  1. I've got great news! Pman had his second interview on yesterday and was APPROVED! He will pick up his visa on next Tuesday and come home soon thereafter. I was so on edge that I couldn't even post. Now I'm relieved. I am praying for a speedy and favorable end to every deserving couple's AP. Thanks for your prayers Bridget. I believe every prayer helps. Stay positive everyone!

Thanks for the helpful thread Whatsnext. Please update my status in the tracker.

  2. Effieb, my dear sister-- I am so happy for you!!! Enjoy your fiance. There is so much strength that comes with being together. I wish you well and hope you will stay in touch. You have been a true inspiration to me.

All the best on your life journey! (F)

  3. Winmail.dat files don't usually contain useful information. They occur sometimes because of a glitch.

Here's a website that provides an online viewer for winmail.dat email attachments. Don't expect much in the way of useful information though. It's usually garbled computer code:

  4. How can i tell how long the ones from palestine were in AP for?

Hey, sorry about that. I didn't post the right link.

    http://spreadsheets.google.com/ccc?key=pGVYlFN7qlh6WLbhGks4pIA&hl=en

It looks like one was there from 1/11/2009 - 9/1/2009.

The other one just lists 5/14/2009 and may have received results but just not updated the tracker.

Meredith_Brahim did an analysis of the data in AP:

Consider adding yourself to the AP Tracker and reading through the thread. There's good information there including this link to a description of Security Name Checks: http://www.usaimmigrationattorney.com/SecurityNameChecksAndAdministrativeReview.html

There are also some really nice/helpful peoople there too

  5. Reform is a long and arduous battle-- one that is definitely needed. The immigration offices have apparently gone feral. I guess a start would be to support those individuals and organizations already taking on the challenge. Here's an interesting article by David Bennion highlighting USCIS abuses and the consequences of too little oversight:

You can really see why due process guarantees matter after witnessing firsthand the myriad ways USCIS officers get it wrong when they act as the sole prosecutor, judge, and jury and proceed under the presumption that the person in front of them is lying.

  6. Hi Debby,

Have you contacted your senators and congressperson?

Have you contacted one or more lawyers?

I'm sure you know that Lagos operates as a 'high fraud' consulate. They're not very objective. Their default answer is denial and they look for reasons to deny. Having been subjected to three interviews, AP, and a Stokes interview with an investigator just further stacked the odds in their favor. Like the 4-legged officers on sniff duty at international airports, I suspect they get rewarded for sniffing out flaws. I have heard of K-1 denials at Lagos turning into approvals, but not without a fight. Are you fighting?

The 'deciding question' was flawed. You could not apply for a marriage visa because you are not married. You are engaged so you filed for the K-1. It was a set up. The Stokes interview may have seemed harmless and/or friendly, but they were trying to get this case out of their system. I'd be interested in what the Freedom of Information Act would reveal on this case. Do you know which CO worked your case? Have you spoken to the IV Chief or anyone else in authority at the consulate?

Seriously weigh your options and please keep your thread updated.

  7. I also had to deal with rude border patrol personnel.

I was turned away at the border because of insufficient ties to Canada and of course I got upset. The customs agent looked at me and said and I quote "Oh boo F'ING whoo" I was so shocked at this I could not believe it.

So I have her name and badge number and I will be reporting her

Really? Where do they find these clods to staff these positions? Everyone has 'bad days on the job' but I would never think to say something so unprofessional and insensitive. I'm glad you're following through on this one. She gives her ilk a bad name.

  8. Hi Debby,

You had a 'Stokes Interview' at your own request... Wow!

You are right to feel robbed and cheated. This is like a nightmare! Your story really touched me. They've wasted a great deal of your time and then dashed your dreams on the rocks for some bogus interpretation of the purpose of K-1 visas. It took them over 8 months and 3 interviews to come up with that? Really? :wow:

At this point it looks like you would benefit from the involvement of your state representatives: your congressperson and senators. You would also benefit from a consultation with an experienced immigration attorney. The faster you get to work on this the better. This is not a good time to sulk or go at it alone. The Lagos consulate can be outrageous! As a citizen, you have two senators and a congressperson. I think you should involve them all as each may have a different approach or level of service. I also think you should post your story on a more widely read forum like US Embassy and Consulate Discussion. Solicit references for attorneys there.

Get cracking. I look forward to your progress reports and posts seeking help. Good luck!

  9. Hi folks,

I have been trying to get this answered for some time. But, due to my error I had put "what in internal processing"? (lol). So, I have correctly posted my question and hoping that someone can answer this for me. The latest is that the consulate emailed and informed us that they are waiting for the internal processing to clear before they contact him.

It is my understanding that AP takes two forms:

    1. name checks (done at different agencies in Washington) and
    2. case review/research done at the embassy level.

Usually the embassies don't tip their hands and let you know which pit your case has fallen into. In your case, it seems like they're wrapping things up at the local level. Although it seems to have been a long battle, it seems like things are going in your favor.

  10. We got a responce to the senators inquiry and it doesnt sound good.im scared as hell.i will try to post it here.ok it wouldnt post but here is what it says. Thanks for your inquiry. Our office is still working out some issues regarding mr. xxxxxx eligibility for a visa to the united states. We recently got a message from Washington and are preparing a responce addressing their concerns.Once we get a more definitive answer we will relay it to you. Regards,Martin Tatuch,Consul U.S. Embassey Stockholm This doesnt sound good.Im so worryed. What do ya'll think?

It does look a little ominous, but it doesn't look like 'bad news' to me Bridget. Instead, it looks like 'no news'. I'm still at the stage where I get 'no news' responses regarding my case. I think they have some protocol where they have to answer within a certain timeframe even if there are no changes. They are keeping you in the loop while meeting that protocol. The Lagos consulate only responded directly to my senator regarding his inquiry on my case. It took them a while and then they told him the same thing they told me: no news! Your senator's office will likely contact you soon with this "non-update." I hope you hear something this week. If not, you should definitely follow up with your senator regarding this response.

Hang in there! They can't torture us forever. I am 40 days into this AP and the agony is starting to subside just a little. It is still miserable, but not as miserable as day 1, truth be told. Just waiting with bated breath for some favorable activity...

  11. Me again. Feeling frustrated. I know that all of us are subject to delays at any point during the application process, and it's par for the course. If I had been told that I was in AP at the interview it still would have been annoying, but it would have been easier to deal with. I walked away from the embassy thinking - great, it's over! For almost three weeks my husband and I started putting our plans into action. My trip to the States. Holidays. I was tying loose ends, closing accounts, packing stuff to be shipped, saying my goodbyes. People were affected by our decisions. And now it's all up in the air...

Here's hoping that we're all out of this limbo as soon as possible, all with approvals of course :)

I hear you treehugger. AP is like purgatory for both the beneficiary and the petitoner. It is one more bump in the road that we did not bargain for. The frustrating thing for me is I can't help but think they had enough time for these "background checks" earlier in the process. Why would they wait until after an interview to sock us with another delay??? So bogus! I thought that's why the process was taking so long in USCIS and NVC. Harumph! That's my gripe for the day
