o.k, finally joining the thread after reading through for weeks. i have a question for you PROs:
i will like to know if we will be required to pay another $400 at the embassy, the information on the Nigeria embassy website currently stats that a visa fee of $400 ($355 visa fee and $45 surcharge) is required at interview. Is this the same $400 that we have paid to the NVC or is this another fee entirely. Response will be greatly appreciated. Thanks.

i couldn't agree more. i am still crossed with uscis, but i just moved on since the lord has delivered me from them. u know what? i only thanked God not CSC they do not worth my thanks bcuz there is every indication that some biases exist in their processing. guess what again? blast them here, it is the least u can do. it helped me when i was in the waiting to blast them here. even if no one cares i just get some relief from it. but do not say any word of threat that may get you hunted and arrested just say how much inefficient, irresponsible, and possibly prejudice they are. i am sure they have heard that being said about them several time and will not be surprised. and talking about calm, you can never be calm until u get ur visa and ur SO get to the U.S without hassle. for someone like me filling for an SO from Nigeria which happened to recently join the list of the TO WATCH CLOSELY countries when a spoiled motherf**** tried to destroy peoples christmas it is definitely not calm yet. I happened to know that the USCIS wait though insanely annoying do not hold a water when it come to the embassy. Approval from USCIS only goes thus far, the big guns at the embassy has so much power for one person that they can snatch the long awaited USCIS approval away (May Allah forbid this).
Bottom line, let out your steam here but becareful what you say. Plus you will be cool after approval and then get hyped for the embassy again, in all you are never cool until your loved one cross over and you can live happily ever after.

I hate checking the website, it usually gave me depression to see the screen unchanged and the date stays the same. If you can avoid it, it may help. Plus VJ also gave me depression and that was why I tried to stayed off sometimes unsuccessfully. Sign up for the text message, it is the best way to get a real update or meaningful touch rather than the depressing self checking.

My wife and I constantly pray for those of you who are still in the process, whether it be USCIS, NVC, Consulate or flying over to the US. We have been very fortunate in the sense that when we were together over Christmas, the previous 6 months seemed like nothing at all!!Our nerves have calmed down a helluva lot since december. I COULD be approved tomorrow, or, I could be approved in March. Whether it's then or now, it doesn't phase us too much. We know what we have is true and we could wait forever to be in each other's arms again!
Not only that, but we found the time apart has helped us as well on our journey together, as well as individuals. She has become a lot more responsible than the person she was 6 months ago, and I too have changed for the better.
Distance makes the heart grow fonder. this is true in the initial stage of the journey. Anything more than about 2-3 months just causes heart aches. Until, you are physically back together and that infatuated feeling runs through your veins and the excitment and love is rekindled within.
I cannot wait to step off of that plane on February 17th in LAX to greet my darling wife. I am going to soak up every moment of those 3 weeks before returning home again!!
As for the PC -------> HAHAHAHAHAHAHAHAHAHAHAHA I'm a douche bag. Here I was, thinking, 'SURELY there has to be a computer to use SOMEWHERE in Florida' lol my bad :oP

@waiter, @aus2usa, @sachinsky and all others don't worry your miracle is around the corner. as you can see that the USCIS stage seems to be the longest, as soon as that is over the NVC will compensate you all. Remember those of us with approvals in your prayers because we still have the last stage at the embassy which holds the key to our joy. I wish us all a successful and stress free end.
I was just reading other thread where sept and oct filers are getting thru NVC and some getting interviews and some getting visas.I am happy for them
but so depressed for myself.
MsSheka and I had same priority dates and she so lucky , she is already at the end of NVC process. Good for her
but what about my file? who the hell is playing with my life? this is total Pure BS.

May God help us all waiting for VISA in NIgeria in the wake of the spoilt child that set off another alarm for the red hot US Embassy in Nigeria. I just put all my hopes in God now because any negative outcome can end my life, i already know that. He succeeded in adding terrorist to the scam reputation that has been shameful to the country's image around the world. I feel for you Nwayioma may God ease your pain.

113 days Sachinsky, you know i was loosing my mind before the approval. Maybe a couple of weeks is what is left and you may get a new year gift like myself and Ms Sheka got the christmas gift from USCIS. Hang in their girl soon the nightmare will be over, but pending the time express all your frustration here at times it helps.

This is the reason why we paid hard earned dollars for our beloved adopted country to get some our beloved families here in order that we may be happy in the holidays. An approval will make us hopeful, and when we are ignored throughout the holidays we carry our depression throughout the entire happy period, and when we get it after the holidays we take it but the magic is no longer their. So, let the USCIS staff enjoy their holidays at our expense, let them make others who filed after us in October and November have a happy holidays since they've got three heads and we've got just one. It is no wishful thinking to want our approval in December, it is our right since we filed in august and somehow got sept 1st date. It is a shame on them for being prejudice by processing some newer applications while the old ones are left behind. Yeah, i can go on and on, it will not change anything but please choose your words carefully since this is a very sensitive issues, for some of us, like myself I have always worked on the holidays for many years not because I particularly liked to but because I would rather be at work and bury my loneliness at work than to spend it with other families when mine are thousands of miles across the ocean and wish I could be with them or they could be with me. Like I said on my previous post, expect a surge in application approvals for September,October and some applications prior to it to be processed around January-March (which still fits in their approcimate time frame) with most apps for September filers possible receiving their NOA2's or RFE's around February.
In general, November-December is such a busy month, and with a lot of holidays coinciding in those months along with the anticipation of a much celebrated Holiday, expect productions to go down a little bit. I mean the fact that most September filers are not getting any notice is a clear give away that they are not working on these particualr set of I130's, so for those waiting for NOA2's before X-mas are just wishful thinking (And there's nothing wrong about that). It would be better if you guys would just focus your attention on your family and enjoy the holidays. Put all your anxieties and worries aside, and start fresh next month because 2010 is your year

He is not serious with this post, he just wants to stir people up. Note that he joined today and his story did not add up, first he/his wife was here january and he has been married to her four years, and his wife came to US in january and later on he has been here for 1 and half years! It is not even a year yet from January. He is a joker and a trouble maker who wants to stir up Nigerian because he knows the country is dogged with fraud and he knows people will be quick to call this out as fraud.

Ok my thinking is if he goes and applies to remove conditional status this reason is enough for the interviewer to turn him down and start removal proceedings agianst him. This in my opinion smells like fraud all around. This is not a good reason for one to want out of a marriage if they claim to love their spouse. Absolutely ridiculous.

hello everyone,I married with a us citizen 4 years back and it was all fine and my wife left nigeria in january and i got my visa now i am on a 2 years green card and living with my wife here in usa since one and half year the problem is that when we sleep in the night my wife has a problem she can not help at all and problem is that she passes gas too much in the days i stay at work and when i am back from work we sleep together and she pass gass that turns me off and i want divorce please tell me how do i get a divorce and how much time it will take i love usa i want to live here but not with my wife.

this is the reason why they are always backlogged and have pendings that exceed new receipts X3! They have shut down since september and only process a few new receipts and the very old ones that have been previously neglected. Yet, they are still taking all the days off as holiday, thanksgiving, christmas, hanukkah, kwanza, new year, unused or deferred vacations, sick days and what have you. They will resume work in January and when you call to question why they haven't process your application they will be telling you: we have been backlogged, it is name checks fault, it is the staff on maternity's fault, it is Obama's fault, it is your fault for wanting to marry from abroad and all other bullsh*t! How about it is their fault because some of them work great while majority of them are lazy couch potatoes who hides under the pretense of 5 months processing to put hard working citizens through an immeasurable emotional roller coasters.

you are right, a home check can also help if they have doubts with his affidavits. as long as this is true then home check will free them "if" the embassy ever questions them. but if it is just the two of them that are aware of this then it is their words versus the consular's opinion vs whatever proof they have
Surely, the fact that the child was born AFTER marriage and the fact that the petitioner is named as the father on the birth certificate and they have another child born after that is the biological child of the petitioner means the likelihood of it being called to question is slim.I would however, in my limited knowledge of Lagos, ask if there was a police report (because the consulate could potentially find it) and/ or if anyone outside of the family (friends, neighbours) are aware of the situation in case they carry out a home check. If no one but the petitioner and his wife are aware of the situation, why would the consulate question paternity of either child?
What would it take to legally adopt the first child and would it even be possible when named as the father on the birth certificate?

packet 4, i have heard of some people who were not require to have dna test but that was a long time ago. check lagos embassy website they already have packet 4 online and the instructions.
About DNA concern and your name on the birth cert:The child is also eligible for the visa since she is your wife's, any DNA test will proof that the child is your wife's and that you are not the father. And you are entitled to have your step child immigrate with your wife. Rape or no rape is not a big deal, at least for this case. You can get the affidavit in case your wife is questioned about the paternity and accused of trying to bring in a child from another marriage with your name as the last name. There will only be issues if the child is not for you or your wife's and a proper adoption document is not available.
Pls when do you think DNA is usually done ?
is it at the interview date after seen the Consular or when she get her packet 4 forms

if DNA is required it will be part of the medical, the consular will not meet her until after the medical therefore she will have to do DNA to prove both maternity and paternity. You should also do an affidavit to prove that you were aware that she was raped and that the event produce the child and you send it to her. It is left for the consular to believe the story or not believe especially if there is no police report, it is your words vs their opinions. But the bottom line is that this is your step child and my intuition is telling me that except if your wife is not the mother this should not be as hard as you thought. The last name can be explained and it is not a big deal, people can change their name to whatever they want (though embassy may not give u that right as a Nigerian since they presume everyone to be scamers until proven otherwise)

There is no need for you to be hard on yourself about this case, though I realize that the thought of going to Lagos embassy and having a not perfect situation is hard enough as they can play any card and doubt every truth. No matter what, we will still go to the embassy and demands what rightfully belong to us and fear not because we are faithful people. The perfection / imperfection of your case do not guarantee approval either (at least at Lagos embassy) we have had cases that are perfect that are blatantly refused while the scamers got approved. It is not a one way traffic, and of all -- God has the last say.
In your case, go back and read the I-130 instructions and you will find this:
8. Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, copies of documents showing that any prior marriages were legally terminated and a copy of the stepchild's birth certificate.

D. Affidavits: Written statements sworn to or affirmed by two persons who were living at the time and who have personal knowledge of the event you are trying to prove. For example, the date and place of birth, marriage or death. The person making the affidavit does not have to be a U.S. citizen. Each affidavit should contain the following information regarding the person making the affidavit: his or her full name, address, date and place of birth, and his or her relationship to you, if any, full information concerning the event, and complete details explaining how the person acquired knowledge of the event.

In addition, if there is any police report like someone suggested (despite the imperfect structure in Nigeria, you will be surprised that she can get this if she reported the incident at the time) you should get it and add it with the affidavits, IF NOT i do not think the embassy will be too surprised (just make sure you did not get a false police report if there was not a formal report at the time of the incident). With that being said, I want you to know that this information do not substitute for a legal advice and it does not predict the outcome of your application. Your case is unique and I wish you the best. Please stop bothering yourself as this will not solve the problem, everyone here has issues as well and no matter how much you bother we cannot solve your problem.

the text message came in late at night, i think it was around 10p.m or something. MsSheka also got a text message at the same time because we both rushed here to give you guys the goodnews. If you go back to the pages where we wrote our approved info the text message came just 5 mins before those posts. But, don't get bugged with this because it can steal your sleep. I strongly believed that you will get some touches and an approval very soon.
