    Every one is correct, you must leave the country. However, what no one has pointed out is that there is nothing to prevent you from marrying someone else, while you are here. Then, that person could file for a spousal visa for you, and you would be able to come back and be with them in about a year. I am not suggesting this as an approach, just mentioning the possibility... Good luck, and sorry that your relationship is not working out.

    I would be super grumpy too, if I was far from my former home with no internet. How hard is it to get internet in a house in America? How rare is it to be without in this day and age?
    I am curious as to how you made it this far, and how you communicated while he was still in New Zealand, without internet access.

    A sponsor should file form I-865. The sponor should file it for themselves. The AR-11 is for an alien to report their change of address.

    If you want the transcripts you can order them online for free from the IRS website. Took about a week to get them in the mail. If your sending the actual tax return you need all pages including W2 and any 1099s etc.

    My tax return for last year was over 40 pages. Much easier to send the transcripts. You can order them online to be mailed to you and in the time you read this post you can be done with one year, honest.

    Nowhere on any of the instructions for the forms required for Adjustment of Status does it ask for evidence of living together, co-mingling of assets, etc.
    The I-485 instructions, under section 12.B. (Evidence of eligibility) says to attach copies of:

    Approval notice (NoA2) from Form I-129F submission
    Marriage Certificate
    Form I-94

    Just follow the instructions and you will be fine. USCIS doesn't want to see any "additional proof" or they would ask for it.

    Also, to "ineedmylover" and others lurking and thinking about posting.
    In a perfect world, it shouldn't matter what country you live in, were born in, or any other aspect of your cultural background. Unfortunately, in immigration, and especially family based immigration, it does matter quite a bit. You have nothing to gain, and a lot to lose, in the usefulness of the responses, by omitting these details. And, if you omit these details, the respondents will typically assume that you are from a high fraud country.
    In other words, when asking open ended questions such as "which immigration route if the best for us?", please post as much background information as you can. Such as your country of birth, current residence, and maybe even how you met.
    One other point to "ineedmylover", you stated that you had an "aunt and an uncle which will support me and my finance financially". Unless your relatives are U.S. residents, they can not legally co-sponsor your immigration. They may contribute all they want, but the USCIS will not consider such support to meet the requirements of financial obligation.

    I wish it will all change when they meet you!when i met my fiance in person way back in january 2008 on his vacation here in the philippines,i never thought he would come back june just to proposed to me...His mom even ask/beg me to not accept it for its only a while that we know each other..She is so vocal in saying she doesn't like a pilipina for him and she wants a latina.She even say this things to him just to convinced him not to proposed to me, My future Mother in law said.. Are you sure she is not a visa hunter???How can you say she is the right women when you only knew her for months and only talking online?with that face of her she can get a much younger and rich american guy... :bonk: and so many other things that is so foul in my part and ouch,,really hurts my ego!Even until the day we already are engaged she keeps on convincing my fiance that i am not the right woman,The most painful part is when we had our child they told him to get DNA test to make sure the baby is his own..That statement of her mom pisses me off,and i told my fiance things i am never used in saying like "I don't give a ###### with any of your mom's comments or issues about me"But you know what melts my heart we are in a 3 way line when my fiance told his mom that me and his daughter are the most important in his life now and if she can't accept us and she can't respect me then there is no way they are welcome in our wedding and our house once i arrived there in US.(glad they live far away from my fiance)But things change as she starts to know me little by little even she can't totally accept me still she says things like I am so surprised how catherine is so smart and wise,how she was able to find a site just by internet and now your daughter is a dual citizen..I think she will be smarter than you as years passed by... she said that to my fiance!!!Just like what other's said you will not marry the whole family only him,if you think you did your part and they still can't accept you,its their problem anymore!
    I am not even as educated as you maybe but my fiance always tell me and makes me feel that I am the BEST, mother to our child and wife to him!I think in the end that's all that matter's!Don't worry too much about his family!Once they see how GOOD you are there is no way they will not embrace you if they have a heart

    I am only going to mention this because others undoubtedly will too. Your K-1 Visa expired the moment that you used it to enter the US. At that time, your wife was issued a I-94 permit, valid for 90 days. The only firm rule is that you get married within the 90 days. This preserves your ability to adjust status status based on the I-129F and K-1 Visa. You have already married, so you are good there.
    USCIS now requires you to apply for an adjustment of status for your wife, from a K-1 non-immigrant entry, to a permanent legal resident (green card holder). This should be done "as soon as possible". There is no real penalty for waiting, it just means that your wife will be "out of status" for a longer period of time. It takes at least 60 days for the adjustment of status (I-485) to be processed. Therefor, most K-1 recipients will be out of status for some period of time.
    Most people advocate timing it so that you at least receive the first notice of action (NOA1) on your I-485 before the I-94 expires. In practice, many couples wait much longer, up to a year after entry (9 months after the I-94 expires) to file the I-485. A big disadvantage to waiting any longer than that is that the K-1 medical is only good for 1 year, and if the I-485 is filed more than a year after the medical, another medical exam will be necessary.
    It is only taking a week or two to get the NOA1 after filing the properly completed I-485 these days. How you want to time it is entirely up to you. I am just trying to provide a little background information to help you. If you can manage to file the I-485 prior to April first, that would be best. But I wouldn't worry too much if you have to wait a little while.
