  1. There is no particular requirement to file the AOS as long as you are married to her mother within 90 days. One of our sons adjusted status 10 months after Alla did. She cannot leave the US until she has an AP or green card, just as a K1. The K1 has 90 days to GET MARRIED. You can adjust status later.

  2. I'm in kind of the same boat, my Wife's son's (6 years old) K2 interview is a few weeks from now, my question is what are the rules for AOS once he is here??

    Do we have to file for AOS as soon as he gets here?

    Do we have 90 days like a K1 visa? (or ask the officer at Point of Entry for more than 90 days?)

    I guess what is the official rule, I tried searching and it's always the K1 info that pops up, I will keep searching.

    I guess the better question would be is it legal to start working without the EAD card physically?

    She has been looking around at a bunch of sites like monster, careerbuilder etc, and will start submitting her resume.

    But we were wondering if it was ok to be hired while wating for the card in the mail. I'm guessing yes since the card production basically means it's an approval right?

    On Part 2. Information on the principal immigrant.

    Do we put in the same Last name as the original K1 filing? Or the new Married Last name?

    If your married then your new last name is the primary name on the form, it will ask for any other names such as maiden name as well.

    OK Thanks, although the I-864 doesn't ask for anything as far as maiden names??

You still file income tax right you can use that..I don't thing a bank account is a deal breaker, if you have your IRS transcripts and proof of employment from your place of work, that may just do the trick, check the poverty limits while your at it so there are no surprises. What do you do with all your income, put it in a safe LOL..just kidding.

    You can easily put another package together...you did it once just get copies of everything again.

    You have to sign the bottom of the form. It's the first thing mentioned on page 1.

    The form below has no mention of food stamps at the bottom of the form.

  7. Hello Fellow VJ'ers.

    Is there a system that the USEM uses to know if the beneficiary has been out of the country for 6 months and requires a police clearance other than what we put down on the applications and what's on the passport?

    The reason I ask is there is nothing on our application and her passport (passport renewed) regarding her short stay in Kuwait and we didnt really want to have to go to Kuwait just to get a police clearance, if an NBI clearance would do.

  8. After 29 days in AP, our petition was finally sent to USEM on September 8th. She got a letter dated on the 17th that she was eligible to schedule her interview. In the meantime, I had already scheduled it for the 22nd. When she arrived on the 22nd, she was told to come back on the 25th because she was not in the system. On the 25th, she was interviewed but still no paperwork according to them. I had given her copies of everything submitted to the USCIS, so she submitted them to the CO but 2 pages of my divorce decree were missing. She was given the white slip requesting her to submit those 2 pages which both of us did and I have verified that that they were received.

    I can get no clear answer to if they have our file from the NVC although it is my understanding that they only send out the letter when they receive the file. DHL tracking also implies that they did receive it. I can get no further information than to wait 6 weeks and highly suspect that they have lost the file but will not directly admit it. Our wedding date has already had to move twice, and this has literlally cost me thousands of dollars. My demands for expedite do to their incompetence have fallen and deaf ears, and I refuse to wait 6 weeks just to be told to wait 6 more weeks at that point. :angry:

    Typically they don't let you set an appointment without being in the system. They wouldnt let me schedule my fiancee for an interview until they had the package from NVC. I called several times and they said "your file is here electronically but we have not received your actual package from NVC, on my last call the files arrived the day before and I was able to schedule.

    Missing paperwork in my opinion the white slip delay was not the USEM's fault. My fiancee spoke to 2 ladies that just finished their interviews yesterday and got the pink with no run arounds whatsoever. So they seem to be organized.

    Good luck I hope things work out and they correct whatever it is that's causing the delays.

    I went through the same process of not being able to schedule at first but then being able to schedule the appointment. Missing paperwork not their fault? The whole file went missing after arriving there. Who's fault is that? My fiancee provided duplicates of everything but 2 pages of a divorce decree she didn't have so that they could proceed with the interview anyway. This was all paperwork that they already had..........somewhere. I just want something to happen as it seems nothing is being done and there is no transparency. If flying there will make a difference, then I'll make that sacrafice. Just wanting to find out if someone has been there, done that, and had any success.

    I apologize I misread the the post..I thought you guys failed to submit the 2 pages. Sorry to hear they screwed the paperwork up.

  9. I see...my passport was renewed years ago and does not show the stamps from years ago when I worked outside the country.

    I guess other than that I was just wondering if the USEM somehow kept a log of every country someone has visited or worked for, that seems kinda impossible.

  10. Sorry if I'm being obtuse, but did you guys get asked for a police clearance? And what did you guys get? A paper from the local police department or something from NBI? I heard from someone about the latter being the right one but I wanted to make sure it was. My interview is this Friday and I don't want to mess up on just a single piece of paper.

    Police clearance is only needed if you had stayed out of Philippines for more than 6 months. You should get one in the country (outside PI) where you stayed or worked. But if you never fly outside PI since birth then all you need is NBI clearance.

    I STAYED in Singapore for 12 days, Company Training, does it mean I need to get Police clearance there? Sorry guys I'm confused.

    Absolutely no. It says at USEM site that it should be "6 months or more"

    Quick question...Does the USEM even have records that someone has worked outside the country unless stated on the forms?

  11. Like many Filipino citizens, my wife was an OFW in Korea for 3 years. Naturally, since she was gone that long she needs a police clearance from South Korea. Per the State Department website:

    Police Records

    Korean National Police Certificate (Crime-Investigation History Report: Bomjoi-Soosa Kyongreok Johoi Hoiboseo) is available to visa applicants of any nationality who are physically present in South Korea. The new KNPC now includes all serious crimes since 1945, regardless of expungement benefits under Korean law, and misdemeanors for five years, according to the Individual Information Protection Law of March 2003.

    Applicants presently in Korea: Foreign nationals, regardless of visa status, and Korean citizens must apply in person at any local police station. The KNP checks non-Koreans according to the requestor's Korean alien registration card or passport. Korean citizens must show a Korean identity card with the Korean citizen's unique, lifetime Korean identification number, which is found on Korean national identity cards and Korean passports adjacent to the applicant's name. KNP processing is no fee and takes less than one hour. The new KNPC bears a red ink half inch square stamp on the bottom containing the Korean characters for National Police. It is issued in Korean only and applicants must attach a complete English translation, certified as true and correct by anyone competent in Korean and English, for the visa interview. A simple computer printout of criminal records is issued with the Korean annotation for information only, has no red ink stamp and is not a KNPC for visa purposes.

    Well I used to work in kUwait and I didnt get the police clearance because in my case I should be personally presence to get the police clearance. We wrote a letter of hardship instead.

    Do you have to submit the letter of hardship? Or is this a one pager stating it will be a financial burden? Then just bring it to the interview?

    Did they even ask for the police clearance? I thought they only need the NBI clearance?

    I can not figure out how to procede to the next step and reading this forum making it more stress. I can't figure out all the codes you guys use LOL I'm a newbie i guess to the abrivations.

    so here is where I stand.

    I have gotten the acceptance letter.

    My fiance has gotten a letter from us embassy i guesss in manila.

    What is confusing is it was just one letter. I am readding that some have gotten a packet?

    So now she has to call and her phone is a prepaid phone the buddy phone. How can we get an interview it says if i call cost 18 dollars us OUCH.

    I got side track on my main question LOL

    The packet that is for interview it says i need to send her I-134 with my tax return and w2. And on the other page says i need the I-864 or I-864ez.

    We are thinking i just do all three also do i have to send her the original? can I copy it and send it in an email with my signiture on my scanner? Or do i actually have to mail it to her? This will take about 1 1/2 weeks to get to her in manial.

    Again any help or dirrection with this will relieve the stress cause at this point she is almost to the point she wants to quit cause it is sooooo stress full and is tired of beign with out me :-(

    You are right it's all confusing but the good people here can help you out.

    Just in case I obtained all the things listed on the i-134, pay stubs, last years bank statement, last 2 years IRS transcripts, and will bring most recent pay stubs to the interview, and myself as more proof of ongoing relationship LOL.
