Thank you for the advice. I have to do some research. A friend of mine has her Niece from Haiti here in the states and she is attending public High school. I have to find out more about how she made this happen. I also know of adoptions happening with living parents consent but need to find out more about that as well. Ugh!

My Husband and I are considering bringing his 5 year old Niece to the states to live with us and study. We are waiting for the removal of conditions right now and hope to hear in the next few months. We have talked about the inviting her into our family and we both want to do this. Has any one gone through this process?...or something similar?

We are going to Nicaragua in April. The NOA1 says that we have a one year extension...if I remember correctly. I hope things are moving by then or that traveling with the NOA1 will be enough.

Can't hurt to try! So frustrating though, as we booked flights to visit Honduras next month, thinking all this would be straightened out by then. It's always hard enough to get back into the states without an expired green card/extension letter, so I'm expecting even more fun this time...

Hello! Happy to find this thread. We filed May 27th and haven't had a touch since 6/7/11. Getting worried but as usual VJ provides the needed support. Good Luck to all.

your permenant residence the date it expires you count back 90 days, thats when you can file the 1-751 to remove conditions, but NOT before or it will be sent back to you, some time people get a reminder notice,some don't, i notice your timeline march 26 2009 your two years is almost up you need to get moving don't be late,

Is it 90 days back from marriage or green card? We were married in March but he got his green card in August.

Your only choice is to remove conditions. Read through the guide here on VJ for information. You can apply no earlier than 90 days prior to the expiration of thwe green card.

My Husband and I came into to the states from Nicaragua on March 26th 2009. I have to check the exact date but I know he received his two year green card sometime in August that year. I think our next options are to apply for a 10 green card or he can become a naturalized citizen. Just starting my research so I'm looking for advice or feedback about what most people choose to do for the next step. VJ has helped us so much through our process. First off a spouse is not a "dependent" for tax purposes. That term is for your children mostly, and others in a few circumstances like elderly parents.

You can file "married filing jointly" with your spouse for any tax year in which you were married, even if it was only the last week of the year. The spouse does not have to be employed or have a greencard yet. Since you were married in 2009, your filing choices were "married filing separately" or "married filing jointly". You would most likely have gotten a better tax break by filing jointly. That means if you got a refund, it would have been more or if you owed money to the IRS, it would have been less or a refund. You can change your 2009 return by filing the form 1040X. You can file jointly for 2010. It will also look good to the officer reviewing his removal of conditions to see you co-mingled your finances by filing jointly.

Last year we filed as Married. Does that mean I claimed him as a dependent? Taxes make my head spin. I think I can claim him as dependent as well as file as married. I need to look into it a little more.

We traveled to Ohio under the same circumstances and had no problems. We had all the paper work on us just in case. Your husband should just show his passport and be fine. Good Luck!

We have been married for almost two years now. Time is flying!! With all the adjustments one is the financial issues. My husband was able to find a job when we moved to NYC but makes below the poverty level. He pays taxes and works full time. He has his two year green card and we will be doing the next round of paper work this summer. Last year I did not claim him as a dependent but I'm wondering if I can or should claim him this year and if I should adjust last years. I'm wondering what other people are doing regarding their new spouses in america?

So it seems that True Blood is delivering this season. The violence and gore was off the charts last episode. I kinda miss the passion and I'm hoping for some Sookie-Eric action. The next episode looks to be pretty good. The Queen looks like she is going to get it and maybe they will tell a little more about Sookie's powers. I love it when she blast people with the white light...I hope she uses it on Lorena.

I just came back from Japan 3 weeks ago, on business. It was my first trip out of the US since getting my GC (K-1 visa). I was a little sad that I had to give back my I-94 from the K-1 entry [i didn't have an AOS interview, so they didn't take it then.]

Reentering the US, my Canadian passport and GC were all that was required. I went through the "Citizens and Residents" line. The CBP officer looked at both, expressed some interest in my K-1 visa, stamped my passport with a normal entry stamp and wrote "ARC" on the line in the stamp (which I'm led to believe stands for "Alien Registration Card"), said "good luck" and "welcome back" which was nice , and let me through. Easy peasy. A coworker of mine, on the same trip, who is a US green card holder from Albania, had to have his picture and fingerprints taken, but that's just on a machine right there in the booth - no secondary inspection necessary.

Getting back in with a green card wa the easiest encounter with US Customs and Immigration I've ever had in my entire adult life, including my K-1 entry!

That sounds like a nice experience and a breeze. We did not have an interview for AOS either since we were transfered to CA. So they took your K-1 visa at entry...interesting. It's funny how the little things represent the mile stones. I don't want to give up ours either. Thank you for putting my worries at ease.

And to the OP: yes, he needs his Nicaraguan passport and green card with him, no need for anything else. He is now eligible to go in the same line as you, as it is for both citizens and permanent residents. Have a wonderful trip -- and RELAX!

I say be prepared for any type of question. Stand your ground. Our experience was positive but there was a women at the Nicaraguan Embassy that asked my husband and I a few personal and somewhat judgmental questions. For example: Why didn't you all in love with a girl in your community? How did you guys communicate?...once she saw all my flight tickets she changed her tune. Evidence is key. We have an age difference which may have been why she was so intense about her questions. My husband was a little shocked but handled her rudeness. Good Luck!

My Husband and I are heading back to Nicaragua on the 10th of August and returning on the 20th. I'm assuming that his GC and Nicaraguan passport is all he will need for immigration clearance. If anyone has any recent experience I would love to hear it. We have a direct flight from Newark NJ to Nicaragua. When we return we go through Atlanta which was also our POE. My husband is about one year into his 2 year GC.

My questions are what documents should we have with us and when we come through Atlanta and which line should my husband wait in? Can he get in the citizen line with me? Thank you in advance for any feedback. Having a few pre-trip jitters.
