted on a gut feeling then it must have been fraud, the petitioner just doesn't see it yet. How absurd. Has it ever ocurred to them that genuine couples truly suffer because of gut reactive biased INCORRECT "feelings" ? By making statements like that you are adding insult to trauma in your pious walk on easy street. Yes, easy street, walk a mile in the shoes of those genuine couples who suffer from returned petitions without factual evidence of fraud and then lets talk.
One can talk from theory and the other from a place of experience, or one can simply have a sense for equality and stand for the right thing to do based on facts. Gut feelings are an epic fail....you don't want a blanket fix but have no problem with guts misaligned ? Alrighty then. SMH.

People like Danno seem to think that homosexuality is some sort of mental defect. As such, they have this phobia that every gay guy wants to have sex with them, as if they are not human and don't have their own set of standards and morals. That is what I find most demeaning about homophobia.
