  1. In the worst case scenario i was thinking of CR-1

You have to have AP before you leave the country. From what I remember, you will not have to start the process with a K-3. Maybe someone else can give you more information. I am afraid you may be stuck out of the US until they K-3 is approved.

You may want to go to My Assistant above and fill out your Timeline.

I really regret your situation. Good luck.

no need for duplicate posts. someone will get to ur original post eventually

  2. Guys, I have a question: they touched my I-130 online - but didn't approved or change anything, since Dec. 11. Is this normal?

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Case received and pending.

On December 11, 2008, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. (...)

When you the card production is ordered, should this change too? When is it approved, usually, in relation to the I-485?

    [/quote

not necessarily...the onlind status is not always reliable.if u got the welcome notice it means both were approved. lucky, u even got the welcome email...mine still shows that my case is pending..)

  3. Your adjustment of status could very well be in jeopardy - leaving before obtaining at least the AP could result in USCIS considering you having abandoned the adjustment of status.

Applying for AP after the fact may not have good results (all they have to do is compare the date-issued and your departure date).

Applying after the fact will not allow you to enter the US. If you arrive at the POE with a AP and your foreign passport they are going to see that you left the US before you even had the AP and you will be denied.

    Caution

Due to recent changes to U.S. immigration law, travel outside of the United States may have severe consequences for aliens who are in the process of adjusting their status. In general, individuals who seek immigrant status or who are already legal permanent residents, and who depart the United States without the appropriate documentation, may be inadmissible to the United States. In addition, their applications may be denied if they do not have the proper travel documents or if they are otherwise inadmissible.

    what a waste of 1300$

  4. I went to this site https://egov.uscis.gov/cris/jsps/index.jsp to register my case . It didnt accept the MSC... number but did let me to create an account.

    1) So I presume I get the eac.... etc etc number with the 2nd NOA ?

    2) Do they stop sending paper notification through email if I choose to get email notification ? or both goes simultaneously ?

    Thanks

the online status normally takes a while for some people. you already have the receipt number so just keep trying.

they do not stop sending the paper notifications. ideally you should be gettin both updates simultaneously but as you will see and as i have pointed on here b4, the online status system is very flawed. mine still shows .."case pending" so just use it for general info, dont drive yourself crazy.

  5. Thanks again FRJ. I did some small research online. Found this :

"There actually are four separate types of A#. You can tell them apart by the number of digits and the first digit. The first kind is an eight-digit A#. These are manually assigned at local offices. If you have one of these numbers, simply treated it as if it was "0" plus the number. Nine-digit A#'s that start with the digit 1 are used for employment authorization cards, usually related to students. Nine-digit A#'s that start with the digit 3 are used for fingerprint tracking of V visa applicants. All other nine-digit A#'s (these actually always start with a 0) are permanent A#'s and remain permanently with you for life."

Mine one starts with 0. Is it starts the same for all VJers ?

yeah. mine starts with a 0 also and its the same one that i had throughout the AOS process and on the welcome letter, after the GC, it states that that it will be your permanent file #

  6. So i think i have to wait till I get my EAD and then i can apply for SSN. And without SSN or EAD i wont be able to a get a learners permit or a drivers license. hmmmm

Had another small query. Saw they have mentioned a A# number both on my Biometrics notice and I-485 NOA 1. I did some research and saw it Alien registration number. Is it common to get this number on these letters while adjusting from B1/B2 based on marriage ??

    Thanks

yes...the A number is gonna be the number by which they can pull up all ur info..as a matter of fact when u get your welcome letter, they tell you to take note of this number because this becomes ur permanent resident account and file number. if ever u need to contact uscis, thats the number that they will most likely ask u for.

  7. After my entire AOS package got rejected and sent back to me saying i needed my NOA2 which i had PUT IN!...they have finally cashed my cheque after i sent the package back to them with about 8 copies of my NOA2

So hopefully after that slight 'hitch' which put me back a month, we are back on a roll.

My question is...i want to get my case status online. Ive only got the number on the back MSCxxxxx... but it wont get registered. Any suggestions?thanks

keep trying...mine took 2 weeks before it accepted my msc receipt #.kept tellin me that the number was invalid. guess its safe to say the online status system is not flawless

  8. I owe you lots of thanks FRJ !...

You have always supported me on many threads. I do appreciate.

We just click, we should be a team on VJ.

Here again I do thank you for supporting me about "Samuel09" thread.

I have been angry with myself that I have lost so much time for nonsense stuff.

    Thanks partner, see u around.

    HERE IS MY TIMELINE :

    haha...no problem

  9. My husband just returned from Iran using his AP. His green card is still pending with no interview date yet. Although he had a horrible experience in Chicago coming in with his K-1 visa, we routed him through Detroit this time and he went through with his passport (Iran) and AP papers with no problems, no questions, all good.

I would advise not missing the AOS interview but it is possible to have it rescheduled although they may really question as to why she missed it.

i guess u werent satisfied with the responses from the first post?

  10. First of all, take a deep breath & relax.

Every state in US is different about issuing the marriage certificate.

I am sure your country, Canada is different too.

You do not have to wait for the sealed Marriage Certificate to apply for AOS.

Whoever marries you ( I mean in HI) signs the marriage license (not certificate)

along with the 2 witmesses' signatures & gives one of the copies to you.

Now, this document became marriage certificate (not license anymore after the signatures).

This is also an offical document, you can use it anywhere including AOS. Later on you can get the fancy

marriage certificate, that takes little bit time. It took me about 1 week to get it for example, I live in NJ.

I know it is confusing. Doet it make sense now ?

    GOOD LUCK !....

right about that....even the counties are different about how they issue licenses.. i got mine right after the ceremony at the courthouse. my friend who got married at a courthouse in another county had to wait till his was mailed. he was given a temporary one however at the time of his marriage.

  11. I had my oath ceremony today, on the oath letter it was for 10 am but they didn't get us in the court room till 10:30 am & the judge showed up at 11 am and it was 35 mins total. There was 49 of us from 30 different countries. But am sooooooooooo happy it's all done. Thanks to everyone on visa journey for all the help.

    congratulations!!

  12. Thanks FRJ which visa where you adjusting from ?? Also can anyone throw some light on my Social Security Number question. I did some online research. Some says one have to get a EAD to get a SSN. Others says one can get a SSN after Biometrics only. Can someone advice ?? Thanks

i'm adjusting from an f-1 but i was out of status. as for the ssn question, i would think that you would get it after the EAD. the biometrics only entails finger prints and picture so it would have to be after you receive the EAD.

  13. touches dont really matter as far as i can see from my case. i got my card in the mail and my online status still says my case is pending.

Yeah I got my AOS interview date today in the mail and my status still read "Case on hold." Can u update ur timeline please?

well i had my interview since feb 19..and i got approved. i got my green card on march 5 but the system still says that my case is pending..as a matter of fact, it shows that my last touch was january 29..so i say all that to say, dont drive yourself crazy with this onlie status system . i know it can be frustrating but ...

  14. Hi All,

We are adjusting based on marriage to USc from B1/B2 visa. As you can see in my timeline we have recieved NOA1 for all 3 and also biometrics notice.

    1) Now all of them has the application number starting with MSC as its coming from Missouri service center. And only the Biometrics letter has a extra USCIS A# number. But i am unable to check my case status online as they look for a number starting with EAC, WAC, LIN, or SRC. Other if i try to check with my number it says

    " Validation Error(s)

You must correct the following error(s) before proceeding:

Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

when can i get my real number ?

    2) After my Biometrics interview, do they give a document that we can take for applying for SSN ? ( as far as i have read one can apply for SSN after biometrics)

    I wd appreciate all replies.

    Thanks a lot

    Christera

it normally takes a while for the status to be available online. i had an msc receipt # and i also got the validation error until after the biometrics. for other people it varies too. i wouldn't pay too much attention to the online status system..i gt approved on feb 19 and i have already gotten my gc but the system still shows status pending..

  15. Thanks Guys!Good Bless!!

    congrats..

  16. I had applied through catholic social services two decades ago. I was given a temporary approval and an EAD. 19 years later the denied my application and now I am out of status. While all this was going on my sister filed an I-130 in year 2001.

Karin, I really appreciate your approach and your expertise/experience. I don't think that people should be rude to anyone, now matter what theri circumstances are. No one knows who is going through what!!

your story is all over the place and i think that's why ppl are confused. first you said your sister filed for u., now u say you used catholic charities? and how did you receive the temporary status? also , in terms of your sister in law, just because she received the EAD and biometrics, doesn't mean that its smooth sailing from there. uscis rarely makes mistakes...
