If you are nervous you would tend to make mistake, I would suggest getting a driving instructor give you a mock test if you really really nervous. Rest is all on your being calm and following the rules and the examiner.
Be calm u can do it.

Choose whatever is easier for you, i.e. affordable, good timing etc. As long as you have a valid Visa P.O.E. would not ask you why you traveled through a particular country. P.O.E. may ask you lot of other immigration related questions but as long as your originating country was India and final destination US, no problems.
-
It depends on what kind of visa she has, multi-entry and till when it's valid.
Also depends if you have AP approved for her.
But yes if possible stay till GC arrives.
-
You need a US Green Card, follow the basic USCIS guide on what you need to do if you want immigration through USC spouse. Then follow VJ guides which are really awesome. Except these two sites anywhere else you are wasting time, energy and getting misinformed.
For case by case basis you may need some help from fellow VJrs and that's when you share your experience and gain knowledge from others.
Before leaving Welcome to your Visa Journey!!!

Don't panic. It's absolutely alright. It's good that your MOM has a birth certificate and you can submit that to USCIS, also since your Dad is having an NABC and affidavits. It would be just fine. USCIS knows that in India most of the people born before 1970 do not have their birth certificates.
Make sure for your Dad you submit his high school record, passport pages showing date of birth along with the NABC and affidavits. For your Mom, just send a copy of the Birth Certificate
There is no need to worry.
Best wishes

I came here on F-1, finished my studies got a job on H1-B and then met my wife and now filing for AOS. The intent question (F1 - AOS)would always be there but I am sure in AOS by marriage the intent is being in love and living life together.
-
In USCIS case early is better always, but if it's only about a week or two at the most file everything together. I am not sure how other people feel about this but I would file everything together.
But again the decision is yours and there is no harm in filing separate.

Finally sent the RFE, hope no more RFEs. It reached there 09/21/2009 but no update on the status yet. How long should i be waiting for touch/status update. The case is still in RFE stage.

hi,
are translated documents needed to be notorized?
i need to submit translated birth certificate (family registry for my wife, she has no birth certificate) as a part of application. and i am wondering if the translated one has to be notorized., and if it is can it be notorized by any public notary or does it have to be done by consulate?
also for i-485, she needs to get medical examination done, but it seems like she wont have it until mid oct.,
i was wondering if she can get the medical examination after we send in our application,
her i-94 expires 10/12, and we are trying to send in by first week of october.
thank you
Translated documents do not need to be notarized, however with translated document you require a certificate from the translator that the translator is competent and that the translation is correct to the best of her knowledge.
You do need a medical examination for I-485.
-
Thank you all for your advice and the quick reply of course.
-
the USCIS does NOT require "original" or "certified" copies unless specifically requested and regular photocopies are OK.
Thanks for your quick reply. By certificate/certified I meant that when you get a translation done, the translator needs to provide a certificate saying that the translation is correct etc. Do I need to send the original certificate from the translator or the copy would do. Looks like a copy would do, but just want to be sure, do not want another RFE.
-
So now i have the NABC translated and they come with a certificate from the translator as well.
My question is what do I send USCIS?
Copy of the original NABC, copy of translated NABC, copy of the certificate from the translator.
or do I need to send any originals (translated doc / certificate from translator).

If you do not have any friends/family who can loan you about $200.
you can go to any Pay Day Advance stores and borrow like $100 from them till your payday. Make sure you send this on time. Also you might need more money to FedEx or Priority it so instead of $100 get $200 and send it on time. Do it first thing Monday. Once you get paid on Friday you can pay the Pay Day Advance people with a little interest money.
I am not sure if you can do this but may be you can possibly buy a money order on your debit-card, bank balance would go negative and bank might charge you a fee, but your status in US would be intact. And on Friday you would cover it up anyways.
As fellow VJers have already mentioned you can also send the application without the application fee, and then they would ask you for the FEE by an RFE, you can send it then (not much of a problem) just a bit delay in your 10 year card processing, but you have already delayed it anyways.
Send it on TIME...
Hopefully you get this behind you...

we got marry last week when i file 485 and g325A do I put her name as her married name or her name as shown on her visa?
you can put her married name. If you look at all the forms they say other names used or maiden name and there you put her name as shown on her visa.
OR
you could just use her maiden name, but then if she is the beneficiary her GC would be in her maiden name.
your choice...

Congratulations to Bigbubble and Richa! I ve got mine 2 NOA for I-485 and I-765 too. So happy for all of us! same day!
By the way, i read somewhere is that USCIS will give us a tracking number so that we can track at their website about our status when they "touched" or when we can get EAD..or may be i am wrong because I did not see any case number/tracking number at the NOA today at all...
Have a nice evening,
Huong
First Congratulations on your NOAs...
Now You must have a receipt no . That receipt no is your case no. You can create an account on uscis web-site https://egov.uscis.gov/cris/jsps/index.jsp and add all your cases on your portfolio. Then you can keep checking them Obsessively like me (everyday) or at your own sweet time . You can also have them email you when they do something with your case.

Hi Rahul,
Thank you. I have received mail from CRIS saying " Request for initial evidence sent, case placed on hold".
But I have no idea what is this for besides the NABC. What do you think and how did you get your email when you received RFE?
Thank you.
Yeah I got the same e-mail and was wondering what is the RFE about and then when I finally received the yellow paged RFE I came to know its about the Birth Certificate. They also send you the Indian 1969 law page about Registering Birth and Death. You would have to wait till you get the letter to see what it is about? But I would still say start getting NABC.
hi rahul,
i guess it is nothing to do with me but can you tell me what is this Indian 1969 law says? i am curious becuase of my parents and ofcourse they are 1952 born so. if you can?
thak you rahul
Indian Birth and Death Act of 1969 law says that everybody born after April 1, 1970 should be registered. So if you are born after 1970 you should have a Birth Certificate, if not you must get a NABC. Since your parents are 1952 born you need only affidavits and school record for proof of Birth. I would assume your RFE is not about Birth Certificate of your parents. I am attaching Indian1969 for your reference.

You can read the guides for I-130 and I-485 here for more info but in short,
Answers
- For family name, should I use my married name or my maiden name?
You can use either (if you have started using married name use married), then look in section B question 7 other names used you have to put your maiden name there.
-#8 on the form asks for place of marriage; does this mean the name of the church we married in or the city & state...or both (although I tried putting both and it didn't fit!)
Place of Marriage is City, State, Country... only.
Also if there is something (other than place of marriage) that doesn't fit on the form you can attach an extra sheet (read the instructions of Form I-130).
-Where do I find my husband's alien registration number? I'm not too sure what this is
write "none", he doesn't have any yet. Once he files I-485 he would get one.
- Under #14 on his side of the information it asks for "date authorized stay will expire as shown on form I-94." There is no date such as this anywhere on his I-94 because his I-94 is a small piece of paper stapled into his passport that only has his arrival record number and arrival date on it. He does have another form (DS-2019) that says the form covers period 10-1-2008 to 3-31-2010. Is this 3-31-2010 the date I should put or would it be April 30, 2010 (which would include his 30 day grace period)?
if I-94 or I-95 does not have a date you can use DS-2019 date put 3-31-2010 (grace period is after stay expires). Or you can just put N/A there.
You should get more information about this.
-For #17, do I need to list myself as his wife where it says "list husband/wife and all children of your relative." I would think this is self explanatory that I am his wife since I am the one petitioning but I thought I'd check.
Still list yourself as his wife. This form is used for all relative based immigration so...
-For #19 where it asks for relative's address abroad should I list the address where he lived before he arrived on his J1 visa, as in, his permanent home address in Canada?
Yeah that would be fine.
-Lastly, for #22, how do I find out what city & state my husband will be applying for adjustment of status? We live in Pennsylvania if that makes a difference
Since he is already in US, he would be applying for AOS here, find the nearest USCIS Local Office and put that City and State, you can find this information on the USCIS web site. https://egov.uscis.gov/crisgwi/go?action=of....office_type=LO
Hope all this helps, good luck...
Also make sure you file for I-485, and I-765 at least with I-130. Read the FAQs and Guides they would clear all your doubts.
-
I am not sure but i think you can send that as it is. because may be they can understand too about difference of address.i don't think they can make a query for address. it is concern to your birth.
Thanks Richa, I guess instead of explaining I would leave it as it is. Waiting for the translators to respond now...
-
I have gotten an NABC from my birth town Municipal Office which of course is in the regional language, so now I am working on getting it translated, once that is done I would send my RFE response.
Now I have an NABC with a little twitch in it too, my mother and father no longer stay at the same address they used to when I was born. The registrar would not search the document with the new address, and gave the certificate with the old address in it.
My question is should I explain this difference in address to USCIS, (address on affidavits from mother father is their present address (i have already sent those affidavits to USCIS so no changing there), address on NABC is the address where I was born), or should I just send it without any explanation and may be wait for another RFE or leave it to luck.
Please respond....

Biometrics done. No fuss, smooth 10 minutes process.
Hi Rahul
I am also from India. I have a qn regarding the Birth certificate. What did you do to get the Birth certificate from India. Since it's not quiet obvious in our country. I have sent 2 affidavits and school certificates but I haven't received RFE yet I hope I won't get. However I am working to get NABC from India.
Thank you
Hi Bluehills73
i applied for my parents AOS. I am also from India and they also doens't have birth certificate only we provide is school cerificate. how you get affidavits and can you tell me what you do to get for BC. i think i am asking the same question you asked to rahul.
thank you
Sorry Ppl for the two consecutive posts. Wanted to vent my misery first.
For Richa,
If your parents are born before 1969 (most probably), then you do not need an NABC, but you would need two affidavits from close relatives (preferrably elder than your father and mother) to state that they were born in X city on Y date. And a school certificate would do for before 1969 born.
For Bluehills73, hoping that you don't get an RFE about Birth Certificate, but I would start NABC process just in case. They sent an RFE in about 18 - 20 days after I submitted, so cross your fingers.

I had send two affidavits from mother and father and high school record. Unfortunately for me, I got an RFE for Birth Certificate they need Birth Certificate or an NABC.
