  1. We filed from Australia as well under similar circumstances. We sent the package to my parents for them to enclose a check and then mail it on to the Chicago lockbox. It didn't cause any issues at all.

    That is so helpful. Did you use their address for your contact address or your address in Oz?

    The I-130 fee cannot be paid by credit card.

    If you are unable to pay the fee from a US financial institution yourself, then send the package to someone you know and trust in the US and have them enclose the fee. You can reimburse them at a later time.

    The Chicago facility is a document intake facility, not a service center.

    I was wondering about that because I was trying to look up the timelines and there were none. So then they forward to a service centre? Likely California, I assume.

    i just finished completing our I-130 and am trying to figure out how I can make the fee payment.

    Both my husband and I live in Australia. There is no option here to do a DCF. We have to send it to the Chicago Service Centre. The only problem is that the form says that the bank check or money order has to be drawn on a US bank. We don't have access to that here. It also says that they take credit cards but I can't find any way to make a credit card payment. Does anyone know how to make a credit card payment? This is so frustrating.

    The only thing I have found reading through other posts is that I should sent it to someone in the US to file for me. Should I do this? It seems like it might be worse in the long run.

    Can anyone help?

  3. I'm not sure where to restart my journey. My husband is Australian and he entered the U.S. on his conditional resident visa. We lived there for about a year when his stepmother got Motorneuron disease at the same time his grandfather passed away. So we returned to Australia to look after his father as he was really suffering. We didn't realise that we needed to file a leave of absence. In the meantime, we filed our AOS and went home for all of the appointments since our intention was always to return home. It took longer than expected so when we moved back home, we were told at the border that his Greencard had been cancelled. We were shocked. So we stayed for about 6 weeks and came back to Australia. We have now been living here for 5 years total and really want to move home especially after we have our first born later this year.

    I think we are supposed to file a DS-117, Returning Resident Status but it doesn't look hopeful. Has anyone else done this? I'm really upset. I never realised that we were breaking any rules.

    I received a letter requiring a Request for Evidence which they said was included in the second page. The second page is below. I have already sent a whole package in with everything listed below. I am not sure what to do and am freaking out now. Could it be a mistake?

    * All foreign language documents must be submitted with complete word-for-word English translations. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. Do not submit the English translation without the foreign language docwnent.

    Failure to respond to this request may result in the termination of conditional residence status and subsequent removal proceedings. Please submit the following evidence using the attached Form 1-797 (blue sheet) with the response.

    Copies of mortgage agreen1ents or deeds showing joint ownership of assets or property or joint

    Copies of credit card statements.

    Copies of loan documents such as car loans, home improvement loans, business loans, etc.

    Any other documentation which shows that the marriage was not entered into in order to circumvent

    U.S. immigration laws.

    Residence: Submit evidence of communal residence. This documentation should reflect the names of both the conditional permanent resident and their U.S. citizen spouse. Such evidence may include but is not limited to the following:

    Copies of mortgage agreements, deeds, or rentalleasesl agreements showing joint tenancy at a

    common residence signed by the conditional resident, the U.S. spouse and the owner(s) of the

    property (or the property manager) .

    Copies of utility bills such as telephone, gas, electric, water, cable, Internet, etc. or other statements issued in both names indicating the residential address.

    If applicable, submit copies of military Basis Allowance for Quarters (BAQ) form for housing and/ or

    DD Fonn 1172 for dependent military dependent cards.

    Any other documentation which shows that the marriage was not entered into in order to circwnvent

    U.S. immigration laws.

  5. Hello Everyone,

    I am trying to file my taxes for 2008. I am having a hard time because I was married in May 2008. We have been living apart until our visa was just approved January 13th. The problem is that my husband does not have a SSN yet. You cannot file a married return without listing your spouses social security number. Do I file single since he didn't live or work here in 2008? Does anybody know. I have been on the phone with the IRS for the past hour and they can't seem to figure it out. HELP!!!!

Wow...Congratulations to everyone. I went to Australia for Christmas because I didn't know when I would see my hubby. Turns out they gave him an interview while I was there. We did our interview Jan. 13th. Approved. My hubby is here with me and I am soooo happy. Good luck to everyone else in February and hang in there March peeps. :thumbs:

  7. I am going through hard times so don't know if our marriage will survive... I may be going blind so how can I support my husband when he comes??? As it is I won;t be able to pay for health insurance for him so don;t know what to do now. All of the old doubts are coming back and I am thinking if he wanted to emigrate(which I know was one reason he married me) he should have married a German citizen instead like so many Nepalis... Good luck to everyone, I really don;t know what to do at this point.

    I am so sorry to hear of your health problems. I feel your pain. Have you talked to your husband about it. I am sure he will stick by your side. In sickness and health and in good times and bad, right..... I'll say a prayer for you. Hang in there.

    I am right there with you. However they are telling me that I didn't send in the original marriage certificate, when I sent a certified copy. So it's under supervisor review still. :blink:

    Congratulations!!! I have found that the cheapest airfares are the ones that get you here on Christmas morning. Not sure how long the flight is. The Aus tix were so expensive until you got to the flights that get you in on Christmas. It's wort checking. Good luck.

    I have a question, which might be crying after an accident has happend. In Item 20 of the DS230 it doesn't ask for address, just city or town. how di dyou do this? Did you do city or town or did you put the whole address. My husband put city. He has not lived many different places, just two really. Did he do the right thing or did he need to put the actual address? :hehe:

    We just put city. We did not add a physical address. I thought that we were going to get an RFE for answering the second part that has the dates. I put 10/1977 to 10/2008. Apparently they wanted 1977 to present. I have seen several people on here get an RFE for that but they didn't give me one. Thank goodness. Good Luck!

  10. Good news! They received the orginal birth certificate and the case is under final review and soon should be complete. Then I will be with the rest of you fine folks...waiting for the interview date.

    Reguardless, I am going to India for Christmas. How about the rest of you? It might help instead of being without your honey! Can you swing it?

    Hello, I'm also planning to to India for Christmas and then me and my hubby, we will fly back together here. I actually want to see Chandigarh where he lived for so many years and then probably, we go to Kullu Manali anf then come back to US. I was planning to go on a trip here in USA but its too expensive. At least, in India, its a little cheaper there.

    What are your plans????

    Well I am so happy. I am buying my ticket to Australia for Christmas and New Year's. It wasn't in our plans at all but we have been saving so much since we have both been at home moping and skipping the going out, partying, eating out, etc... Hopefully our airfares don't go up to much by tomorrow. I am leaving the 23rd of Dec and coming back the 14th of January. We are hoping for an early Jan interview now and maybe I can go with him in Sydney so that he is not all alone. That would be awesome. I was so depressed at the thought of not seeing him until Feb but now I am so excited. Counting the days again.... :luv:

  11. I am now in the same boat, however our case was barely completed Nov. 5th. They told us all of the Dec. appointments have been set and to try calling around the 15th of December. We have never been in the AVR, so skip it and talk to a real person. Call NVC. Press 1 then 5. I don't think that it will do any good to contact the foreign consulate as NVC has the rights to schedule. Good luck!
