on a few of the other forums i see, although much older posts....telephonic nikah will give you a nikah nama so you probably need to tell that you did a telephone nikah...just get the nikah nama, then get an English translated version, that would simply state you guys are married.
you are good to go, until the interview where they ummm....might ask for pictures of the wedding. But hey, we worry about it then, right!

I found a couple of good sites check them out.
So nikah on the phone would be considered as proxy marriage which in most US states is considered as common law marriage, however Montana recognizes it!
So here it goes....check them out and see if it helps and what you may do...you can call the office in the last link and see if you file for immigration, will it work or not?

They told me that there had been 'some action' about 3 months before it finished.. in that case they had asked the embassy for additional documents on my fiance (officially an 'update' to the case). But our case was longer than usual. I hope yours is much faster, inshallah!

My hubby picked up his visa/passport today.He got a call to submit his passport on the 6th after 1 month n 12 days of AP...Good luck to all u you who are still waiting to hear the gud news....inshallah its coming soon....Good luck to all....

Sorry for adding on posts, but things keep popping in my mind....
The requirement is for you to be married...whether a temple, mosque, courtroom, phone....it beats them.
However, you can't 'tell' them you are married you have to submit a black and white document....so have these molana's do SOMETHING for you!

A really old family friend of mine married a USC over the phone as she was not able to travel to the US without the visa and her parents obviously would not allow her to go till the ruksathi...
I am not sure the exact process but I remember they did the nikah over the phone and once her visa was issued she left for US. This was in Kuwait. and her hubby was living in NY.
So its gotta work!

Well as long as you can get something on paper I dont see why not.
Like all we had is our nikah in Pakistan....maybe the islamic center in montana and mosque in perviz's city can work together, maybe sign the nikahnama there and send it to you guys so sign here....then you can just file the i-130.

Sara, sorry to see that all the efforts you are putting in result in nothing but making you tired!
If montana recognizes nikah over the phone...go for it! Immigration will not even understand the nikah over the phone process however, see if perviz or yourself can get a document once you do the nikah over the phone and then just file the I-130. After that you are married...so so be it. Call one of the islamic centers in montana and ask if they can issue you a certificate or something? Or if perviz can get one and send it to you.
Then screw USCIS over!
* for those who don't understand 'nikah over the phone'...nikah is 'marriage' in Islamic terms. Islam recognizes a marriage as long as there are two witnesses on the grooms end and two on the brieds. Thus you are able to do the 'marriage' over the phone Islamically. There will be a priest (Muslim priest) and over the speaker phone with the witnesses on each end a couple can get married.*
So, Sara, once you can do that over the phone, you are married and should be able to get something in writing!

Abitenez - a friend of mine had her case completed at the end of July and her hubbys interview is sept 30....
so immigration = anything is possible!
Sibtain - WOW thats a lot of money considering most don't have to pay that much its unfair for you! But alas its done and now you guys reunite. congrats and best of luck!

Hmmmm...truly does depress you waitingforapproval....I call them every monday and thursday! I think I would kill someone if i called every day. Anyway....I agree with ATK...what about when your hubby gets there would you be able to answer the calls? hmmmm....yeah!

Sara - You need to quit with USCIS, as in not withdraw the petition however, stop breaking your head with them and start calling the media. have someone listen to you and speak up for you! I know you are a muslim, but when in Rome do what the Romans do...go to a church...ask them to help you. You need to be HEARD not read!!!
I also noticed you said you will be off your parents medical insurance....how about getting a part time job? that will help with your insurance, some pocket money as well as you might come across someone who can pull some strings somewhere!!!
If oregon doesn't do it for you.. How about you and your mom go somewhere else! Drive down to a neighboring state...get a job...get senators from that state involved! Tell them how your life has deteriorated with all that has happened to you. Maybe if Oregon would not recognize a nikah over the phone, try a different state. I know Illinois does.

Sara, GOD BLESS! Really sorry to hear about this, but I am sure you don't want any sympathies from anyone! I really hope things work out, however my 6th sense says you should just drop this battle. If they made you wait for 2+ years just for an approval on the case, you don't know how long you will have to wait at each stage further down the road.
I am not sure what medical reasons you have for not being able to travel yet, however with all the stress you must be going through its really difficult to heal. And probably is effecting your health and wellbeing overall as well.
Did they ever tell you what this special unit is and if you can contact them? Are you dealing with CSC? Maybe all of us who support you ought to start emailing them on your behalf, though I wonder if that might ruin something for you!!
You should write an article in the newspaper....have people speak up for you. If they have not been able to find anything on perviz for 2 years, what are they trying to dig out at this point!?!?
Our prayers are with you, however if there is anything we can do....pls let us know!

well that will be only questioned at the interview....and hopefully by then you might be able to travel to india, to meet up with him?
Surely if you can file the I-130 with the certificate and get your approval and things start working out, your health will surely improve and with all prayers you might be able to travel.
