  1. Do I have to include all my children on the affidavit of support even though my ex claimed them on his taxes? I have 4 under 18.

    the i 134 form ask if your dependants are completely or partialy dependant on you. it doesn't ask who claims them on their taxes as dependants. So, do you help support them ? do you pay child support ? do the children live with you ? do you get enough support from your ex to say that is all you need to support 4 children ? if not you may need to say you partially support your 4 children.

    You are right... nothing constructive. I am true to my word and will not discuss who did what in our relationship, but you have assumed that what I was charged for, happened just that way. The only thing your response tells me is that you or someone you love or are close to has never had any run ins with the law.

    Meaning, you have never been in a situation where someone is telling you you have done wrong doing when you know you haven't but it is out of your control. Don't worry... when you do and you come to a public forum I read, I won't reply assuming you are a bad person and deserve punishment.

    IF it were terroristic threats or something similiar then I might understand. its the INJURING a family member that disturbs me.. they usually have to have some proof for that. i.e. doctors report or pictures with police report. I know everyone is innocent till proven guilty. and it appears you pleaded the case down to a no-contest. and I have seen a women lie in court to further their case. some can be down right wicked. but they can't charge you with injury if there isn't any. of course there's always the exception to the rule.

  3. I have searched for VAWA though forums posting and have not read anything contructive to tell me the effects of a VAWA filing on the citizen/sponsor.

    It is 21 months since my wife and I married and her temporary green card is up in May 2009. I have filed divorce papers Dec 2007 and am looking to finalize the divorce as soon as possible from today. She recently moved out and we have both decided the marriage is no good and we are not meant for each other.

    I am not here to talk about our rocky relationship and who did what. Simply put we are both good people who in our own ways love the other, but don't show it the way the other wants to see it.

    So in Aug 2007 I was charged with 'Assault with Injury to a Family Member' by the police. I got an attorney and pleaded No Contest and received a 1 year probation with deferred prosecution with a promise to remove the arrest and the charges from my record if completed. Two months later my wife and I went back to living together until a week ago.

    She wants to use the VAWA process with the above case repot to continue in this country. Fine with me. I am way passed the 'deportation anger' that the citizens feel initially.

    QUESTION:

    What I would like to know is when she does this do I need to fear further criminal prosecution if she only mentions the above case or if she claims further and untrue violent acts on my behalf? I feel threatened and worried about further legal problems affecting myself and my family (son/single father), emotionally and financially.

  4. Put a note nlng...FRAGILE...GLASS-BREAKABLE... :P HANDLE WITH CARE!

    in theory its a great idea. but in reality they don't treat luggage, boxes, etc. any different just coz it is labeled fragile or handle with care. it is a fact that the very expensive luggage gets thrown around just like the cheap luggage. I always get a laugh watching people affix those stickers to their luggage. anyway, if your husband can take it back. give it to him to take. thats what we did. and it worked out just fine.

  5. now go directly to ..Immigration Timelines from the menu bar and click on that. then go to video help for creating and editing a timeline and follow the directions and creat a timeline. this you will need throughout your journey. and don't nforget to update it as things progress. if you don't fill in your timeline VJ peeps will be reluctant to help you, as your timeline also helps others.   6. I got my NOA2 about 3 weeks ago. My fiance did not get his paperwork yet from the Embassy in Rio, but we decided to go ahead and take care some of the things we could. so we realized that he will need 3 times the Hepatitis B vaccination with a time of 4 months between the first to the last one.

    I beleive he will have his interview before the last one. So what could we do?? Could he take the last one once he is here in USA?

    Please, let me know. I would appreciate any help.

  7. When responding to an RFE, it is critical to provide exactly what is requested and to mail in the envelope provided. Did you do both? If not, what was requested exactly? Why did you not use the envelope or mailing instructions provided with your RFE?

    Please stick to the topic. OP is asking for advice. NOT to be scolded!

    I am sticking to the topic and need further information before providing additional advice. It's possible the OP "did both" or not. I need to know before advising further. Get it? There's obviously a problem. It must be identified before it can be solved.

    your question makes perfect sense. and for good reason. its a lot easier to give quality help when you are better informed.

  8. welcome to VJ, I see your in the VSC , so close to california but they send you to vermont. I am curious how they divide the petitions from state to state. well, I guess there's no making sense to this system. so good luck with your journey and remember to tred lightly, this is VJ and when the natives or bored and restless they will seek victims to sacrifice to the USCIS gods.

  9. So, I got my answer from my congressman after inquiring into our K3 petition at VSC.

    "Bla Bla your 130 will be pulled and processed when your 129f is processed. Currently the processing time for 129f's is Feb 1st 2008"

    "VSC also told me that prioritization of processing of applications is frequently predicated on the personell resources available, however hundreds of new employees have been hired and once they are trained they are commited to the reducing the backlog"

    I may call the contact I was given and ask that she ask some specifics. Maybe like, at what stage is our application? Backround checks or what? Hmmm, maybe I will

    I just wonder how many of their staff has to stop processing petitions to take the time and train hundreds of new staff to stand around and do nothing ? sounds almost counter-productive to me. in other words, it will get worse before it gets better !!

  10. My sister in law lives with a guy from Jamaica.

    He came here 10 years ago to study.

    After a while, he made an agreement with a us citizen girl to get married so he can file for adjustment as married to a us citizen.

    They got married in 2004, and in 2005 he got his temporary GC.

    In 2006 he met my husband's sister and they started living together.

    They now have a doughter together, but he never got divorced from that other girl.

    Meanwhile, he applied for the citizenship. By preparing him for the interview, his lawyer advised him to tell the whole truth, to admit that the marriage thing wasn't genuine and everything was to get the legal presence in the US. Eventhough, his legal wife is willing to help now, there's nothing to be changed, cause he did tell all the truth.

    So, now, obviously he recieved a letter stating that he's now officialy a subject for deportation, and he cannot continue to work or do anything.

    My sister in law is desperate. They have a little girl together and he is actiolly a good family-man.

    My question is if he divorces that girl within the next 30 days and get married to my sister in law, and they make the paternity test to proove that they have a child together and proove they have been living together for 2 years, can that help, or he's definatelly going to be deported?

    are you freakin crazy for aksin for help here?? all of us here have waited for a long time and spent alot of money to help get our spouces here the LEGAL way. and now you want people here to help advise your in laws how to get out of a mess because he commited FRAUD!! he is the reason its so diffucult for people tring to do it the right way. i say deport him and put a 10 or 20 year ban on him too. if he wants to be with your sister in law and his child im sure it would be pretty easy for them to immagrate to jamacia. its NO ones fault but HIS OWN FAULT that he in that mess...

    holy #######, i said something VERY similiar to this on a post a few weeks ago. and the VJ gangsters came out in full force to attack me. and now for some reason a lot of people agree with it, even some of the gangsters. this place is really focked up !!!!..

    do I care about him ? hell no !! but I feel awful for the child involved, and that would be enough for me to help if I could. maybe more people should start thinking about the child here. so what if the father stays here in the USA. this place is sinking like the titanic anyway.

If this was a marriage between 2 USC that went sour there would be no question of how can I get the person kicked out of the country?

    IMO, if you're broken up that your marriage has gone bad, getting your ex's greencard revoked would not be the first thing you think of....ways to win him/her back, counseling yes, not thinking up ways to get the person deported.

    certainly not in our minds, we could only guess or make assumptions. but I believe that the married, possibly soon to be divorced couple honestly knows if its just a matter of differences and being incompatable, or a scam from the start. love is blind, but eventually the blinders come off and we see life as it truly is.

    I don't understand why everybody wants to be in this country. It is not all it's hyped up to be.

    I know, some people have it worst in their home countries but marrying for papers is sad...really sad...

    if I could sell our house and business for a fair price, I would move to my wifes country next week. but it looks like we have to wait some years for the housing market to turn around. we are in the process of buying land for housing there. we will just hold off building till we sell here first

  18. pushbrk, I know the op is asking about marriage. but, can the fiance com here on a tourist visa and then file a k1 while they are here and skip the weeding until the k1 is approved. of course still not overstaying the tourist visa. the advantage being a shorter time period being seperated, and they would still get married in america like they want
