  1. hi there..at first i couldnt figure out what really triggered them to let u sign that papers ur talking about..but after ur 2nd post with bunches of possible denials, i slowly understand why the denial of visa...first and foremost, ur hubby should have cancelled the K-1 application before u two applied for a K-3. second, one of the concrete proofs of an existing relationship is ur personal meeting, more so, he is now ur hubby ..... 2 times a year the least if u ask my opinion...third, the financial issues (bankruptcy and not meeting the poverty guidelines)

    im not perfect nor trying to scare u or depress you esp. with what ur going through now but the embassy interviewers have all the rights to approve or deny the visa..U should have advised hubby that things have to be cleaned or cleared up first esp the K-1 application for his X bfore ur K-3...Nevertheless, i totally disagree by what they said that ur just after the GC or for greener pasture...u mentioned u love ur hubby no matter what economic status he is in now...and thats the spirit girl! regardless of ur effort to explain how much u love r hubby, still they told u to sign that papers banning u to leave for USA(?)...for me, honestly, if i were in ur shoes, i would rather accept whatever they think about me and my hubby and thats their opinion but NEVER their rights to let u sign for something thats NOT TRUE...for u girl, try to calm down and give it a time ..better if u will let ur hubby call or explain to them which will prove of his sincerity and enduring love to u...and tell him to cancel the K-1 application of his X and then start again for the K-3 or see how u can revive the process again...( better yet consult an immigration lawyer)...ull never know....luck comes in a cycle...ur not always at the bottom,,,who knows u might succeed on ur next application ...also tell ur hubby if he can possibly visit u...ive never been to the States but im sure no government wants to be liable for immigrants' misfortune,if and when it happens....

    re: the veracity of ur marriage in the PI, its all true and legal..so dont worry...

    for now, try to look back what u missed as far as evidences /proofs are concerned...and at the same time PRAY that ur next attempt will be a successful one....whats more enduring and heroic than the love u have towards each other...that will calm u down now...have faith in Him ...God bless my friend...

  3. all i can say is some couples get their NOA2 in less than 2 months ..others in 4 months the most..

    whether it was approved on an earlier date or still have to wait longer,,it has special reason that ONLy God knows...so dont give up for those who are waiting..like me....as much as i want to be with my fiance, all i can do for now is pray and trust in HIM so he will facilitate everything...

  4. hi rebz...im sorry to hear ur case with ur hubby...

    i dont know how others would feel about it but in my opinion even if u ask him for the password, if he wont change his style and wont value ur relationship as a married couple, he might still be tempted and might create a new email addy which ur unaware of and might keep things from u again unless u catch him...u have to cure the problem from the roots...if it happens to me, i would rather talk to him in a nice way and see what is missing that will win back his full attention...men are men and they like to be praised and teased...communication and trust are 2 of the indispensable factors to a good relationship..trust me,,mine wasnt perfect when i was married before and i had problems similar to yours...fortunately, during those times we had no computers only celfons and celfons shops loved us for we always end up fixing/buying fons after each feud and with regards to privacy--yes..whether ur a woman or man, young or old,,each one of us needs some privacy..but its a case to case basis....but be aware too that u have all the rights to know whats going on with ur husband coz ur married in the first place...this is might be ur first time experience with such issue, communication is ur solution...try it..besides from what u shared, the confrontation ended up well ..except for the password

    i just dont understand why some women still tempt married men :bonk:

    i respect others posts here and i dont want some eyebrows to raise as they read this reply....this post i am sharing is based solely on what i think and feel is right to do....everyone has his/her own way of advising u...keep the ones that u think is right thing to do...i wish u no harm....

  5. hi pokerman...in my own opinion nobody cant stop u from seeing/meeting ur filipina gf for as long as ur divorced..well ur almost divorced as u claim...

    u can already start establishing a relationship coz u know more than we do that ur divorce papers is going to be finalized soon...but as for the issue of filing the K-1 visa, u cant start it yet unless its final(divorce) coz u need to show in ur packet ur divorce papers....its one of the indispensable requirements in submitting the I129...this is also true to ur filipina girl if she happens to be married..

    Assembling the I-129F Package: Checklist frequent questions

    Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.):

    1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted.

    2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

    3. Form I-129F: Petition for Alien Fiance(e) (see example)

    4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.

    5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)

    6. Proof of having met in past two years. (click here for examples)

    7. G-325A (all four pages) filled out by the US Citizen signed and dated (see example)

    8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    9. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated (see example)

    10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

    12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

    13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

    14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

  7. hi..my case is even more complicated coz i was married here before and u can imagine the annulment papers to submit..but i was not told by fiance to send the BC..and so far so good...he just submitted "HIS" BC for the I129..and not mine... although i got the original BC with me with no corrections of name or bday but only to find out later that it wasnt registered at the Local Civil Registrar's Office and NSO..so i got a negative result from NSO and they endorsed it to the Registrar;s office which took me more than a month to finally get the SECPA(security paper) of my BC (for the interview or RFE's if any )...i think for the interview they need the SECPA NSO BC...

    my suggestion is while u do the paperwork ready for the I129 packet for visa application, she can already go to the registrar's office (because i found out that NSO is not the liable agency for any name or date corrections--that whatever the LCR gives them, thats exactly what they issue in the paper) and address her concern there and they will advise her what to do ..

    good luck and im sure the sooner u do it, the shorter the hassle and long wait...

  8. hi fellow Vjers...i would like to ask if its normal for the TIMELINE to change the date for adjudication? we got the NOA 1 hardcopy last June 22, 2009..the first timeline says it maybe adjudicated between October 6-10, 2009..then yesterday it moved to October 8-15 and then today it says October 13-20, 2009...

    and another question is--- if it states there that the I129 F maybe adjudicated in 4 months, ,does it really happen in 4 months or can be earlier than that? is it really reliable?

    pls. enlighten me on this matter...just curious and excited here...

    Hi, as I observed before when I am still processing my K-1 visa, the timeline that the Immigration will adjudicated for my application was exact. Even until now that I am on my AOS, it is still exact. I even received my EAD and AP, advance from my timeline. It is a good sort of timeline. Hope for the best that your`s will be adjudicated in advance.God bless and good luck!

    hi netscot..thanks for the post..we want it sooner but i can also manage the tentative timeline they show here..its still within the 4 month period..but the only thing that bothers me regarding this is----it keeps on changing ..from oct. 6 to oct. 20..like the electricity in the PI thats fluctuating.. :whistle: ...

    and another question is--- if it states there that the I129 F maybe adjudicated in 4 months, ,does it really happen in 4 months or can be earlier than that? is it really reliable?

    pls. enlighten me on this matter...just curious and excited here...

    The timeline is an average based on the information that people who fill out their timelines provided. Perhaps Capt. Ewok could provide a statistical dispersal, so that we could see how consistent, or inconsistent the actual data points are. Your case may be completed sooner than predicted, or later than predicted.

    I agree. It's just an estimate most probably based on statistical analysis. Also, each case is different. The cases might finish sooner or later than the timelines specified here in VJ. Though let's hope it will be sooner than later. :lol:

  12. I wonder about the VJ timeline too, ours changed also. Anyway, we got our NOA1 on 3/3/09 and are still waiting for the NOA2. We are getting pretty impatient, but what else can we all do but wait?

    hi there..thanks for the input..yeah i guess its hard to be patient when all we think now is to be with our darlings the soonest possible time...

    i heard too from a friend that her timeline also changes from time to time..so i think its just a guide..giving us a rough estimation of time as to when its gonna be adjudicated...so i guess im not the only one who noticed the inaccurate time...and of course, nobody wants to wait that long..hope we will get the NOA2 this august or sept. but mind u, there is one VJ member here who broke the world record (lol)...in 2 months time, she got the visa...wow...as in WOW...amazing!!!!!!!!!!!

    urs has the fastest timeline of K-1 visa ever approved from all the ones i checked...in just 4 months...way cool ....

  16. hi there...its quite surprising because my fiance submitted the packet a day before u did which is June 17, 2009 amounting to $445 via California Service Center and thank God, it was not returned to him. He instead received a letter from USCIS to confirm they had the packet.. It was just a day difference to think. We dont know why they increased the K-1 fee...try to call their number or register in their site so u can keep track.

  18. in my case friend,,,lane and I make sure we chat everyday even for 10-15 mins during weekdays(US time) bfore he leaves for work...and when i have free time at work..but we chat longer during weekends and play domino..chatting doesnt have to be serious all the time,,u need to have fun too with ur partner online...and share anything under the sun and moon,,,if its true love, ull never get bored with each other...each partner needs to be creative to keep the appetite for love alive and sumptuous...for my fiance Lane,,he is like a complete meal...everyday has different flavor...which is good...

    friend..dont worry about the long wait..at the end of the journey ull see the light and life u want ..with ur fiance...keep the faith friend...

  20. for me i would suggest english both written and oral and driving lessons..thats what m gonna do (latter) too as soon as i get my NOA2..but still few more months to wait before then...funny and ironic..here is ur fiancee getting bored of her mundane stuff at home and here i am getting bored and tired of my present job sometimes.but cant do anything coz this is my bread and margarine(promdi kasi ako eh)...but im pretty sure that every moment spent on doing nothing is really very dull...ive tried leaving my job for a year and it felt good for a while until i got bored ....well, cross stitching is also a good hobby...or anything that will let u and her benefit once she is in ur country like a vocational course so she can land a job there if u permit her to work...this is just my opinion...thanks and god bless to u and ur fiancee

    In my case i already use my maiden name, then on the box "all other names used" i typed my married name before.then on the box "former husband" i wrote my ex's name...be sure to include the ORIGINAL paper to prove termination of previous marriage in your packet to send at USCIS.kasi pinadalhan nila kami ng RFE kasi hindi orignal napadala ko.
