Just a comment here, while I also know stopping for a school bus is mandatory (just like stopping for a tram or regular bus in Aus) I've never been in a location where I can't continue if the bus is on the opposite side of the road, or where I can't go AROUND the bus by hopping into the next lane. For instance, the trams occasionally travel on 2 lane roads. We drive on the left so the tram would be in the middle of the road or in the right lane. You are NOT allowed to go into the left lane and drive past a stopped tram with it's little "stop" out (almost did once 'cause I didn't see it.. eep!). School buses open with their doors to the street and kids are expected to obey the laws of the road (stay on the side of the road until the bus is gone so you can look for traffic. Do NOT walk in front of the bus. Cross at the pedestrian crossings) but you still drive at 20kms in a school zone.
My natural instinct is to keep going but cross into the farthest lane and that's what I thought you did until Tony told me more about it. Even the driver learning book didn't explain that if it's in the opposite lane you need to stop as well. That makes no sense to me as 1. people should be teaching their kids not to run out into the road and 2. There should be a safety monitor there who gets out first like a lollipop lady with her "stop" stick to make sure people stop while the kids cross.
So I completely understand how she could have got this fine.
People can teach their kids but kids are kids. It's onto responsible adults to make sure they are safe and STOP when school bus lights are flashing. That's the law.

You have only one choice................
1. File for AOS together with EAD/AP, ASAP no matter how you get the money borrow, sell cakes, sell furniture, pawn jewellery, wash cars, or whatever arrange that 1070 + the cost of postage and the cost involved in photocopy etc, file it the first thing. Do not worry about I-864, You can still file using last 3 years tax which show that your husband was 125% above poverty line. But without filing for AOS you will get nowhere and will not be able to help your husband financially at all.
2. Start understanding the whole AOS/ROC and naturalization process and carefully plan for it moving forward and start collecting all that money so you don't have to be in this kind of situation again.
Good luck. Wish I could buy couple of your cakes to help you.

Hello Guys,
Hope all of the applications are going on smoothly. Just for your information, I mailed my I-751 on Monday, August 15 by first class mail and it won't give me delivery confirmation, so I am not able to find if VSC has received it or not. Secondly, I sent in my cashier's check, and I am also not able to find if it has been cashed out.
Any feedbacks are welcome...
Till then good luck!
Package reached them or not you can't find out. But there is a way to find out if the cashier's check was cashed. You would have to contact the bank from where you made the check and they generally have a number you call and enter your check ID or receipt ID and you know if it has been cashed.
If not then just wait for NOA

You can curse, and disgust, if some of the documents are lost, you can fight it, call them, make appointments but it would be easier to go forward and submit your evidence in time. So moving forward
Assuming, you would have made a copy of the whole package I-864 is not a problem, just print and get it signed again and send with the tax returns or W2.
I-94 is also not a problem just make one more copy and send it.
The bummer is I-693, but you can always go to the doctor who did it initially and may be request him/her to do it for you again as he may have a record and you can tell him that it's for the same person and he may do it without any cost.
Don't worry about what has happened, send the stuff they need in RFE ASAP and your case would move forward.
Good luck.

Had the AoS interviews today and was informed of approval at the end of the interviews.
We were interviewed seperately, I went first. Questions were about things around the house, color and position of washer and dryer etc, health conditions, what we did last weekend, etc. Asked if she'd recognize the house key, I said probably not because we use the keypad on the garage door mostly. Funny that she uses that keycode about five times a day when working outside, but she couldn't remember it for the interview. Didn't matter though, since he approved her green card. Said it should arrive in a few weeks.
congrats!!!

Finally sent mine in, adding myself no. 13 CSC.

Do you have Health Insurance covering each other. Would be a good evidence if you have and have just overlooked.
I am getting ready to file mine too.
Good luck.
-
Need to understand your situation better, who is the petitioner who is beneficiary and what are you trying to do in any case here are the two common scenarios based upon your husband is petitioner and you are the beneficiary.
1. If your husband is sponsoring you and his income is enough then just include the tax transcripts of last two or three years, throw in the W2s as well just in case.
2. If your husband is sponsoring you and his income is not enough then you have a co sponsor and you have to furnish tax transcripts for the co-sponsor and husband both.
-
Get them to file for 130, 485 together and all the stuff that goes with it. Overstay would be a question if they suspect that the reason for marriage is to gain GC, hence if your friends were in love much before the overstay dates, make sure they include those evidence. Good luck
-
thanks for the response. Are tax form and w2 copies different than tax transcripts? I dont have tax transcripts and if i order them it will delay sending response to rfe.
This is the fastest way to get Tax transcripts. Go to your nearest IRS office (you will have to make the trip). Take your ID and all you would need is Tax years you need transcripts for and your SSN. Depending upon the wait you should be done maximum in one working day.
Good luck

Read the I-864 instructions section
What If I Cannot Meetthe Income Requirements?
Income from the intending immigrant, if that income willcontinue from the same source after immigration, and if theintending immigrant is currently living in your residence. Ifthe intending immigrant is your spouse, his or her incomecan be counted regardless of current residence, but it mustcontinue from the same source after he or she becomes alawful permanent resident.
So yes you can but this is the form that your spouse is going to fill and your spouse has to show their income and you can also pitch in for the requirement, you may have to provide a letter from your employer though that your income would continue.
Good luck.
-
As milimelo suggests, do it as soon as possible.
You should have done this within 10 days of when you move .
That's a condition and responsibility for you as a GC holder.
In any case since you didn't USCIS may forgvie you but to avoid further complications and to receive the 10 year GC at your new address and all other correspondence please file AR-11 online as soon as possible and don't forget to mail the I-865.
-
I had filed AR-11 when we moved to our new home. Still we got a letter on our old address forwarded by USPS to the new home saying "Don't forget to Remove Conditions" and so on. I won't worry too much about this. I am sending my packet in about a week and I am going to list all the addresses in a sheet I have lived in past two years and also would send the copy of the AR-11 successful filing.
Also I am sure 751 only asks your current address. Although you can include list of addresses lived in past two years kind of thing. This way you can show some evidence from the old address as well.
Good luck
-
A moderator should move this to AOS this is in the wrong forum.
-
We will be joining here soon. Have 70% of the paperwork done but still need to create packet. Although can't file before 8/8.
Here we go again......Good luck to everybody here.
-
nope, didn't do that... it only said to put the blue letter on top of everything in the package... *worry even more*
That's what I meant by Response to RFE (Placing the blue letter on top of the package). If you have done that then you should be fine. Also in case of RFE my experience is that if they are satisfied by your response your wait is over, you go into the next stage.
Good luck.
-
Drop the marriage license and certificate. They already have your marriage certificate from the AOS.
I was told to go easy on pictures and that's what I am doing.
Your list is solid. Good Luck.
-
If you have the receipt where it says it was received, you are good. Just wait till they review your package. I am sure you did mention "In Response to RFE" on the package according to USCIS guidelines.
Good luck.

I-485
Birth certificate. I was born in Shanghai in the 1970's. I don't have a birth certificate. According to my mom, it was handed over to the local police department to get a Residency certificate (HuCou) when I was a baby. What should I do? I read in a forum where the consensus there was that I should get an official letter from the local govt saying that the birth certificate is not available. My parents should do an affidavit certifying the place and date of my birthday?
You are correct. You would need a certificate from your local government that Birth Certificate is not available. Also if this certificate is in a foreign language then you would need to get it translated and include the translation, copy of the non-availability certificate and the certificate from the translator. Apart from all this you would also need 2 affidavits from your parents, grandparents, close relatives that you were born on that day and they were the witness.
Where should get this letter from China? Is it easy to do from the US? I still have some relatives in Shanghai who may be able to help. Is an affidavit necessary from my parents? If no birth certificate you would have to get all this. Or you would get an RFE and then you would have to do all this in 30-60 days.
On the I-485 form, it asks for my non-immigrant visa #, consulate where the visa was issued. I am a Canadian citizen and my H1b comes in the form a I-797A for my H1b visa. There isn't a traditional visa struck to my passport. The I-797a has a receipt # but no visa #. It was not issued at any consulate. It was issued by USCIS when I was in the US. Should leave this blank? Or say "refer to my I-797A"?On you cover letter you can include explanation for item no. X and in the explanation you can explain as it is. May be someone else can help you better on this for what should you put as visa number.
I-693What are the vaccine shots that are absolutely required? I am planning to get most if not all the tests done with my own primary care doc before seeing a civil surgeon. I had a BCG shot when I was a kid so I test positive for TB skin test. I guess I will get a chest X-ray. There are a number of shots listed on the form. Do I really need to get all of them? I have positive titers for mumps, rubella, varicella and Hep B and can produce documentation. I know I had hep A shot over 10 yrs ago but it will be hard to produce documentation.
Just call couple of civil surgeons in your area and ask about procedure and cost. Based upon your affordability, time and vaccine taking ability you can decide if you want to take all of them or if you want to prove that you have all of them by getting a blood titer. You would for sure have to go through a TB skin test and if it comes positive you would have to prove that you are inactive by a clean chest X-ray.
Good luck.
