    I need ur help with the N400 Part 9 A question: It says lists ALL children i have regardless of wether they live with us, step kids or missing, etc. etc.

    question; I have 2 kids from a previous marriage and have 1 now with my USC husband

    My hubby has 2 kids from his previous marriage- one living with us with her 3 yr old son and his other daughter lives with his ex in another state.

    Should i put 6 in this question or just 3?

    I Have 2 kids + 1= 3

    Hubby has 2 kids (1 live with us with her 3 yr old son and 1 in another state= 3

    So what shud i put in this part 6 or just my own kids??

  6. i came from Philippines last sept 28th 2011 and we get married dec. 27th 2011 ...but until now we didnt do the change status becoz of finacial problems.my husband told me he will saved up so after 3 months we can do change status.is that acceptable that taking too long for us to do the change status. im desperately bored and homesick sitting here at the house with my daughter everyday cant even apply for work becoz they required for social security number but how i will get social security if we cant do change status.pls help me...i want also to go back to Philippines already. thanks

    You can apply for SSN right after u have ur marriage certificate and u do not have to wait for Adjustment of status. But even with SSN u need to have the EAD or employment authorization to work. U can work with EAD even if u have no AOS yet and get a job to help save up for Adjustment of status.

    In short u go apply for ur SSN and EAD or Employment AUthorization so u can work and help save up for ur Adjustment of status. As long as u got married within the 90 days period u will be okay for now.

    U are not as bored as i was when i first came here coz u have ur daughter with u. I left my 2 kids in the Phils. when i came here for 3 yrs. before they finally came here so do not ever think of going home coz u are bored..u are lucky u have ur child.

    Marriage is not a bed of roses.. be ready for the adjustment period. Ive been there done that and wellbe happily married for 5 yrs now with my hubby and our 3 kids.

  7. thanks for the comment sir, yea I might as well just get my daughters Phil passports and my phil passport done as well, after coming from the embassy today to get them Social Security numbers I went straight to Phil Immigration and it look very unorganized up in that place. I was just worried kasi most of the people here got Phil Passports before Doing CRBA, and i couldn't find any questions on people getting Phil Passports after CRBA

    All u have to do is go to their office and apply. I did my CRBA in 2008 and did not get my son a Phil. Passport while i was there so i regretted it.

    What i did with my 2 other kids was i used a travel agency to get the kid's passports..less hassle all i had to do was give them the requirements and pay.

My daughters were interviewed for CRBA on Jan 12,they recieved their CRBA and passsport on the Jan 30, my question now is it alright if I go ahead and also get them a Phil Passport or should I just get an Exit permit, I dont plan on leaving and going back home any time soon but I just wanna know if getting a phil passport for them is better because I myself am a dual Citizen and i am planning to get myself a phil passport so i was wondering is it better if me and my 2 daughters get our Phil passports at the same time also??

    It would be better if u get it while ur there . It is quicker and easier there than in US.

    1. See my answer at 4 as well. If you do not send them your 2011 return that you file separately, it will not cause a red flag.

    2. Whatever the co-sponsor does is up to them, that is not your responsibility for as far as I know. They made that 'contract' with the government themselves, you just submitted the co-sponsor paper. I don't even have contact with my co-sponsors and they could have moved around the world 4 times and I wouldn't know. I wouldn't be worried about it if I were you :)

    3. No, not at all. As long as he is no burden to the United States, they wouldn't give a darn thing if he works or not. How many people are not at home these days without a job, or simply a stay-at-home mom/dad without income? Again, as long as they are no burden to the US, the US doesn't really mind it. They might ask a question during the interview regarding that but they wont deny him based on that.

    4. No need to send the 2011 now, they cannot request that one until after. If you have not filed it yet, you cannot send it either. This way you would avoid the filing separately part ;) For now, 2008, 2009 and 2010 will suffice.

  10. I will be filing N400 end of Feb and here is what I will be sending in:

    1. Money order for $680

    $595 + $85 biometric fee

    2. Completed, signed and dated N-400 application form

    3. Photocopy of both sides of permanent resident card

    4. Two identical color passport size photographs(name in pen at back)

    5. Copy of hubby's birth certificate

    6. Copy of my birth certificate

    7. Copy of hubby's current passport(inside of front cover and signature page)

    8. Copy of current marriage certificate

    9. Copy of our daughter's birth certificate

    10. Copy of IRS tax transcripts OR tax returns (2009,2010 and 2011)

    11. copy of rental agreement

    12. copy of insurance policies (car and renters)

    this is just for me personally, and whatever I send in I will bring in to the interview UNLESS they specically tell me what to bring in BUT I will still bring in JUST IN CASE, if you know what I mean.

    Now i have mixed questions and i hope this won't bother u. Ive been married for almost 5 yrs now to a US citizen.I am getting ready for my N-400 based on a marriafe to a US citizen.

    I have other posts but i will just do it all in once here (please bear with me).

    Here are my concerns:.

    We filed as married joint in our income tax since 2007(when we got married). Since hubby has been unemployed for almost 3 yrs.now we decided that i will have to file this year which i just did as married filing separately.Reason is he owes child support from his ex. So this time i filed separately but NOT Head of the household.

    1. Would it not cause red flag in my N-400 application?

    I read that ur co-sponsor once she will change her address will also have to file an AR11?(change of address) ? I did not know that and it's been a year since my co sponsor for my kid's I-130 bought her a new house and i did not file the AR11 coz i did not know i have to.

    2. Whos gonna file the AR11?/ IS it me or my sis in law who was our co-sponsor?Am i gona be in trouble for not filing the AR11 for my co -sponsor??

    My husband is out of work since May 2009..would it be a problem if i send in my N-400 application? I am working full time since 2009 so am the only one bringing income in the household.

    3. Would it be a problem with him being unemployed?

    4. So should i send the Tax transcript for 2008, 2009 and 2010 when i do my N 400 or should i include my 2011 as well?

    Please help i am really confused now. Thank u so much.

  12. You only need to send one of each. For example, if you send in a copy of your spouse's passport (the front cover and signature page), you don't need to send the other parts of that question (a, b, c and e). In my personal situation I have send the following:

    1. d

    2. marriage certificate

    3. n/a (never got married before)

    4. a

    Now, many people will argue that it is better to send tax transcripts, I'm not so sure about. The only difference, from what I can see, is that you do not need to find all the other information and send it to them. It makes it easier, but I don't think it matters all that much in the end. If you had to send those transcripts instead of all that other stuff, they would have mentioned them by them self.

    These things are indeed the only things you need to send with the application with, of course, any court evidence and such if you 'ever' have been arrested. But this is all additional to the application and not standard, most people will not have to do that. If there is anything they want but is not considered an RFE, yet still requested, you will have to bring it to the interview from what I understand.

    What about the copy of my green card?

    You can't get any paperwork from them in a timely manner (goes to old address).

    also - it's the law that you need to do this - guess what happens when you break the law?

    It's easy to change your address - and make sure your sponsor does the same (they use a different form)

    Oh no!! let me ask u about this. My sister in law who was our co-sponsor when we filed I-130 for my 2 kids bought a house and has new address now and i did not know that i have to file for change of address for my co-sponsor as well. AM i gonna be in trouble for not doing this?

    What form should i use if i file change of address for my co-sponsor? is she the one who files or me?

  14. Penalties for Failure to Comply

    A willful failure to give written notice to the USCIS of a change of address within 10 days of moving to the new address is a misdemeanor crime. If convicted, you (or parent or legal guardian of an alien under age 14 who is required to give notice) can be fined up to $200 or imprisoned up to 30 days, or both. The alien may also be subject to removal from the United States. (INA § 266(b)). Compliance with the requirement to notify the USCIS of any address changes is also a condition of your stay in the United States. Failure to comply could also jeopardize your ability to obtain a future visa or other immigration benefit.

    It is my friend who moves 3 months ago not me i still live in the same address since i came here in '07. Can she still file for AR 11 now? How would they know if she moved and when she moved?

    are you filing on the basis of marriage to a u.s citizen?

    If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:

    1. Evidence that your spouse has been a U.S. citizen for the last 3 years:

    a. Birth certificate (if your spouse never lost citizenship since birth); or

    b. Certificate of Naturalization; or

    c. Certificate of Citizenship; or

    d. The inside of the front cover and signature page of your spouse’s current U.S. passport; or

    e. Form FS-240, Report of Birth Abroad of a Citizen of the United States of America; and

    2. Your current marriage certificate; and

    3. Proof of termination of all prior marriages of your spouse (divorce decree(s), annulment(s), or death certificate(s)); and

    4. Documents referring to you and your spouse:

    a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or

    b. Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years; or

    c. An IRS tax return transcript for the last 3 years.

    so you're telling me you didn't send in anything regarding point 4?

    So let me ask u this 4 list of documents u gave me are the ones that i have to send with the N-400 application first,,am i right? or they will send me a letter telling me what to bring during the interview??

  16. Sort of correct. LPRs can get food stamps after 5 years. LPR children under age 18 and here less than 5 years can get medicaid and free school lunches. Sponsors CAN be required to pay for this but usually are not.

    The only place you could have trouble is if your husband declared you to be a US citizen on the application form as it specifically asks for each household member and whether that person is a citizen. As long as the forms were completed truthfully, and it sounds as if they were, you have no trouble.

    First of all thank u so much. Now i don't have to worry. No i did not lie in any immigration form. The food stamps were getting was only good for 2 ppl (my USC husband and our 3 yr. old son). Me and my 2 kids who are non citizens were not on the system since we did not qualify. Me and my kids do not have Medicaid even . Again thank u so much

  17. Is getting food stamps any issue as far as immigration is concerned? The only place I have seen that asks about receiving any help from public funds is on I-485 application. However, receiving food stamps is not an issue even when applying for adjustment. Perhaps clear up the food stamp questions - you say only your USC husband and USC child are receiving them (not you and the 2 other kids) - do you just make the food you can get with those stretch between everyone or are you being claimed in any way by him as dependents on the foodstamp application? I don;t really knwo how it all works so that's why I'm asking.

    As several folks have noted, there is nothing asking you whether you've claimed benefits (which you may well not have anyway)so doesn't seem like there's a problem. Assuming you've files your taxes and can shopw the prrof of marriage you require for this 3 yr application, it doesn't seem like you have an issue. There is no affidavit of support involved with the N400.

    sorry guys but am still confused. The food stamp applicant was my USC husband. So even if we tried to apply( me and my 2 non USC kids) the application was only approved for 2 people( my USC husband and 3 yr.old son).

    SO the food stamps were getting is basically for just 2 people and since we are family of course we eat too. Do i need to hire a lawyer when i file my ctizenship??

    I dont think i lied in any immigration forms. They can check that truly my husband has been unemployed for almost 3 yrs. now. He is having a hard time getting a job because of his health.

    SO my question is.YES or NO?? are we in trouble for getting food stamps?

  19. You say the food stamps are in his name. Is he the only one receiving them? You and your kids aren't eligible for them so he should only be receiving enough for one person. As a USC he is entitled to that and it is not an issue.

    If you are all receiving food stamps, the government has the right to come after him to pay them back if they so choose.

    thanks for ur reply. I said the food stamp was on his name coz he is a US citizen and our 3 yr. old son. Me and my other 2 kids are not yet citizen that's why we are not eligible.Yes we all are receiving food stamps but we are not on the system just my husband and our 3 yr. old son who is a citizen. Is this gonna be a problem when i file for my citizenship?

    Just wanna ask and would greatly appreciate ur help.

    I came here on a K1 visa and hubby is still unemployed for almost 3 yrs now. SInce he lost his job we are getting food stamps. I am the only one working since he lost his job.

    Here are my concern:

    1. Since hubby filed the Affidavit of Support for me when we started the K1..are we now in trouble for getting Food stamps? He is unemployed for almost 3 years now and his health is not in great shape .

    2. The food stamp is in my hubby's name and that being said,, are we not in trouble for getting this government benefits though he signed the Affidavit of support for me and my 2 kids the time comes that i will submit my application for citizenship?
