  1. I know that this is not a fun time however that time frame is not very long at all compared to when my husband and I went through this. We filed in May of 2009 and didn't get an approval until September of 2009 and waited until November for the interview. It has been 3 months and you are half way there. Just be patient. I know that is easier said than done but it will all work out...

  2. The person that was referenced earlier who's AOS was denied due to a return ticket was my husband. USCIS claimed that he left the country on the return ticket date and he did not. After meeting with our congressman's office and getting his case re-opened and then providing a phone book of evidence which was very difficult to obtain, we finally got his green card 2 weeks ago. It took 2 and a half months to get it worked out. I will say...had I known that we were going to have to go through all of this just because we bought a round trip ticket, we would have either cancelled the return ticket or bought a one way ticket and paid the extra money. Our case was a rare one. This normally doesn't happen but it did and it was a horrible experience. Had we not had the help that we did, I am not sure what we would have done.

  3. The unfortunate thing in this whole situation is that it is your word against USCIS. My husband has never left the country...NOT for 1 day but now it is our job to prove that and with that comes more time and more money that was not our mistake to begin with. We have done everything that they have asked us to do to the point that David never even came to visit while the K-1 was in process just to not complicate things. I have spoken to our Congressman's office. There is nothing that they can do. I was told that the only way to get anything done with USCIS is to file paperwork and pay fees.

  4. His Biometrics appointment was on March 17th and he supposedly left on February 24th. I have contacted the airlines and they verbally verified over the phone that his ticket was never used but getting it in writing, that is another story. I have a contact at our Congressman's office that I had spoke to before we got the letter who was trying to find out why it was denied who I will be calling in the morning. We also called passport control in Chicago where he supposedly flew out of and they said that if we can get a government official to call and give them David's passport number, they can verify that he did not come through there on that day. I am going to see if my contact from the Congressman's office can call or will call...who knows? I never dreamed after all we have been through and thinking we had done everything right we would be dealing with something like this. At the end of the day, we are honest and know that. We just have to prove it to the right person and hope they believe us. I'm sort of understanding a little bit of what it must feel like to be charged with a crime and having to prove your wear abouts.

  5. I had posted last week that my husband had gotten a denial on his AOS. We were not sure why.We had only received the email notification and not the official letter. Well, we got a letter today. When David moved here and came over on his K-1, he bought a round trip ticket as a lot of people have done on VJ. He flew here on the 31st of December and the return flight was for February 24th. Of course, he did not fly on the 24th of February. We had just bought it as a round trip ticket to save money as many VJ members have. Well....the letter states that he was denied because he left the country on the 24th of February without having advanced parole when if fact he has not left the U.S. since he arrived here.

  6. My husband and I filed his AOS back in February and we received a receipt that the file had been transferred to California, March 5th. This past week, I got a notification via email from USCIS stating that the case had been denied. We have not received a letter yet but the our Congressman's office is in the process of inquiring why the case was denied. In the meantime, we have gone back through the paperwork and I realized this morning that I marked the wrong box on the I-864 on pages 1 and 3. Very stupid mistake but a mistake none the less. This is the only thing that we have found that could be the reason for the denial. Does anyone know if this would be a reason for a denial or would you be sent an RFE? I have done some research and it looks like we might have to file all over again and pay the fees all over again. I never realized marking the wrong box would end up being a 2,000 dollar mistake. If anyone has any experience or insight, I would much appreciate it.

  7. Well, it looks like we are not out of the woods yet. I called our congressman's office today and spoke with the immigration representative. I wanted him to contact USCIS and verify that David's file had not been denied because we had gotten so much incorrect information yesterday. The rep called his contact at USCIS and his contact verified that he had been denied and a letter was sent to us yesterday from California. His contact could not see a reason and said that if it had been for an RFE it would show on his computer screen. He then proceeded to contact the immigration officer who decisioned the file directly to try and find out why. Once he does find out, he is going to contact the rep from the congressman's office who will then contact me. In the meantime, we may get a letter. We have been so upset because we cannot figure out why. We have done everything that we were asked to do and in the time frame requested. At this point there is nothing that we can do except wait.

  8. Hey, this is the "D" of GMJDMJ, with some helpful advice for people who have this situation.

    If you call USCIS and ask "Why has my application been denied" they will go on autopilot and simply repeat the mantra "You must wait for the letter to arrive. If it does not arrive within 15 days call us" at you until you hang up in frustration. You have to realize that these people have a script for everything from their greeting to their goodbye, they have memorized the script, and they're going to stick to the script.

    Don't tell them you've been denied - this will invoke the mantra instantaneously. Ask them for the last activity on the case, ask them if there were any RFEs sent out, ask them anything reasonable that they can't give a stock answer to. I spoke to SIX people who all gave me "the mantra" when I asked why I'd been denied. My lovely, charming, and above all SMART wife called again after my six failed attempts and asked questions which made them actually LOOK at their screen to get the answers. This SEVENTH person actually looked up the case and said "hey, you haven't been denied, there's been no decision on this case yet! Must be a notification error!".

    My point is that in order to get anything done, you have to get them to break from the script. The script will give you absolutely nothing, but the person reciting the script has the ability to help if only you can politely, respectfully, and calmly get through to them.

  9. Sorry that would probably be helpful if I had that information. We filed the AOS on Feb 22nd, got notification on March 5th, got a letter stating that it had been transferred to CSC. We have not moved from the address and have received everything in the mail that we were supposed to. I did finally get through to an immigration officer tonight at USCIS and after asking questions, finally was told that the email that we have been sent was a mistake (she couldn't tell my why) and that his file had not been decisioned. She said that in the system it did not show that it had been denied. You would like to think that the notifications are correct but I guess sometimes they aren't.

The same exact thing happened to us. 2 different dates (April 27th and then again May 11th) stating that a new card had been ordered and a third date (May 18th) stating that it had been approved. I finally called and got an immigration officer on the phone yesterday at USCIS and was told that the actual card was mailed on the date when we got the approval notice which was May 18th. We will see if it comes in the mail in the next couple of days...

  11. The civil surgeon is going to want to see her proof of vaccinations. If she does not have that, then the civil surgeon will require her to have the vaccinations again. The form that you take to the civil surgeon that he or she is to sign states that they have reviewed her vaccination sheet from her home country and that she is good to go. Once they will out the form, they seal it in an envelope and you are to send that with you AOS paperwork. If you do not have that form, USCIS will RFE you for it. Fortunately, we had my husband's vaccination sheet but I had to call about 15 doctors before I found one that didn't want to do the entire medical exam all over again. With the K-1, the medical exam that she took in her home country, is good for a year.

  12. My fiance already here in USA, California now finally after 1 year waiting in Amman, Jordan, I have a couple question I will appreciate if you help me.

    1. My fiance and I still looking for a job, we have money to get married only but not to apply for green card, Is it mandatory to apply in this 3 months period or ok to postponed? It is not mandatory but would be wise to apply before the 90 days. After waiting so long to be together, why risk it?

    2. Can my fiance apply for driving license before we get married? His drivers license will only be good until his visa expires. He will have to have an EAD to get a drivers license after that and will also have to have an EAD to get employment which he cannot get until after you are married. It is illegal for him to work without an EAD

  13. We got a notification for my husband that "a new card had been ordered" for the EAD on the USCIS website and please allow 30 days to receive it. Does that mean it has been approved and is on its way? He came here on a K-1 on December 31st, married on January 23rd and filed February 15th and we are still waiting. We have received the Advanced Parole but not the EAD.

  14. I would go ahead and get a co-sponsor in place that can provide proof of current employment. They would fill out the same form and provide the same documents that you would. The one thing you don't want to happen is him get to the interview and approve pending the I-134 and then you all have to wait even longer for them to receive the information to approve the visa. It is better to be safe than sorry.

  15. Congrats to everyone with their recent approvals! I haven't been on in a while...computer issues, preparing for David's arrival in 3 days, planning a wedding and working 60 hour weeks, I haven't been able to get on but I wanted to say...congrats and I hope that everyone is together again soon!!!! 3 more days for us! Almost 7 months to the date when we saw each other last....I can't wait!!!!!

  16. After 7 months of waiting to be together and having gone through this process like everyone on here...David was and hopefully will arrive on the 31st of Dec on BA. He called me this morning to tell me about the strike and I was so upset and still am. I cannot believe that once again we are having to wait on someone else to decide our fate and still don't know when this issue will be resolved. Right now, our choice is to wait it out or book another flight and loose the money which we really can't afford to do. I called BA tonight and waited for 45 minutes to speak to someone and they are not even sure if the strike will happen but said that in the next couple of days, it will be resolved. They did say that they could push his flight back to the 4th of January, of course that is the day we are to meet with the minister about the wedding. My concern like everyone else is that if we do wait it out and don't try to book another ticket then when they do decide to cancel the flight, there won't be any available. I have planned a welcome home party for him on the 2nd along with other appointments in reference to our wedding and having to push his flight date book would ruin all of that. I was told not to plan anything until the visa was in his hand and I didn't and now...I am not sure that I can still plan anything...I never dreamed that after all of this, we would have to deal with an airline strike as well... I just hope that get this ####### resolved soon so that we can all go back to planning our futures instead of once again waiting on someone else to tell us when we can.

  17. So I have just phoned the NVC and they tell me that they sent everything over to the London Consulate on the 17th Novemeber, any idea how long I have to wait to get confrimation of this? Or if I should call the embassy themselves? I keep getting the automated number as no one will put me through to speak to someone. any suggestions?

    Now it is all about calling the DOS.

    The number is 202 . 663 . 1225. Press 1 then 0.

    Make sure you have your new number that begins with LND and they will ask you for the beneficiaries name.

    Many thanks for that! I will call them later. However I don't have the new number that starts LND? where would i obtain that?

    The NVC assigns the new case numbers. Contact them for the new case number starting with LND. You will use that through the rest of the process
