    Thanks for the congrats anyone... I absolutely couldn't be happier. I hope all of you who are waiting for the same will get it soon. It's true what they say - the years of distance melt away when you're together.

  2. My fiance arrived early this morning on his K1 Visa. We've spent the past 14 hours getting reacquainted, not really believing that the five years of long distance is really over. Thank you so much for answering my questions, VJ. I'm sure I'll have a few more through AOS, ROC, citizenship, etc - but it all feels so trivial now that the paperwork isn't keeping us apart.

F2C-MaDMaXX, we're happy to answer your questions here, but pretty much everything you've asked has been answered in the Guides and in previously asked forum questions (search in upper right). If you look in these places before asking a question, 19 times out of 20 the answer will be there.

  4. My fiance's at the Dublin airport, taking off in less than an hour. Even though he's flying Continental, his gate didn't allow for immigration in Dublin. Instead, he'll be POE'ing in Newark. Strange. I'm glad I didn't fill out the POE line on all my AOS forms yet.

    Oh, I'm not nervous or excited at all.

I will be thinking of you, as I am jumping out of my seat right now at work as John calls and gives me an update every few hours for the past two days letting me know how much closer he is to "home". He is driving across the upper United States and should be in Michigan and HOME in about 5 hours or so! :dance: :dance: :dance: Very exciting to have our loved ones FINALLY with us, at HOME!

  6. I think a lot of people in the UK forum can tell that my fiance is on here too. :lol: Sometimes I wish I never told him about it -- it had been my little secret and now he's on here all the time. :unsure:

    I volunteered to be the one to master the immigration process, including research, which is basically VJ. And I'm happy to do it. Moving countries is stressful, and I'm happy that I can make it easier by knowing what we should do. Definitely the fiance's accused me (rightly) of being too scared by people's "horror" stories. You see the worst of what happens on VJ and, of course, worry that it'll happen to you. He's right on that point, but at least we've been overly-cautious rather than too careless.

    Let me try and clear up some misconceptions (by the way, this is all in the guides).

    If you are half through your 180 days and you are married, you are fine. You don't need to get a greencard within those 180 days, you just need to *apply* for one by sending in your AOS packet. As was mentioned above, you don't need to start over - I bet the letter you got rejecting your fee waiver is just telling you to send in the check, not the whole packet again. Read the letter carefully to see, but probably your AOS packet is just waiting for your check.

    So again, you don't need to get a green card faster than 180 days.

    DO NOT LEAVE THE US before you get your green card or AP.

    Send it back with the 1010 dollars.

    I'm pretty sure it's impossible to get the fee waived.

    If you have to, take out a small loan to get it paid.

    In that case, Lowe, just do your AOS package as soon as possible and send it in with the check. While this should've been done within the 90 days after you landed, you did marry your fiance within that time so hopefully they won't give you a hard time.

  9. Do not travel home. If you leave the country without your Advance Parole, your application will be considered abandoned and you'd have to start over.

    That said, we need a little more information to answer your question.

    1. What reason was given for your AOS package to be sent back? Did you get a request for evidence, for instance?

    2. Did you include your check for $1010 in your AOS package?

    3. Do you know why you are out of status? Out of status means that you've stayed in the US past a current visa. Did you enter the US and get married within 90 days and file your AOS within that time?

    Aw man, I have one. My fiance gets these muscle spasms when he sleeps, left over from a childhood illness. This wouldn't be such a big deal, but he's a big guy - 5'4'', and fairly muscular. That means that when he spasms, he sometimes literally punches and hits me when we sleep together. He feels bad about it, but what do you do? :) He says I steal sheets though, so maybe we're even.

    Also he spells words with extra u's. What's with that? :whistle:

  11. You know - your not suppose to use the K-1 to "check out" the relationship first, your intentions to marry are made prior to the visa being granted.

    What happens if her dad doesn't agree with the fiance? It would be probably cheaper to just fly there first and "check" out the guy...

    just saying...

    But then he'd have to take a trip to Jamaica! A fate worse than death! :whistle:

  12. I would greatly appreciate some help understanding Advanced Parole...I'm a little dense on this subject ;)

    I have read the forms and some posts that look like advanced parole is only for emergencys but others look like you can use it for vacation? My cousin is looking into doing the K-1 visa so her dad can meet her fiance first, but they want the ceremony to be abroad. If they marry legally in the US, will they be able to file for AP so that they don't have to wait two years to do a non-legal ceremony with her fiances family?

    Also, is AP only for a one time entry, or can you use it multiple times till it expires?

    Advance Parole isn't just for emergencies, it's for any kind of travel - even pleasure.

    If your cousin is getting a K-1 Fiance visa, the legal marriage ceremony *must* be in the US. You can always do a ceremony or wedding party after as well, but you must receive your marriage certificate in the US.

    Once your cousin is married, he/she can file for Advance Parole. It's recommended to do that with the Adjustment of Status package so it isn't an extra fee. He/she will get the AP in about 60-90 days from filing. But once your cousin receives his/her green card, he/she won't need the AP to travel - the passport and green card will be sufficient.

  13. The JFK entry stamp is NOT good for employment. You need to file for an EAD and wait until you get it. IT will cost you $340 and will take about 60 days and will expire with the I-94. If he works before he has the EAD that you pay for he is working illegally. Do you think the only one airport in the US has the authority to grant employment authorization. They are using a stamp they should not be using anymore. Unless he passes the E verify he is not authorized. The rules about the stamp like JFK gives out about a year ago and clearly defined that it is NOT good for seeking employment. If your fiance/husband uses it to gain employment both he and the employer can face criminal charges and fines. Not the way you want to start out married life I am sure.

    Please note that EAD and Advance Parole are free if filed with Adjustment of Status ($1010)

  14. When you obtain the social security card it will be stamped across the face something like "Not valid for work without DHS authorization". What will you show in addition to the social security card to prove you are authorized to work?

    Damn, it's really inexcusable that the language on the SSA website I linked is basically incorrect. The government doesn't even understand its own policies, yet expects us to? :bonk:

  15. SSA is not the one that issues EADs - it's USCIS that says who is employment authorized. Per I-9 (also found on uscis.gov) if you don't have EAD (with fee) you're not employment authorized. There is a whole thread pinned about this very topic so you may want to read it as well. There was a I-9 rule change last year that clarified that K-1s are not employment authorized.

    Also, I see no pinned thread on EAD. The three pinned threads in the main AOS forum do not have it. Got a link?
