If you are going to be a citizen very soon (on your oath day-May, 29 or later) , why do you need a GC anyway?

I guess you want to give your $450 to USCIS as a donation .

Even if you apply today for your GC renewal, it takes about 5 months to receive.

After you become a citizen, USCIS gives you Naturalization Certificate & takes your GC back.

Now you tell me, does it make any sense to renew your GC ?

I filled my i751 on november 2011. Went to Bio on February 2012.

We were fighting for 1 year and now we get seperated 2weeks ago. We are tried everything it just didn't work.she had so many issues it didn't work.

I left the house and we are not talking at all. I don't know my case number also.

I checked my mailbox last week. There was no updates. Don't know what to do? Any advice?

Since you are just separated, not divorced, so you can not do anything about it except wait. If you get approved, no problem.

However, if you get an interview you have to explain "why you have been living separately" & prove that the marriage was originally entered in a good faith.

Your case # is listed on your Bio App. letter. Also change your address with USCIS on-line.

You are a VSC-November 2011 filer, you have to wait for another 3-4 months & according to the VSC's processing speed right now, I guess you will hear about your case sometime in August 2012.

I went on to the Uscis and it has change from saying card production was ordered 3/30/12 to card production ordered 4/30/12.

I think for some reason, they have forgotten to produce your GC, since they updated it on 04/30/12,

they probably realized that your GC has been skipped & they are correcting their mistake now. I'm sure you will get it in 10 days.

I respectfully disagree with your assertion that the VSC aren't looking at applications in a logical order -- especially since your next statement: "I am sure they are going to start August-filers in May" clearly indicates that you DO think they work in a logical order.

If 50% of September applications had already been approved, then you might have a point. As it stands, they seem to clear the majority of one month's applications before starting on the next month.

I'm guessing that the less-than-100% success rates you're seeing on this site for March, April, May, etc., stem from the fact that some proportion of posters neglect to update the site.

What I am saying is every officer might handle different NOA dated applications, of course they process "First come first served" basis. At any given time, they are not all handling the same month applications. Let's say you are a May 2011 VSC filer if you have received a RFE & answered your RFE back, then that particular officer will readjudicate your case after looking into the documents he has asked for. VSC processing can not be placed on a logical statistics.

Please remember also, every officer's working speed might be different from each other's.

First of, let me tell you this. Your situation is not complicated. Late filing creates a big headache.

That NOA does not mean anything. USCIS issues NOA to everyone who correctly pays for ROC. Once her ROC has been adjudicated (right now sitting on one of the officer's desk),

she will be denied & put on deportation proceedings, but don't panic !....There is a way to get rid of this situation.

You will go to Immigration Court & tell your story before an Immigration Judge & I am sure he will remove the deportation proceedings & let you apply ROC again.

Then you will be under normal circumstances. Since you filed ROC recently, I am sure it will take time for an IO (6-9 months depends on Service Centers) to touch your folder but once IO looks at your folder, your wife will automatically be denied, that is the law. If she goes abroad in the mean time it can be so risky to come back to US, because once she has been rejected, all the privileges like work & travel will be frozen & she will be denied at POE (CBP officer can easily see her situation on the computer). I understand her mom is very sick but if she really has to go, tell her to make a short trip. The ball is in your court right now.

On the last day of March, 27% of July filers had already been approved. By mid-April, it was more than half.

On the last day of April, ZERO August filers have been approved. The first ones should be occurring any day.

This is your educated guess, but don't forget VSC don't work in a logical order.

I am sure they are going to start August-filers in May, but the question is when they will start in May & Who is going to be the lucky one?

Thank you for clarifying this issue. So I guess my stepdaughter will apply separately 90 days before her conditional GC expires. Now I still have two more questions. First, in Section 5 does my wife include her name or not since she is applying separately. It still states all your children without reference as to if they are applying separately. Secondly, when my stepdaughter applies separately, what documentation she submits? I would imagine she has to submit the I-751 form, her fees of $590.00 along with a cover letter with an explanation of why she is applying separately and a copy of her GC, front and back. She will also submit a copy of he birth certificate and a copy of her passport showing the POE and date of entry and documentation that she lives with her mother and me. Thanks again.

I totally agree with "Vanessa & Tony".

Put her name on Section 5 & drop a note saying that "She will apply separately due to her arrival to US more than 90 days of my (your wife) arrival"

They are good documents but also include any school related document shows "Name & Address". & don't forget the cover letter.

In fact, she is not going to remove condition, she will inherit the permanent residency (ROC & GC) from her mother.

When mom has been approved she will also be approved automatically.

I am hoping some fellow VJ'S can help me with a question I have for a friend of mine. He married on K1 visa. He will be filing for "Removal Of Conditions" for his wife and her 2 children. My questions for him is this, does he place the wife and 2 children on the I751 form together(as it does ask for children's info) or is it done on separate forms. He is aware of filling within 90days of green card expiration and all needed evidence for showing legit marriage. Also, how much are the filing fees for all 3 persons for lifting of conditions.

Yes, he can include them Section 5 of I-751 form, If the kids have arrived within 90 days of his arrival. One I-751 form & one check in the amount of $760. (505+3*85), but again if they satisfy the conditions of 90-day rule.

FYI, even the kids are under 14, no biometrics but they still have to pay for the fee which is $85, look at the sentence below, exactly taken from the USCIS site.

"Note on Filing Fee: Please include the base petition fee plus $85 biometric services fee for all conditional resident applicants.

Each conditional resident child listed under Part 5 of this form who is a dependent seeking to remove their conditional status,

is required to submit an additional biometric services fee of $85, regardless of age."

I just received another approval notice in mail today! they would rather mail us a actual greencard instead of sending out too many letters like this! unbelievable

My wife has just had her approval letter received here for her permanent residence and no interview was required. We now have to soon start the procedure (I-751) for her son. My question is: Do we gather all the same materials and go about the same procedure as we did with his Mom? I understand that there is rarely an interview for the sibling, which is fine either way, but want to be sure we send immigration the correct package. Thank you very much. Mark

Why didn't they apply together ? He is going to inherit his permanent residency through his mom. Has he arrived to US after 90 days of his mom's arrival ?

I was hoping the Infopass appointment I went to could give me some more answers on my case. The IO told me right now they are taking a year to process the I-751 so I don't need to worry. He asked if I received my letter for the interview yet. I have not, so I am assuming I will be getting one of those. He was very pleasant but would not stamp my passport with an I-551 as he said my extension letter should be good enough for summer travel out of the country. Here is my question, my receipt date on my I-797C (extension letter) is dated 07/05/2011. Would this letter not expire 07/05/2012? I told him I would be traveling at the end of July and he said that was fine.

I wonder how he knows you will have an interview ? & FYI, one year extension is counted from the GC expiration date, not NOA date.

I received my green card provisory in 2010 and after a few months later a suffered domestic violence at the hands of my ex husband. I was still married when I suffered the violence. I had to submit I-751 but my divorce was pending, it took 1 year and 3 months to finalize my divorce due the trial.

I submitted the I-751 without the divorce decree with the help of my friend and lawyer, she is a member of the Visa Journey "Sandranj" .I sent the I-751 as a battered spouse and bonafide marriage, I chose both options, but my friend Sandra warned me that the USCIS could accept my I-751 waiver as a battered spouse and they wouldn't ask the divorce decree or they could accept just based in bonafide marriage and the USCIS would ask me the divorce decree, because good faith marriage that ended in divorce is mandatory the divorce decree, but that I had a huge chance that USCIS would accept as a battered spouse!!! Today after ten long months of waiting the decision Vermont Service Center approved my permanent green card without divorce decree and without Interview.Glory To God.

CONGRATS !.... You are just a lucky girl. I'm really surprised that you haven't been called for an interview.

I am still confused because when you answered enigma11561, on the same subject, you advised only to fill out only one I-751 and pay 2 bio fees along as the children are entered in Section 5 of the form. Enigma11561 clearly states that the child entered several months after the principal beneficiary.

He said "Several months" later, I took that word less than 90 days, that's why. If it is more that 90 days, they have to file separately too.

I believe VSC has been adjudicating ROCs for the months of May, June & July nowadays at the same time.

Also don't forget every officer's handling, approval speed might be different from each other.

VSC should make a movie & call it "WAITING GAMES" as opposed to "HUNGER GAMES".

I have began to study the removal of conditions for my wife and her daughter and I find the information at the USCIS site a bit confusing. It states that if you have dependent children who acquired conditional residence status concurrently with you and entered the United States within 90 days of your arrival, then include their names in Section 5 of the application. Then it goes on to say that if the dependent children acquired conditional residence after the 90 days of your adjustment then they have to file separately to have their conditional status removed. In my case, my wife's daughter entered the US four months after my wife's arrival, however she was granted conditional residence status within the 90 days of my wife's adjustment. So according to the first part she is not eligible but according to the second part she is eligible. Now which is it?

She has to file I-751 separately because she entered to US after about 120 days of her mom's arrival, not within 90 days of your wife's arrival. She doesn't fulfill the first condition. They might go to Bio on different days too.

He said that i could apply for citizenship after 3 years of marriage AND 3 years from the first initial date on the GC. I said to him that a person could apply for citizenship 90 days before the date on the GC? and he said that it is better to apply pretty much by the date on the GC or they will send back the N-400 form and you will lose the $680.. So now i am not sure if it is ok to file 90 days before the date on the GC or not.. Anyone know?

I am afraid that your IO who has interviewed you does not know or he hasn't read " The instructions part of N-400 Application ".

This is exactly taken from USCIS web site, here you go :

" If you are applying based on five years as a lawful permanent resident or based on three years as a lawful permanent resident married to a US Citizen,

you may apply for Naturalization up to 90 days before you meet the "continuous residence" requirement.

You must meet all other requirements at the time that you file your application with USCIS"

My 2 years green card expires on 8/5/2012. The 90 days time frame includes Saturday and Sunday? If I file/send package on 05/08/2012, is it within the 90 days period? I am applying as soon as I can because I have a business international trip on June 14th 2012, and would like to have the biometrics completed prior to the travel.

According to your conditional GC expiration date, earliest you can file is May 7, 2012.

Why don't you do it after you come back like I always do. Unless you stay abroad about 2 months.

My wife and I will be applying for I-751 JOINT PETITION TO REMOVE CONDITIONS ON RESIDENCE for myself.

I have a trip abroad on June 14, 2012. I will send the package on May 8th 2012. Per your own experiences, do you believe my biometric appoint should arrive by then?

Also, do I have to make an infopass and get a stamp on my passport for this trip? Or the letter, green card and passport should be enough?

It is difficult to say nowadays, they both (NOA & Biometric App. Letter) might come before your trip. According to my experiences, they will probably come but you never know.

If you get the NOA Extension Letter, then it is going to be enough to travel passport, expired GC & NOA Extension Letter.

However if you do not get the NOA letter on time, I mean before your trip, make a INFOPASS at your local USCIS office & get your passport I-551 stamped.

If you get the Bio App. Letter & the date is let's say after your trip date, you can also do your Bio by walk-in, just in case take the copy of e-ticket with you to show that you are going abroad.

Some ASC doesn't accept walk-ins, but most of them do, again everything depends on the person, If you are nice to them they will be nice to you too.

Another scenario is you receive your NOA letter but not Bio App Letter, in this case appoint someone to check your mail box & If you get the Bio App. letter while you are abroad reschedule your bio

according to your return date.

Bottom line is, If I were you I would file my ROC after I come back to US, you have 90 days to file, I wouldn't worry about it while I'm abroad & also the date you are filing (according to your trip) is very risky, considering not much time in between. Good luck!....please keep us posted......

Date of I-751 = The Date you sent your application

NOA Date = The Receipt Date on your original NOA letter

Biometrics = The Date of your biometrics appointment

I emailed VSC approx two weeks ago. This is the response I got back:

The Form I-751 is still pending and within our processing times. We are currently working cases from June, 2011, so you may receive a notice within the next 60 days. Thank you for your patience.

If you would like to obtain forms, filing instructions, case status or schedule an appointment with your local office, please visit our website at www.uscis.gov.

It is kind of funny, it says "Thank you for your patience" but they (VSC) don't know we have no patience left anymore !....
