I am adding my mother as a co-sponsor just in case. There are example forms of how I am to answer questions 10 and 11 but I am not sure how she is to answer those questions. Question 10 is I have submitted a visa petition to U.S. Citizenship and Immigration Services on Behalf of the following persons. My mother did not file the petition, I did. and Question 11 I intend or not intend to make specific contributions...my answer is to be N/A (K-1 visa process for permanant resident) is her response to be the same? If anyone knows, I would greatly appreciate some clarification.

Thank you for your response. Is your income calculated on your gross income or on your take home pay (with taxes taken out)? Typically, a person will have a paystub that breaks all of that down but I will not have that. My employer is an individual so my paychecks come from their personal account every week. I have a salary chart that we use to figure my check amount every week...ie, if I work 30 hours, the chart shows what my paycheck should be with the taxes and social security taken out of it, it also shows what the gross would be before the taxes are taken out of the check. What I can provide are copies of the checks that have been issued to me and a copy of the salary chart. Because I am hourly, my checks vary from week to week. How many check copies do I need to provide? How many months worth? I and my employer are willing to provide whatever they need, I am just not sure without knowing how they calculate income how to provide what is necessary. Any advise would be much appreciated....

I have a specific question in reference to the I-134 and I have not seen it addressed on this website. I work for an individual as a personal assistant, not a company. I also am paid hourly, not salary. I have a guranteed minimum number of hours every week but on average, I work more. My employer has their own letter head that the letter will be printed on and will be notarized. Also, my paychecks have taxes and social security taken out every week. My checks are written to me weekly out of their personal account. The letter states that I have a guranteed minimum number of hours, with what the average amount I actually work and at an hourly rate what my gross income would come out to be and that I am in good standing. There is also a salary chart that is provided by their accountant that shows from 1 to 40 hours at my hourly rate what my paycheck will be. The accountant is also providing me with copies of the last 2 months of cancelled checks. Is there anything else that I need to provide? Is there anything else that needs to be stated in the letter. What other proof do I need to provide. I have not worked for them for a year yet so I do not have a w-2 and my fiance's interview will be before the end of the year. I am also planning to provide 3 years tax returns. I am able to get 2006 and 2007 but I just files 2008 and the irs will not be able to provide a transcript to me for several weeks so I was going to send him the actual return just for 2008. The last 3 years prior I did work for companies and made a significant amount more. I do qualify with the job I have now but barely. I have added my mother as a co-sponsor just in case because I want to cover all of my bases. Any advise would be greatly appreciated. Thank you!

My fiance and I received email notification that our NOA2 was approved on 09/23/2009. The NVC received it on 09/25/2009. The file has not been sent to the embassy as of yet but from advise taken from VJ, I wanted to get my documents together that I will be sending to my fiance. I do earn barely over the poverty line and because of that I was going to add my mother as a co-sponsor just to cover our basis and help to make our case look stronger. From what I have seen, we are looking at the minimum of 60 days, not including additional delays. My concern is if I go ahead and request a letter from my employer, paystubs, etc...and the letter from my bank that the documents will be dated to early. Is that an issue? Should I wait to request these documents after we know that the embassy has received our file, or after he has received package 4? If someone has any advise, I would greatly appreciate it. Also, if I do meet the requirements for the I-134 but barely does it matter either way if I have a co-sponsor? I figured it couldn't hurt but I wanted to make sure....

You had said the number is in the other topic. Which one would that be? I went back through the link that you posted and couldn't find it. Is there any example of what the letter should say? Thank you for the information. I really appreciate it. Do you have a fax number? What did the letter that you sent say? I feel so defeated at this point. Just getting through USCIS on the front end is enough and I feel like we just started this process all over again. Do you think it would help to contact my Congressman's office? I want to do something but at the same time, I don't want to cause problems either. Do you know if this will cause problems at the embassy or is this just with the DOS/NVS? Thanks again for your help. It is much appreciated.

Does this happen to everyone or are the files picked at random? Is there a particular day I should call during the week? Can I contact my congressman or is there anything that I can do?

After 4 months, my fiance finally got our NOA2 which of course for everyone is exciting and we were thrilled to receive the news. I called the NVC today to find out if they had received our file and was told that they had received it but it had been sent to AP and could not give me a timeframe when our file would be sent to the London Embassy. I then called the Department of State to verify this and it was confirmed. I asked the operator what AP was and was told that this is normal procedure and that the file has to be processed in order to send it to the embassy. I have read nightmare stories here on VJ of people waiting sometimes 6 months before their file is sent to the embassy and that this is not something that happens to everyone. The forums that I have been reading date back to 2007 and 2008 and I wanted to see if anyone else has experienced this recently, or knows any information about what my fiance and I can expect. Is there anything that we can do? Are there more and more files being pulled? Any information that anyone has would be greatly appreciated....

My fiance is in the UK as well and we have been apart since May and will continue to be apart until this process is over which will most definately be next year sometime. There is no quick way of doing anything when dealing with immigration in the United States. If you guys are already there, together and are planning to get married there, then why don't you just stay there? It is A LOT easier to get your visa extended and to stay in the UK. You could marry and be together and then apply to bring him over here with a K-3 visa. You could apply for that right after you are married and would not have to be apart for very long. I can tell you from experience because I live it everyday that being apart from the person you love for months on end...well it plan and simple sucks. I would not put my future with the love of my life on a company. With the economy the way it is now, I can't imagine them paying the insane amount of money that it would cost for them to get him to the US. They might...but there are no guarantees. You are not in as bad of a situation as a lot of people...atleast you guys are together. If it were me, I wouldn't wait until August of next year to marry if you are wanting to live with him in the US. I would get married in the next few months, apply for the K-3 and move on from there. The process for a k-3 is the same time frame as a k-1. Right now, the USCIS is working on applications that were filed on 12-30-08, so it is taking at the minimum 6 months to process them, if not longer. If you wait until next August to get married and then add 6 to 8 months to that...you are looking at a long time. At the end of the day, you guys want to be together and right now you are...so I would take my future in my own hands to insure that everything is done the right way and not put any of my future on the company that he works for or better yet, risk that the USCIS sees that you guys have intent of marrying as well and then you are left with a mass amount of attorney bills, possible deportation for him and issues that you will try to overcome for a lot longer than 8 months. Unfortunately, when 2 people are marrying from different countries and one happens to be from the US, you can't always plan everything the way that a normal couple would. I know that you want to be able to plan the perfect wedding, for him to be able to work right away and start your life together here in the US but the way immigration is set up, that can sometimes be impossible. I get asked all of the time "when is your wedding going to be? and I have to always respond with "I don't know". At this point, I don't care about the wedding date, I care about when I can finally be with the love of my life. There are options for you...I would be VERY careful with which one you choose because it is your future...

My fiance and I mailed the package for the K-1 visa while he was visiting on a visa waiver. He has returned to the UK. I wanted to make sure that is not going to cause problems for us in the approval process. Does anyone know?

My fiance and I wanted his parents and sister to attend our wedding in the US once we have approval. They live in the UK. Can they come on a visa waiver if they are only staying for a week or do the HAVE to get a tourist visa in order to attend the wedding? If they have to get a tourist visa, how early on can they apply for it? We don't even have our approval yet but I wanted to let them know what they will have to do if they in-fact have to get a tourist visa. If someone knows the steps we have to take to make this happen or where I can find this information, if you can let me know, I would greatly appreciate it.

My fiance and I have already filed our K-1 and are awaiting the NOA - 2. I wanted to go ahead and start getting everything together for the package that I will have to send him. I make enough to cover the requirements for the I-134 Affidavid of Support but barely. I wanted to add my mother as a co-sponsor so that we are more than covered. There is a section on the form that asks the relationship to the person that you are sponsoring. For my mother, do I put "future mother-in-law", friend? I am not sure. Does anyone know??

My fiance and I mailed our package to the Vermont Service Center this past Friday. He then went back to England yesterday and I am beyond sad...Being seperated again! At least we are on the road to being able to be together...My heart goes out to all of you that are seperated from your significant other...I am very thankful for this website. It has been a life saver for us. Good luck to all of you!

This is probably something that differs from country to country... But, i was adopted as well and i haven't had any issues getting documentation of my birth. However, when the adoption went through the government re-issued me a certificate with the names of my adoptive parents on it. When i went to apply for the long-form birth certificate last month, they issued it in my new name with my proper parental information. According to the packet 3 i recieved they are looking for both certification of birth and any applicable adoption certificates. So, i would contact what ever department is in charge of birth documentation to make sure you can't get one...

My fiance and I have gotten conflicting information. He was adopted and has adoption papers, not a birth certificate. We read that the USCIS would want a copy of his birth certificate or a certified letter stating that it does not exist. Is there anyone who's fiance has been adopted and were the adoption papers acceptable to the USCIS?

My fiance and I are getting ready to start the process for the K-1 and I am trying to be prepared for the steps after that. I work for an individual out of their home and they pay me directly. I do not have "normal" company paychecks and the employment letter is not going to be on company letter head....Does anyone know how I need to document this? I can provide bank statements of checks deposited and my employer is more than willing to provide a letter to show my continued employment. Is that going to be enough....Does anyone know? Would it be better to have a co-sponsor just in case? and if I do...does the co-sponsor have to be on the initial I-129f?
Not enough information. If you worked there in 2008 and received a 1099 or W2 form, that will document 2008 income. If you are working "under the table" you'll need to crawl out from under the table. Legal income can be documented and taxes are filed on it.
I am not getting paid under the table. I am basically self employed and responsible for paying taxes on the money as if I am self employed. I am just not sure how to do that. I have always worked for corporations but I was laid off at the end of 2008 and had to find something in order to pay my bills. 2008 taxes are not due yet. I am just trying to plan ahead and didn't know if anyone may have some suggestions. I just want to make sure that I have everything that I need for this process. I have a w-2 for 2008 but I am no longer in that job.

Our file has been sent to the London Embassy but DOS cannot confirm that it has been received. Do we need to wait for David to schedule the medical or send in the paperwork from packet 3 before we know that it is there? My main concern is that he goes to the medical and they send the results to the Embassy and our file hasn't been entered into the system yet. Should that be a concern? Also, I have noticed that people can track the package but they will not give me a tracking number. How long does it typically take for the package to show that it has been received by the Embassy? Any advise would be greatly appreciated. Thank you!
