  1. We sent them in the RFE the following:

    - Actual signed joint sponsor i-864 (not photocopied)

    - Explaination of why we had no w2's for 2011

    - Payslip for my wifes(USC)job here in NZ

    - Photocopy of 2011 tax return complete with signatures and dates

    - Proof of US domicile (Lease on house)

    Surely this information does not take a month to verify and send us another checklist?

  2. We are still waiting on our i-864 RFE to have it's final review; its been over a month since they have had it and last week we called them to have it fast tracked.

    We called them up today thinking that it would be 'case complete' since we have not received any new checklists but low and behold its still being reviewed.

    Not sure what is taking them so long to review it; should we be worried? I just hope if they need any more evidence they hurry up and give us our check list so we can get it sorted ASAP.

    Should we call them everyday? doesn't that annoy the NVC people?

    Like most of you lot; our lives are on hold until this immigration stuff has gone through; it is stressful and we are so over it.

  3. We called NVC on wed last week at around 10pm and the guy we spoke to said our last packet is under final review and give them a couple days more.

    This morning we checked DHL tracking to see if anything had been sent to the Auckland consulate between when we spoke to NVC and the end of the week; there was one package sent from the NVC to auckland on Wednesday at 2:37pm which was before we spoke to them on that same day; Auckland recieved the package yesterday.

    Is it possible that the NVC system had updated with case complete by the time we called them or do you think it is somebody elses information?.

  4. Okay just got another check list in the email.

    This is a copy and paste from the email we got exactly one week ago.

    ______1 - IMMIGRANT VISA APPLICATION PART 1:_______________________

    The NVC has received the requested Affidavit of Support (Form I-864) or supporting documents.

    However, we are still waiting for the response to the checklist letter for the Immigrant Visa Application

    or civil documentation. Please return the requested information so that we may complete the processing

    of your case.

    This is the email we got today.

    ______F - FINANCIAL EVIDENCE:______________________________________

    The NVC has received the requested Immigrant Visa Application (DS-230). However, we are still

    waiting for the response to the checklist letter for the Affidavit of Support (Form I-864). Please return

    the requested information so that we may complete the processing of your case.

    When responding to the National Visa Center, please include the bar code sheet that came with this

    letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

    code sheet should be placed on top of all documents being submitted for this case and mailed to the

    address provided.

    So last week they had our i-864 but not the DS-230 and this week they have our DS-230 but NOT the i-864

  5. A week ago we received a checklist stating they had received our i-864 but not the Ds230 part 1 so today I called them up and they have actually received the Ds230 but NOT the i-864 which we sent them as a RFE (we had to send both DS230 & i-864 for RFE)

    The lady on the phone said they were reviewing our i-864 and that they would be sending us another friggen checklist which was the exact checklist they sent last time; apparently they are reviewing the orginal packet we sent and not the RFE packet we sent 3 weeks ago.

    The lady on the phone said give it another 5 days and we should know more.... wth?

    We went through this process in 2005 and flew through it because DFC was an option; they really messed things up by getting rid of DCF for a lot of countries; this is just confusing as heck.

  6. This past saturday we received a RFE for the DS230, part one but that the everything was in order for the i-864; we sent them in at the same time but in separate envelopes after recieving a RFE a couple months back for more information on the i-864 and certified copies for the DS-230.

    From what I understand the RFE for the DS-230 is an automatically generated email when they process the i-864 and have not processed the DS-230. We havent heard anything since Saturday so should we be expecting notification that everything is in order and our case has been sent to the consulate in New Zealand?

  7. Alright so quick question. I am following the EZ Spouse Guide, which is SO useful and wonderful. Thank you to everyone who put it together.

    But a quick confirmation. We just put in the I-130 and know that while playing the waiting game we should put together our AoS and IV packets. But the only question is we don't obtain the NZ Police Clearance Certificate, right? Should we just fill out the authorization form and put that with the IV packet?

    Yes you are correct; you need to send the authorization form to the consulate in auckland NOT with the IV packet which goes to the NVC.

    I would send the police authorization form at the same time you send your i-864 and ds230's to the NVC.

    All sponsors must submit the following documentation with their I-864:

    * Proof of current employment or self employment

    * A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

    How is a photocopy of my tax return any different than the turbo tax printout (which is what I gave them) I am unsure of what they mean by 'photocopy'

  9. How is your wife sponsoring? Ie is there a co-sponsor, or are you sponsoring on assets?

    Her job in NZ doesn't count as it will not continue in the USA.

    Sorry yes I should clarify that; we have a joint sponsor (wifes mom)

    On a side note anybody reading this and filling out i-864's with a joint sponsor please make sure to have to original i-864 and i-864a filled out not photocopied or scanned.

    We printed out the i-864 my wifes mom gave us and it was not accepted even though it was in color; the i-864 needs to original with blue or black ink.

    My wife (USC) and I sent off the i-864 a couple of weeks ago and sent my DS230 with civil documentation.

    Received today an email from the NVC the following:

    A review of the I-864, I-864EZ, I-864W or I-864A (if applicable) Affidavit of Support form and

    supporting documents that you submitted has revealed that you have provided incomplete information in

    your response or you have not responded to some questions.

    Please pay specific attention to the questions marked in the attached I-864/A checklist. You will need to

    complete and submit a new form with the changes noted on the attached checklist.

    You will need to follow the instructions for the Affidavit of Support (I-864) that are posted on the

    Department of State website at the following address:

    www.ImmigrantVisas.state.gov. From there, you can fill out a new form online, print the new

    completed form and mail it to NVC. If you are the Petitioner, please read all instructions and complete

    the correct form to submit to NVC. An Affidavit of Support form is required to be submitted from the

    Petitioner on each case regardless of his/her income level.

    NVC will hold this case until you send us these needed items. When you return the documents to NVC,

    please make sure that the documents submitted are in the correct order and stapled together, as stated in

    Part 6 Sponsor's Income and Employment

    [x] NAMEWITHHELD s income indicated on the I-864 Part 25 does not correspond

    to that shown on the most recent tax return and W-2(s).

    We called them today and they stated that they have 2009, 2010's tax information and that they have 2011's.

    When we sent them the tax information for the last 3 years we just sent them the print out with all the schedules that we sent the IRS from turbotax.

    All three years have been done in turbo tax but only 2011's was turned down.... was this because the most recent year is the most important?

    Besides sending a tax transcript for 2011 what else might be acceptable?

    They want a recent paystub from my wife's job here in New Zealand for proof of employment and a written reason of why no w2s were submitted.

    My wife has worked in NZ since 1st jan 2009 and so has no w2s for the last 3 years and has been filling out the foreign earned income form for her taxes in turbo tax which does all the correct schedules and fills out the 1040 correctly.

    To prove domicile we will be getting an official lease agreement with my wife's mother who we will be living with.

    Now the other thing they sent us was an email stating they have not got my ds230 but when I called them they said it was just an automatic email and that my DS230 has not been processed yet; has anybody else had this?

    Hopefully somebody can help us; we are so close but yet so far :-(

    Filling out the affidavit of support forms this weekend but ran into a problem.

    I was wondering if we need to fill out the last 3 years of tax returns as joint OR if my wife (the USC) just does them as married filing seperatly?

    I had a greencard but 'abandoned it' at the end of 2008 so do I even need to file for foreign earned income if I am no longer a US resident?

  12. the I864 only requires the last 3 years, so if you can show 2010, 11 and 12 you should be fine.

    Since 2012 isn't over yet it would be 2011, 2010 and 2009 buts that's besides the point.

    I suppose that I could get away with missing those 2 years until we get back to America; it's not like the IRS is going to audit me straight away if I miss 2 years; I know I owe them money; I am fine with paying but I want to wait till I am back in the US to do so.

    USCIS does not have access to the IRS records (as far as I know) so they wont know that we are missing 2 years.
