  1. Thank you...

Should I send in my moneygram receipt even if it doesn't state why he sent me the money? Will this make them suspicious that he's just paying me for this procedure or something.....

I would not state that your husband sent you the money, no need to get them worked up. You could fund the sources from your savings, or family support, or any other means. If the questions arises maybe at the interview, which i highly doubt, then you can clarify with the moneygram receipt, till then don't worry about it

  2. For any of you NVC vets who may have experienced something like this....

My wife's I-129F and I-130 was approved just before Xmas.

She is Belarussian, which means she has 2 potential embassies to deal with for the exit interview. Minsk for the K3 (non-immigrant), Warsaw for the IR-1 (immigrant).

We're going K3. We have our reasons for going this route, which I won't spell out here, but a lot of it has to do with her logistics.

USCIS got the info to NVC on January 5. Checked with NVC later that week, they said the 129-F packet was sent to Minsk on Jan 6. Then, I get two identical letters from NVC over the next week, one dated 1/7, and one dated 1/13, saying the info would be sent to Minsk within a week. I called NVC to ask about these, but again, they said it had been sent on 1/6.

Been calling the Minsk embassy since 1/6, up to and including today (1/23), they say they have nothing. Every time I tell NVC that, they say the same thing. They sent on 1/6.

From a tip provided by another VJ'er, I checked DHL's website for the packages sent from NVC since 1/6, up to today. Over 700 packages, sent to all embassies around the world, including some close to Belarus (Warsaw, Moscow, Kiev), but not a single one to Minsk. I decided to call DHL and speak to a rep, he confirmed this. Nothing to Minsk sent from NVC.

So, I call NVC back today, tell them Minsk still has nothing, and DHL says nothing has been sent. My suspicion is they may have mistakenly sent this to Warsaw. I tell the agent that. She was terse, and told me, no, it was sent to Minsk, on January 6, you just have to be patient. I ask her, wouldn't it be unusual for a DHL package to take 17 days to get to Minsk, especially when DHL shows no record of a transmittal, not even one that is in transit. She said there is no way I could get that info from DHL. I told her that I most certainly did get the info, from two sources - their website, and a DHL agent. She said to continue to be patient, and if it didn't get there by the end of the month, to call back.

I think this is BS, and it has me concerned, because there is obviously a time-ticker on the I-129F and I-130 approvals. I'm thinking about calling my congressman's office to see if I can get them to look into this.

Any thoughts? I would really appreciate the perspective of those who have experienced something similar.

    Thanks.

    CJ-G

I totally understand your frustration. I have been in a very similar situation, only with USCIS not NVC. They approved our petition Sept 3 2008 and said it has been mailed to NVC asme day. However in January, (this month) when i contacted my senator she inquired for me and found out the case was never sent and for four+ months i was under the impression it has been sent. they were doing some addtional background checks and stuff due to which they approved it but never sent it.

Your best best at this point is contacting your senator or congressman...it usually helps, if CR1 is the most suitable route for you, fight for it!!!

  3. We're still waiting as well.

    Hi cdneh,

This really sucks.... just when we thought we were so close.... we get stuck for AP!! I try so hard not to think about it or worry too much... the truth is, had I not found this site, I would never think twice that our case was unusual, only because I see other K1 filers fly thru NVC in a couple of days did I think why was ours taking so long.... however, I am greatful for everyone's support here and everything I've learned just from other peoples experiences... I guess the only thing we can do is WAIT.....

Have you tried contacting your congressman/senator for assistance?

  4. USCIS says its been sent - NVC says they haven't received anything

We recieved the NOA2 notice on Dec 19th of 2008. It's now the 19th of January and NVC still has no record.

I've talked to operators at NVC who have checked for my case number (I didn't just rely on the automated voice system) but they say they have nothing from USCIS yet. NVC suggested I call USICS.

I called USCIS and they confirmed the NOA2 and said it has been sent to NVC. The woman at USCIS said it can take 60-90 days to deliver to NVC. I said "60 days!?" and reminded her that we only have 4 month of validity for the NOA2. She put me on hold to check with her supervisor then said not to worry if it takes that long I can get extension, but that it is very unusual for that to happen. She was polite and friendly but her actual answers were not reassuring.

I searched this site looking for similar cases but have read conflicting reports and am worried but trying not to panic. I am worried it is lost somehow either in an "inbox" at NVC or an "outbox" at USCIS.

    Advice please

    ___________

    filed 129F > 7/31/08

    received NOA1 > 8/4/08

    recieved NOA2 > 12/19/08

    ....waiting

  5. I was in the same boat as yourself, if you notice my posts...

I actually waited for the whole 90 days for NVC to get my docs, but they still did not have anything and both entities gave me the run around saying we sent it and thats where we are done with the process and NVC said we can't answer any questions about something we don't have.

So your best option is what i did 90 days later, which is, write to your local congressman/senator. Their inquiry usually speeds things up faster.

My senator said on the 12th that USCIS still has my stuff for additional background checks. And then another on the 15th which said they are done with the background checks and have sent it to the NVC, i wish i had done this sooner rather than waiting for 90 days.

you better get to it now...

    Best of luck

  6. I filed for my husband while living with him from Pakistan, only difference is since I could not file DCF i simply mailed out the package from here to US and used my parents address as my permanent address there. So all the mail goes to my home address in Chicago, even though I put my present address as Pakistan and permanent as USA the USCIS people still believe I am in USA everytime i call, so these things don't really matter until you are at the interview and asked where your spouse is or was...

  7. Hello All!

Our I-130 petition has been approved 4 months ago and the approval letter stated that it would take NVC 90 days to receive the papers. However 4 months later once NVC still has not recieved the papers I contacted my state senator and I have been told that the USCIS never forwarded the documents to NVC instead they have held it up for further background checks.

Has anyone else experienced the same situation?

If so what is the hold up yet???

  8. hello everyone, i read online that uscis will have completed all background name checks that are pending for more than 6 months by february 2009, is this true? did anyone else read anything about this?, my petiton is still pending from last year, and according to uscis , my petiton is pending background checks.

    where did you read this??

  9. Hello all!

As you can see per my timeline the I-130 petition for my husband was approved 4 months ago back on September 4, 2008. So far the documents have not been recieved by NVC yet. I have contacted the sentor for Illinois in regards to the delay with the process and the caseworker responded back to me last night that when she investigated this case, USCIS has told her the case still remains with them as they have already approved the case and are now working on the background checks. She also added that there is no way for anyone to expedite the background checks.

Has anyone else experienced the same?

Also if they are now doing bacground checks, after a whole year since they got the petition and have approved it a year later, what were they doing for one whole year? AND furthermore, on what grounds have they approved the petition???

I fail to understand these people.

    Any insights or similiar experiences???

The basis on which they approved the petition is that you are a US Citizen without an Adam Walsh act conviction, that you and your husband were free to marry when you married and that your marriage is legal as well as there's at least a reasonable chance your marriage is bona fide. Most of the last year, your petition was sitting in a box, shelf or file cabinet waiting its turn for the next step in a multiple step process. A good portion of the sitting time was before the did anything at all besides cash the check, assign a file number and assemble a case file.

New background checks can be ordered at multiple stages of petition adjudication process at pretty much any stage after that up to and including just before and just after the visa interview.

I hope you find the answers helpful, even if you don't like them.

Well I wouldn't lie about liking the answers although I do appreciate your responding to my post.

So now, why would they write in the approval letter, that the case has been sent to the NVC and to give NVC max 90 days to recieve the case, where as they could write we have approved the case and are still working on background checks, wait for next process??

    any insights? :(

  11. i got my noa1 for the fiance visa on 5-12-08 , and have not heard anything...no approval, no RFE nothing..........i have called several times and they sent me a letter saying it could take up to 6 more months before they give me a responce...........anyone else out there waited this long?

Yes. Our NOA was dated Sept 07 and we got approved Sept 08. And still waiting for case to be transfered from USCIS to NVC. Its been 4+ months. I probably would have reached faster if i had walked with the case from destination 1 to 2

  12. OKAY so lets say USCIS has sent the approved I-130 petition and NVC never got it cause it was hypothetically sent to the National Records Center. Whom am I to call to have it rediscovered and what exactly do I say to them??

    Any insights...

Well, its been a while since you were approved. Doubt it was sent to the NRC instead of NVC. I would call USCIS and see what is going on, and maybe even call NVC and inquire there?

Just for grins, why do you think your approved petition was sent to the NRC???

well because USCIS says that they have sent it to NVC and have no further action on it. NVC says they never got it even though its been over 90 days and they can't act on something they dont have.

  13. Hello All,

I filed for my husband (I-130 petition) back in September of 2007. Our case was finally approved one year later on September 3, 2008. I receieved an approval notice for my I 130 as well as I-129F (filed in December 07) and the approval notice stated that the case has been forwarded to the NVC. Upon ever call of mine to NVC they stated they could take anywhere from 2 weeks up to 90 days to get the documents from USCIS. Now after December 3, 2008 that it has been over 90 days NVC still has no records of my case. USCIS states that they have sent it and that I should file an I 824 petition which would cost me $340. Has anyone else experienced the same situation?? Shall I wait or go ahead and file the I 824 cause I have given both parties a hard time and they have left me with this last resort.

  14. Hello,

My I-130 petition was approved on September 3, 1008. And per the approval notice from USCIS the petition was also mailed the same day to the NVC. NVC said they need up to 90 days to receive the package. its now been over 90 days since the package and now they still have not received it. They say call USCIS, USCIS says that they have done their part and to contact NVC. So now, niether of the departments have my petition, and I am not sure who to seek help from.....any suggestions?

  15. My case has been approved by the USCIS on September 3,2008 and my notice states that my cas has been sent to the NVC. NVC states that they may need up to 90 days to get the documents. Its been over 90 days now, and they still say they can't find it. I have spoken to a rep live as well as a supervisor and still no luck. I have sent them an email as well as a copy of my notice but is there any other route i can take? How can they have recieved notices after my date of approval and not yet ours??
