  1. Bottom line is that if you question any agency regarding their laws or procedures, they will bounce back and state these laws or procedures were made by congress. So it doesn't do any good to argue with them, have to go to congress. And it does do good to contact your representatives as I see some wording changes in the IRS forms that I objected to that cleared up then nebulous method they used to ask a question.

    The place of birth is an excellent example of this in creating a hardship if that home country does require a USC to maintain a passport for that country, where any natural born USC can visit that same country without a visa with their US passport. Leaving the key question, are you really a USC or not. And we certainly do not have bilateral agreements with many countries, as USC's, we are free to visit there, but next to impossible for them to get a visa to visit us.

    While we can pull a spouse out of a foreign country, certainly cannot bring their entire family here and they do like to visit occasionally, that place of birth does present a hardship.

    Time to write a very short meaningful letter to your congressman to see if this minor procedure can be changed. One think about the USA, we are a nation of all nationalities and our naturalized citizens showing complete allegiance to this country should not be penalized by this place of birth requirement.

    I would opt instead for the place where the naturalization took place. You cannot start a new life if hindered by your past.

    Maybe we should start a petition. And try to get some media attention to this issue. Ant D you are good with words, can you please put something together that we can send to our congress members, and maybe share with other VJ members ?

    On another note, I think Jerusalem is listed as such, since it is still contested legally between the two countries...

  2. Maybe you meant naturalization. Certainly, the way it is, and in complete contradiction to the oath, with the place of birth clearly listed, one is put into a position what is called, "dual citizenship." The USCIS is an independent agency as is the DOS. USCIS is saying, now you only have one country, DOS, says you have to honor the requirements of your home country.

    Is far easier to get a US passport, can do that in town, and a dinky town at that. Most foreign countries only have 1-3 consulates in the USA, want to see you in person, so can be a minor inconvenience, definitely, a very expensive procedure.

    The agreements between countries is certainly no bilateral, as a natural born USC, can freely go down and visit them, but near impossible for them to come and visit us due to very strict and even unreasonable visa requirements. Took my mother-in-law over a year to get a visa to come here, impossible for my wife's unmarried son. But my mother-in-law received such severe harassment from our POE, she never wants to come back.

    Was suppose to be on a plane this morning, had a freak accident last night and badly slashed my hand, doctor advised strongly to cancel, so we had too. Fingers still work, thank God, but hand is very painful, don't like being doped out on pain killers, but do have that bottle sitting there. Wife insisted on canceling the trip. Wondering if that plane we were scheduled on would crash, with poor maintenance, becoming far more common, if so, that slash could be a good thing.

    USCIS also seems to forget the sacrifices one has to make to come here in terms of family, just think about fraud. Make you take an oath to be 100% allegiant to this country while another agency forces you to serve two countries. Can only wonder on what basis these rules are made from. Smoking crack?

    Thanks for the correction I meant indeed naturalization. I just look at it as treating non born US citizens unfairly. for example if I go to Morocco, and show US passport that has Morocco as place of birth on it. I will be asked to use Moroccan passport, or Moroccan ID. My daughter also, is considered Moroccan, eventhough she is born in the states... Morocco does not allow you to give up your citizenship

    "The standards for the names of places of birth that appear in passports are listed in volume 7 of the Foreign Affairs Manual, published by the Department of State. Place of birth was first added to U.S. passports in 1917. A request to list no place of birth in a passport is never accepted. A citizen born outside the United States may be able to have his city or town of birth entered in his passport, if he or she objects to the standard country name. However, if a foreign country denies a visa or entry due to the place-of-birth designation, the Department of State will issue a replacement passport at normal fees, and will not facilitate entry into the foreign country."

    I wish the US passport has "Place of birth or Place of neutralization " After all you are born again American :)

    Indeed I was trying to be forthcoming and disclose the ICE incident, even though no charges were filled, or detention happened. I remember when I did the adjustment of status, the officer asked me about that incident back then. She also said she already checked with the ICE officer, and that my version of the facts matched what he told her. We will see what will happen in the interview, I will explain again since I have no record or what so ever...

    I am punching my self now for filling early. I never thought that i would complain of the USCIS processing my case so fast. Hopefully they will give me my oath letter the same day, for a near date since Dallas has Oaths almost everyday.

    My interview will be early in the morning. In the Dallas office if your interview is before 11 AM and you meet all the requirements, you do the oath in the afternoon.

    You would think they check before scheduling interview, that you meet the anniversary requirement. It sucks to have to go there again, just because I missed the mark by 24 hours.

  5. Do you have anything at all that relates to the situation with ICE? It doesn't sound like you were arrested or detained, just questioned. You can probably explain what happened at the interview itself. You could try contacting ICE and asking them if they have any sort of a report on the incident involved. You would have to give them the date and location of the incident and ask them if they have anything on record. I suspect that you may not need anything though, if the circumstances are as you explained. However, you were better to disclose the information as you did and let USCIS decide if it needs further information or not.

    Yes, unfortunately, you won't qualify for a same day oath ceremony if you are one day shy of your third anniversary. If it is any consolation, if your interview is scheduled later than mid to late morning you wouldn't have been able to do the same day oath ceremony anyway as there wouldn't have been enough time to process the paperwork. They may tell you at the interview when they will schedule the oath ceremony or else they will send you the invitation in the mail.

    Good luck at the interview. If you still have documents that relate to your college classes and switching schools you might just want to add them into your pile of documents on the off chance the interviewer wishes to see them.

  7. Hello ,

    I need help with my Citizenship NOA Questions

    I received a yellow notice asking me for more info. When I filled out the N 400 I checked that I was arrested, when technically what happened was, back when I was a student, ICE immigration came to my apartment thinking I was out of status. After I explained to them that I transferred to another college, they left. Now USCIS wants me to bring an official document that says I was charged or not charged. How can I come up with that, since I was not arrested, or detained ?

    I also received the interview letter, the date is set for 03/05, and the date on the green card is 03/06. My local office offers same day oath, and it appears I might be short one day for the 3d anniversary. or 3 years including the end date. Am I gonna be asked to come later for the oath another day?

  8. I was scheduled for my N 400 Biometrics today at 8 Am. Long story short, I went to the wrong old ASC at

    DALLAS ASC Village at Bachman Lake 3701 W. Northwest Hwy Suite 211. Dallas, TX 75220

    I did not realize that the address is a new one, or that my GPS was taking me to the right place :)

    Anyhow, after 45 minutes pf driving in circles, I decided to trust my GPS. When I got to the North Dallas ASC, I had to wait an hour to get processed. The agent told me they moved to this new address since February 2009

    Lost Green Card and Transportation Letters

    Permanent resident alien registration cards (commonly known as Form I-551 "green cards") can be issued or replaced only by the United States Citizenship and Immigration Service (USCIS) in the United States. The U.S. Consulate General is unable to issue a replacement green card. If you left your alien registration card in the United States, you should ask friends or relatives there to send you the card by express mail.

    If you have lost your green card, the U.S. Consulate General may be able to issue you a transportation letter that will permit you to return to the United States. We must also obtain confirmation of your resident alien status. Knowing your alien registration number will expedite the process. There is a $165 processing fee for the transportation letter. This fee must be paid whether or not the transportation letter is issued. At your interview, you should submit the declaration of loss, declaration de perte, from the police station in the city where the loss or theft occurred. In order to apply for such a letter, you must appear at the U.S. Consulate General and sumbit an I-90 form.

    To apply for a transportation letter you must apply at the U.S. Consulate General between 8 and 11:00 a.m. on any Monday, Tuesday, Wednesday or Thursday, excluding U.S. and Moroccan holidays. Be sure to bring your Alien Registration ("A") Number and passport with you, the police record of loss of the green card (with an English translation of the record if it is not in English), as well as proof of your presence in the United States within the last 12 months. Upon verification of legal permanent resident status, the traveler will be given a temporary document for return to the U.S.

  12. He wont have to translate a Moroccan birth certificate since he is dealing with the Moroccan embassy.

    He also can play dumb and give them the 2006 Birth certificate, and most likely they will accept it.

    They can mail him back his documents back if he provides them with a paid first class USPS envelope.

    One more thing do not stress too much, He is Moroccan and he will know how to deal with the folks mentality at the consulate

    Again, thank you! Is there any way he can get his birth certificate, and renew his ID in NY? I guess those are the first steps, along with registering to get his Consular Card. It seems we might have to make more than one trip up there, then.

    Ask him I am pretty sure he has a Moroccan birth certificate on him. If he has a family book he can use that to get a birth certificate from the consulate. Other wise he can always ask someone to send him one from Morocco.

    I think one trip should be enough for him. However, It is a good idea to plan for it to be for 2 days or more.

  14. Thank you, MoroccanInTexas! I will have him look at that link (my French and Arabic aren't that good yet). I was wondering - when you renewed your passport, was it still valid, or expired? That's one thing I'm concerned about - his expires in less than a week, and he doesn't have a current birth certificate or ID card, and hasn't registered to get his Consular Card.... He was planning to go there in person if/when he gets it renewed/extended, so that part isn't an issue.

    You are welcome. When I renewed my passport it was 5 months before expiration date. He will need his birth certificate, and he will have to apply for a new Moroccan ID. I wont worry much about him getting a new passport after old one is expired. They will have to give him one, or in case of emergency a Laisser Passer (Travel document).

  15. I renewed my passport with NY consulate. It took forever to be mailed back to me. Now, Morocco is going to have a new Biometric passport starting 04/01/2010 and your husband will have to go to the consulate in order to get one. please share this site with him. It is in Arabic and French only

    Correction starting 04/01/2010 Morocco will give emergency digital passport

    For normal digital passport started on 12/15/2009 and the person needs to have a national ID, regeistred with the consulate, and present in person to apply for one.

    I will try to answer you to the best of my knowledge

    1-It wont hurt if you do send my Divorce Decree even though you wont be applying via marriage to USC.

    Also apart from sending the check and pictures send copy of your green card front and back.

    2.. You can apply 90 days prior to 5 years. some ppl had there interviews and then had to reschedule those interviews or re interview because there interview date was prior to 5 years of GC. As the USCIS can not give you citizenship unless you qualify

    3.. Relax :) rescheduling wont be that hard. You can always apply after the 5 years, this way you wont have to stress about all these scenarios.
