  1. We are trying to bring someone overseas but she is having a problem getting her passport done in DFA. They were asking for 4 different IDs.. I mean this is ridiculous..

    Those who just get her passport done just recently, what is the current requirements to get a new Philippine Passport?

    Hi, I think she only need two valid Id's and she can get a Postal ID (valid for 5 yrs) and NBI clearance or authenticated birth certificate.Postal Id is easy to get.Or if she has a voter's registration that would work too.

    We were just married Nov 19th, 2008. in Wisconsin Can anyone tell me the process to change my wives name? She is from the Philippines and we want to change her middle name to her maiden name and now her last name will be mine. We were married by a court commissioner and told to go to the court house which we did today. The lady there wasnt sure of any answers and told us to go to the SS office.

    Any comments?

    as long as you have your marriage certificate she can use your surname in any legal documents. especially in applying her adjustment of status.

    Right, But the question is about moving her maiden name to her middle name. Its the custom with Filipinos to replace the middle name with the maiden last name. Example:

    Maiden name Jane Doe Smith now she marries Mr. Johnson. So it would be Jane Smith Johnson. Former middle name drops off and the maiden last name of Smith becomes the middle name.

    Its not really an AOS question.

    hello Bucksol,

    what you do is have your wife's passoport ammended so she can bring your name then. All you need is send her passport to your nearest US embassy and file for passport ammendment..thats what i did. Hope i have helped.

    How long is the clearance valid? What are the requirements? fees?

    Getting an exit permit don't take long..If you will do under the table( I did) and it only took me an hour.wag lang masyadong malaki ibigay mo..200 puede na wag ka paloko yan lng bingay ko.Just had it last sept 08 umuwi kc me dyan to give birth from here(Georgia).

    Also u can sign up for a waiver kung d mo dala anak mo to get the exit permit pero you can also pay sa airport na during check in sa immigration.. this way you dont have to go to the BID office and give under the table(d ko kc alam puede pala sa airport na mismo).

    anyway good luck and have a safe trip.Welcome to US of A.

    I forgot to mention the fees its P1,250.00. I suggest sa airport k na lng to avoid under d table thing and hassles.Also you will pay travel tax for u and ur baby sa airport even if your ticket has already tax added to it.

    Well, following issues at home, I've managed to secure a place on campus where I can stay until I head off to the States (fingers crossed). I'll be officially moving out next week, and I will have police assistance. I've been a busy bee =p.

    Now, the USCIS is really confusing about how you go about reporting it, and they're not responding to my emails. It says to file a form AR-11 but it says I need to send it to the US, and it's for people changing address within the US.

    I'm horrendously confused and I need to submit my changes soon. Any help you guys can offer would be appreciated.

    hi knight and maggie,

    you need to report that you changed address within 10 days after you moved coz i did the same. you dont have to send it you can just do it online or call USCIS.

    Am really confused what application i will have to file to bring my kids here in the US? Would it be better if my husband(USC) will file an I-130 petition for my kids being the step parent or I will just go with the I-824?

    I -824 is a following to joint benefit which my kids can follow me here in US after i got my LPR status thru fiancee visa..It says that my kids wont need the I-130 petition from my hubby since they are still eligible for the I -824.

    Am really confused. My questions are:

    1. What is the difference between this two and which is the fastest and surest way to bring my kids here with me??

    2. If i go with the I-824 how long can my kids follow after my k1 petition was approved? is there a certain time frame where my kids need to follow me ?

    I know i asked so many questions..but really wanted to make sure i will do the right thing before i will file the application for my kids. PLSSS..HELPPP! Thanks so much in advance.

Just asking.......my 14 year old son was denied of US passport when i applied for it at the embassy in the philippines. i am a US citizen. my son is a green card holder and currently studying in the philippines. but as i was reading all the posting here, it seems to me that all i need for him to get a US passport is my Certificate of Citizenship. I was told in the embassy that it is not automatic for a child to get a US passport even if one of the parents is a US citizen. Is it best for me to apply for US passport for him in the US? What are the requirements? thanks...

    The requirements are listed above, in NickD's post beginning with "Here is a copy of the N-600 instructions...". One of the requirements is that the child has to reside in the US under the legal and physical custody of the US Citizen parent. If he applied at the consulate in the Phillipines, I can see where this requirement might be in question.

    As far as i Know once you become a US citizen does not mean your child is also automatically a citizen. even if your child has a 10 yr green card does not mean he is a citizen he has to apply for his citizenship like you did.

    It don't take long to get ur child a passport coz i got mine for my new born son whom i gave birth in the Phils.

    You need to send to the embassy your proof of citizenship or how you acquired it and your consent to issue a minor child's Us passport.

  7. Marital property in Georgia is considered joint property, so at a divorce you would have to decide how to divide the property if it was shared during the marriage. If, heaven forbid, one of you passed away, the other has right of survivorship due to the marriage whether the name is on the deed or not. My name is not on our house deed mainly because Georgia is a joint property state and we didn't want to pay extra to get a document that says what is already in effect by law.

Since you were not married to your children's father ,you have sole custody and parental authority of your children and their father need not consent for you to bring them here, thats our Philippine law. However, I did read a post here by another Filipina VJr that because the father of her child signed/acknowledged the same by affixing his signature on the birth certificate although they were not married, the CO who interviewed her asked for the father's consent for the child to travel.

    You might want to check the birth certificates of your children if their father signed the same.If he signed, I suggest that you make a notarized affidavit stating that you have not seen or heard from him for years now and also maybe an Affidavit of Two Disinterested Person stating the same and present them during the interview IN CASE the CO will ask.

    You think i still need his permission? The fathers name appeared in my kids birth certificate but he never signed it as the father. Medyo ginawa namin is pinalabas namin kasal kami (kunwari using under the table )coz he wanted the kids to bring his name but legally we were never married that is why i was approved of my K1.

  9. It's October now and we are closer to 8 mos from filling our 1-130 and still case PENDING. It's so frustrating and depressing that until now we haven't receive our NOA2 yet. Soooo... unfair while we see others filed April, May, June got approved already without expedite. Wonder how Vermont approve everyone's case, I'd like to believe now they approving it at RANDOM not by FIFO -first in first out. And here we are, the waiting continues like eternity. How long can we stay apart from our spouses, ohhh, sick & tired here to just talk in the computer everyday, I hate the waiting....It's about time, VSC PLSSS APPROVE US & those that have been waiting for long time. :bonk::crying: :crying:

    Just hang on there.. i know K3 application takes longer than K1 . K3 sometimes will take a year or 2 of waiting period.Good luck and be patient.

    Just wanna ask to anyone who have the idea about my question? Any inputs would be appreciated.

    My question is, If my husband(USC) files the petition for my 3 minor kids as the step parent, do i still need the kids'father's permission to travel abroad?

    The father of my kids never supported the kids,,not even a single penny..were not legally married and no contact ever since(about 10 yrs now) so the kids are considered illigitemate.

    If the kids will travel abroad do i still need to ask the permission of the father? What if he will not give permission?can the kids travel? all my kids are in my custody.

    Pls help me and thank you so very much in advance.

  12. It depends upon the state where he lives. Where I live during my divorce proceeding the house would be propoerty that we both owned since we post it after we were married. It does not matter that I was listed on the deed only. Then after the divorce we had to file a quite claim deed that changed me from Married to Single. At that point she could no longer claim the property as joint ownership.

Were not planning to get a divorce since we are happilly married..just was curious about the conjugal properties that me and hubby have acquired since we got married.     I would like to know for some clarifications. I hope you can give me some ideas.

    If you are legally married here in the US does it mean that the wife also owns the assets/properties of her husband even if the wife's name is not in the property ownership? example. .If the couple bought a house but just in the husband's name..does it mean the wife also owns it since they are legally married by the time the property was bought? Does it really have to be in both names? or it's ok even if the property is just in the husband's name?

  14. I just checked the status with the USCIS website and it says that the K-1 petition was approved on Nov. 12, 2008. I wonder why USCIS did not email me on the approval. Anyway, they are mailing the Notice of Approval to my fiance in California. Good heavens, we are so excited. :star: :star:

    PDOS are only for FILIPINO OVERSEAS CONTRACT WORKERS.

    Nope, PDOS is a pre departure seminar to those who are leaving out of the country,, not only for contract workers. YES.. it is required. You have to get yiour PDOS CERTFICATE before leaving.

    Since you said the child is now 17 yrs. old you need to hurry up the process before she turns 18 otherwise it will take a long time to process the papers once she is over 18.

  17. My green card is expiring NEXT WEEK! eeeeeek ya I know... pls dont attack me. Took me a while to save $545. So it's expiring Nov. 17 and I JUST mailed it today through USPS overnight shipping. So it'll get there tomorrow morning (at least thats what the guy said)

    Is that a little too late? I believe/hope that if they see its postmarked b4 my card expires then I'm good.... correct? Oooh hope so. :unsure:

    So having the thought that I'm only going to be able to file it close to the expiration date, I took effort in collecting copies of needed evidence.

    would have been better if you filed it 90 days before the expiration date as what you been told to..but anyway better late than never.

  18. I finally received my welcome letter in the mail yesterday, 4 months after my AOS application was approved at the interview. Somehow, my file was sent to storage without being updated in the system. Fortunately I had received the I-551 stamp in my passport and I was able to travel, but the Social Security office and NY DMV did not accept the stamp when I tried to update my documents.

    A little advise for those with upcoming interviews, if you are offered the stamp after the interview, it is worth the 1 hour wait to get it. It may be the only proof you may have for a while if someone makes a mistake, like it happened in my case....

    Congrats!! just was wondering why it took 4 months before you got your welcome letter. I got my Green card 2 weeks after i was interviewed.

  19. My mom texted me that the delbros delivered the crba and passport of my son today at exactly 5pm. And when I wento home I was so happy coz finally its in my hand.. few days from now we will be together...

    Am Happy for you. I know how it feels. I went home sa Pinas to give birth to our son and had his crba papers in 1 week lng. Finally back home here in Georgia.

My aunt went through this constantly and almost every time she stayed outside the US for more than 6 months, there was an officer who would question her to no end but was never denied re-entry since it was less than 12 months. Others didn't have any problem with it and let her through without any issues.

    Your mom should be ok but it would be a good idea to at least bring a letter from her doctor explaining why she had to stay outside of the US for more than 6 months... just in case.

    I am a 2 yrs. conditional green card holder (K1)and went on vacation in the Philippines for 5. 5 months and never had a problem with immigration getting back to US. As long as you don't stay for more than a year then you should be fine and don't need any re entry permit. I hope i have helped you.

    i gave up calling NSO since this Mon. the employee told me they no longer give any information. My fiance will make a call to the embassy this Thursday, so let's just wait till then. Based on all the posts I have read the best thing to do for now is just wait and look out for any updates from the VJers. It is comforting to know that u are not alone who is dealing with the stress of visa :) Good luck to all.

    Am a green card holder na from Pinas and now in Georgia. You all just have to be patient as the delivery of the visa is in alphabet order. I got mine after exactly one month. If you got a pink slip after you were interviewed then there is no reason to worry..just wait it will come ..i assure you.Am enjoying my married life with a verrrrry handsome 4 months old baby boy. WISH you all the best mga sis.
