Wait a second, Did you get approval on your interview which was on April 26, 2011 ? & according to your GC you have been resident since December 29, 2011. This does't make sense, something does not add up here.

Is the I-797, Notice of Action actually an automatic reply to everyone that files an I-751? The attorney states that a clerk just accepts the money and issues a receipt (the I-797). And that once an examiner reviews her application, it will get denied.

You see I am not the only one who said that, even JP's Immigration Attorney did say the same thing. Like I said before DEPENDS ON IO'S DISCRETION !.....

As my stupid friend's case, he has not sent any explanation/apology for being late, maybe that is why his wife has been rejected, I don't know. There are double standards in every company, every office.

Every IO has been trained for laws & procedures but guess what, they don't have to follow exactly same paths always. I rest my case, thank you. Next subject please .

Can anyone please help me to clarify this.

On the notice to conditional permanent resident letter, it stated that I should remove the conditional status from Jan 29, 2014 to April 27, 2014 but when I receive my green card, it said that my card expires on 29/12/2013 and i start to reside since 29/12/2011?? Very confusing? So when should I start to file for the removal of conditional status?

Your conditional GC expires on 12/29/2013 & you're approved on 12/29/2011 or you have been residence since 12/29/2011.

You should mail your ROC between 09/30/2013 & 12/29/2013.

I got the 1 yr extension!!!! This is insane. I thought I was gonna have to wait longer. Just seeing the envelope in the mailbox this early on actually freaked me out. I thought it was gonna say something bad.

Hello all fellow ROC friends

Just have one question I hope someone can help me with.

I'm waiting for my card, but we are going away for a couple of weeks on vacation. Is the card just delivered in the mail or does someone have to sign a paper when they deliver it?????

USCIS's started sending GC's by USPS with "Pick-up & Delivery Confirmation".

If you create an account on USCIS site by entering your Receipt # (from Bio App. Letter) & you check OK in e-mail.

You will track your card by getting e-mail from USCIS. So it does not matter wherever you are in the world, as long as you periodically check your e-mail,

when the card arrives, you can tell one of your buddies/neighbors/relatives to get it from your mail box.

FYI, if it is lost after delivered by USPS, you have to file I-90 & wait for about 5 months for replacement, on top of that you have to pay $450.

Thank you very much. With 2 babies and trying hard to fight life these kinds of issues are the last I would want to fight. I received NOA to my Baltimore address (I filed from Baltimore). Now I am awaiting biometrics letter. Will they consider the address on the ROC petition or will they dig up my 2 years record based on A-number and try and find Florida address. I dint know I had to file the address change. I dont even know how florida looks like.

Relax Buddy !....Forget the address in FL, You're now Baltimore, MD resident.

USCIS knows you at this Baltimore, MD address. Please don't start being paranoid like some other people on VJ !....

Hi every one,

I filed my I-751 on the 16th of April 2012. I received the NOA on the 23rd of April (Dated 19th April). I am eagerly awaiting my biometrics letter but haven't yet received it. I am concerned about the following issues and sincerely request your opinions. My sincere thanks to you all in advance

1) I will have to do my Bio at the Baltimore Field office. Is this office known to be slow in scheduling appointments. Anybody among Feb, march or April filers at Baltimore, have you received biometrics letter. If so please let me know your time line and when you received the letter.

2) I am shifting to PA by end of June. When do you think I should notify an address change and how soon do they update it to their system.

3) In case I dont receive biometrics before I shift to PA will this delay bio appointment further? will I finger print in PA or Baltimore?

Please let me know.

1- I'm sure you will get it before you move to PA, if the Bio App. date is later than your moving date, you can always do Bio walk-in in Baltimore office as long as you have the Bio App. letter in your hand.

2- After you move to PA, you can change your address on-line, here is the link https://egov.uscis.gov/crisgwi/go?action=coa.Terms

you will get a confirmation e-mail by USCIS, save that e-mail for a proof that you have actually changed your address.

3- You will get it before you move to PA but just in case bear in your mind that you can always reschedule your Bio App. too.

FYI, since you're an April 2012 VSC filer, you will probably hear something about your case in January 2013 or later.

Here's the irony. My case WAS relocated to the local office back in October and then nothing was heard even after a SR.

Odd huh...

This is so weird. The only reason I can think of right now, local office has forgotten your folder or misplaced for some reason.

I filed I 751 in April, received a letter called I 797 Notice of Action recently, I just want to make sure this is part of the normal process.

the following is the brief summary of the letter:

"Your conditional resident status is extended for a period of one year.

In order to further process your petition , you will be receiving an application support center appointment to capture your fingerprints, photos. you must wait for you applintment notice"

there is one paragraph stating that:

"NOTE: conditional resident applicants will not receive an ASC applintment notice."

I 'm little confused, am I coditional resident applicant or not? will I receive ASC appointment notice?

You're fine, nothing to worry about. Don't be confused. Wait for your ASC appointment notice for your Biometrics.

You did not write the sentence completely, it says as follows :

Conditional Resident applicants ( including conditional resident dependents) WHO have been residing overseas pursuant to military or government orders WILL NOT RECEIVE an ASC appointment notice.

Okay some interesting development to update.

Got an letter from the congressman today, mailed from his Washington DC office.

Attached is a printout of the email from Congressional Liaison of the NBC.

Basically it stating that since I have a pending N-400 case and a pending ROC, "... the forms I751 and N400 will be adjudicated at the SAME TIME by the local USCIS office..."

That's not the whole story, it also stated that "... however if the field office approves the N400, the applicant is granted with the citizenship while the I-751 will be CLOSED; of the N-400 is denied then the I-751 will be adjudicated accordingly."

Blah blah blah they can't interview me before sometime in the future (LPR + 3-year rule).

Looks like I'm going to get my passport stamped soon here and, hopefully to hear from them soon.

Wonder if this simply due to the fact that I got the congressman involved or USCIS started to do things like this...

That is actually good news, local office can adjudicate ROC much faster than CSC or definitely VSC.

Normally, local offices don't handle ROC cases but If one of Service Centers asks, they do.

I'm sure you can be a citizen in the year of 2012. Maybe you can even vote if you get registered in time .

I will start the procedure for removing conditions from my status of permanent resident and I have a question: my wife is the citizen and she has a daughter, that is my stepdaughter, that lives with us that is a citizen since the birth: should she be mentioned in the part 5 of the I-751 where it says to list all the children?

Yes you are going to list her but under the immigration status you are going to say USC. Look at below for Section 5:

Name DOB A-number Address / Immigration Status Living with you

Jane Doe xx/xx/xxxx N/A Same as mine, US Citizen Yes
