I did. I didn't say much so as not to bore the person reading plus I didn't really have a long explanation. I said the truth, that I was under the impression my due date was the end of May, and that I understood it was not an extraordinary reason to miss a deadline, to understand we wouldn't file late on purpose and that we were sorry. That's kinda what we said. I mean it has to be clear it's human error, considering one of the affidavits was dated to before the expiration date (cause I was convinced I was doing it all in a timely manner).

Mailing late causes "Detour" in the process & gives you headache. In the end, you will be approved, nothing to worry.

If you give a good excuse then IO accepts your late-filing, of course it depends on his/her discretion.

Otherwise, I'm afraid you have to explain your reasons (of filing I-751 late) before an immigration judge. Good luck !... Please keep us posted...

You can discuss that you have filed it on time but received date is considered not the post mark.

Since USCIS was closed at weekends that is why your filing has been rejected , however if the next day was a work day, this wouldn't be happened

Not exactly true. Please read the law on this. While they do not HAVE to (technically they don't HAVE to file any of the paperwork but for the protection of her status of course filing paperwork is prudent)... as soon as the divorce is final the conditional GC holder is in breach of the terms of their GC and deportable (if found by ICE of course). There are many discussions on this topic and several the mention the specific law involved.

I would not be traveling without that NOA1 showing they have followed the terms of their greencard.

Out of 3 process AOS, ROC & CTZ: I think the most "excruciating" & "pain in the assssssssssss" one is ROC. The easiest one is CTZ which takes 3-5 months, very straight-forward process.

I am trying to get the sworn affidavit from ex-wife to submit my RFE. need help what should be included in the affidavit.

It is very good idea & strong evidence. Basically she should be saying "the marriage has been entered in a good faith & the didn't work out".

She can write any format she wants, it doesn't have to be notarized.

I didn't say you were making it up I simply said there is no guarantee what will happen and you don't know what will happen. The section you quoted about the waiver filing actually refers to filing for ROC with a divorce waiver before the 90 day window, it's to clear up that issue. The gentleman I mentioned that was late filing (with a waiver) had VERY strong circumstances for failing to file in time (personal reasons that I am aware of but not able to divulge) and I'm sure it was his letter that helped his case go a bit smoother.

There is no guarantee this person will go before a judge. If they've already been put in removal proceedings then yes they will, if they haven't there's a chance if their case is strong enough that they will avoid it. I'm simply letting them know that they don't have to dread the worst, plan for the worst yes, but hope for the best.

My friend, there is no guarantee of anything in this world. Everything is up to the discretion of the IO who's handling your folder & every case is different.

But what I'm saying is " Under her circumstances she will be rejected " , that is the LAW !..... I would be so surprised If she doesn't get rejected.

VSC has really only reached July 4, 2011??? More than a month ago, they had almost finished June applicants!

Maybe you do not have to travel with NOA, you might have a shot to receive 10-year GC before your trip. In either situations, you will be fine.

I received email/text this morning stating that my card had been mailed to me. So I called uscis to get a tracking number and they told me that one has not been assigned as of yet, because the card has not actually been sent, that it was still in production and I should call back on Friday. These guys don't make anything simple do they?

I can see that your GC production takes little bit longer than usual time, normally takes 7-15 days.

You got approval on 03/26/12 & as of today 05/02/12 you do not have GC in your hand yet. That is kind of late,

but don't put the blame on USCIS because a private company in MO produce Green Cards. Anyway, if you get it, please let us know.

Unfortunately though your wife's card DID expire so she should NOT leave the country until she has a new card.

I'm not making up the laws, you can find information below, plus one of my co-workers & his wife has applied ROC jointly like 10-day late & they had to go to an Immigration Court in Newark, NJ

I remember it was very hectic, just a big headache...After the Immigration Judge has seen their baby boy, he has granted her status again, sent the decision to VSC & the case has been resumed as if they have sent a RFE.

They have not applied ROC from the scratch.

That post is applying ROC with a waiver. Late filing can be excused because of divorce !....

Below is taken exactly from USCIS website :

- Your conditional resident status will automatically be terminated and we will begin removal proceedings against you - You will receive a notice from us telling you that you have failed to remove the conditions

• You will receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (we are not responsible for proving that you did not comply with the requirements)
  
• The Form I-751 can be filed after the 90-day period if you can prove in writing to the director of the appropriate Service Center that there was good cause for failing to file the petition on time. The director has the discretion to approve the petition and restore your permanent resident status.

Hi Everybody

I need some HELP please . I got married on April 30 2009 , got my CGC on February 2011 , got divorce on December 2012 ( ex husband was cheating on me so bad ) Now i didn't now that I can remove my condition when I got my divorce decree last december , now my question is , I want to go to my country Argentina in July .Should I wait to come back from Argentina and file the ROC with a waiver or should I do it now before my trip . Please some advice , like I said I did'nt know that I didn't have to wait for the 90 days before my expiration date . Thank you

Let's clarify some points & give you some facts about your situation :

1- You do not have to file ROC as soon as you get your divorce decree.

2- You do not have to wait for 90-day window before 2nd anniversary of CGC either.

3- Since you got the divorce decree, you can file ROC anytime, of course earlier is better.

4- You had better file ROC with a waiver anytime soon, so you can do Bio before you go abroad, waiting time for CSC is about 6 months.

5- Send as many as evidences you've got with your ROC, more you send less likely they call you for an interview.

6- Get ready for a possible interview though, you have to prove that your marriage was entered in a good faith.

7- You don't even need a NOA (GC Extension letter) because you have the CGC valid until February 2013.

8- Appoint someone to check your mailbox while you're abroad & sign-up e-mail updates of your case with USCIS

{You have to enter Receipt Number found on ASC Bio App Letter, Not NOA(I-797C)}

9- If you apply ROC in this month, May; you will go to Bio sometime in June. You"ll probably hear about your case sometime in this year.

And yes I thought we were good to go as well but you must meet all other requirements except the continuous residence requirement to apply early... which means you must be married to and living with the US citizen spouse for the 3 years immediately prior to applying. For us at least that didn't begin until POE

I go back and forth with it but I've found some posts that mention couples being denied (like: http://www.visajourn...-90-days-early/) so I think we're just going to wait the full 3 years.

If you satisfy the Continuous Residence situation, I'm %100 very sure, you can apply for your citizenship as early as 06/13/2012 !...

I just have a quick question to see if anybody knows this in PA. My license expires on June 2. I filed in September and my extension letter would expire on December to VSC. So I am 500% sure I wont have my card before my DL expires. Did anyone experience this in PA? Thanks.

I don't know about PA but if you are in NJ, you would get a DL until May 2013. NJ DMV people calculate like this: NOA Date (Not GC Expiration Date) 1 year (Extension) + 5 months (Extra).

Example : Let's say your NOA letter dated December, 17 2011 & you can get a DL in NJ with the expiration date May, 16 2013.

That's entirely what I am thinking. I was just surprised to see an update pop up so late after getting the card and being done with the process.

FYI, USCIS computer information system has not been working perfectly. Sometimes they do update sometimes they don't.

They even mail so many approval letters/notifications/ send text-messages too unnecessarily but never duplicate GC, because they are not produced by USCIS but by a private company in MO.

Now you can clearly see the differences between a government office & a private company.

One thing they pointed out was Date of Marriage

Please verify the correct date of your marriage. You have indicated on your From I-751 that you were married on February 28, 2009 and on you Form G-325A you indicated that you were married on April 13, 2009.

We had our ceremony on 02/29/2009 and we celebrate our wedding on that day. However I believe we got the license later 04/13/2009 so that was the date put on G-325A. However 3 years later I did the I-751 and when they asked for Date of Marriage I put 02/29/2012 because that is the day we celebrate it. It think if I send in more proof and an explanation it should be ok.

Bryonm4, my friend, there is only ONE Marriage Date, it does not matter when you receive the marriage certificate or when you celebrate it .

Those days are irrelevant with the question asked in the forms.

Of course, when you give so many different dates which will raise red flags.

When you answer your RFE, please include a detailed Cover Letter explaining the situation,

otherwise I'm afraid you have to answer so many questions over and over again in front of IO at a possible interview.

Anyone can easily guess the first question being asked multiple times during the interview like "When did you guys get married" ?

i have conditional GC, that expires in fall 2013. this fall 2012 i'm planning to go back to studying, not in CA though, where we live, but in WA. as this is where i would like to get my degree. So...if i change my address for a while, even one semester (i have to get to university again for my career) will that b an issue when i file the form to remove conditions. do i have to mention it there? will that be considered physical separation? what are the possible consequences? Anyone with similar situation, pls help... i have my brain steaming by now trying to get the answer... Thank you very much for your time ans answers )

Why do you want to change your address anyway, keep the old address where you call home or where your spouse lives. You are free to move to any state for any reason,

but the question is if you leave your spouse back in CA , it might raise some red flags. Assuming that you are happily married,

if I were you I would not change my address with USCIS for one semester.

I would temporarily move to WA to study & come back home. It is that simple. You have got a plenty time to apply for ROC anyway.

Got a letter back from the congressman today, basically it's just a receipt stating that he will put in an inquiry directly to the CSC's director about the case.

I have a feeling something is going to happen this month... fingers crossed.

10 months + for CSC, that is so weird. Your case is very unique one. I have been following you closely, hang in there. Please keep us posted if you hear anything.

They may have changed their rules in the interim. Right after I got my Utah driver license in December 2009, good for 5 years, they changed the rules so that now you can only get a drivers license good for as long as the documents you show them. If I had waited until January 2010 to get my local drivers license, it would have expired with my 2 year GC in December of 2011.

FYI, in our state, NJ they give the DL until NOA Expiration date + 5 months.

Let's say your NOA dated September 16, 2012 they give DL expiration date as February 15,2013 & indicating the licence written "TEMP. IMMIGRATION STATUS".
