  1. Thats the main reason why we contacted ours (even though we'd pretty much decided with the timeframe we had to work with we were just going to go for another medical) like you say, if they aren't aware how can they help make a change?

    I know one person who WON'T be getting our vote next time round if he doesnt get back to us soon...lol

    Would an infopass appointment help? maybe going to speak to someone face to face would shed some light on it all?

  2. I don't know why you would delay in contacting your representatives. Why send a letter declining to provide all that the RFE asks for and risk getting an intent to deny letter? Why not get some action taken on your case and make sure someone *looks* in your K-2 file?

    There have been an increasing number of VJers who have successfully gotten their congressperson/senator involved and resolved this exact issue. My story is in the link on my signature, and here are two others.

    Make sure your representatives know that you are having these problems. When I called and mentioned that a lot of people were having issues with the medical, the immigration expert I spoke to had NO IDEA!

    Representatives arent always all that, we're still waiting for ours to get back to us. I was also instructed (by the lovely lady on the phone at USCIS) to send in a letter and was promised it would be forwarded to 'the right person to deal with this'....and most people tend to do as the USCIS tells them. This problem needs resolving at source, both mine and my sons medicals were handed in at the POE together, they had no problems locating mine yet my sons' has gone AWOL. I'd dread to think where all that vital information now is......there is no simple solution to this, until the USCIS wake up and start doing their job!

    Just popped in to update everyone on my sons fiascoooooo formely known as AOS.... :whistle:

    We;re still waiting for our lovely congressman to get back to us, so in the mean time i hopped on the phone and started calling up some civil surgeons in the area. After about 5 calls to various places i found a great place in Hoboken NJ, who could fill in the medical form and yes it was covered by our insurance :dance: (most other places i contacted wanted to charge us 100-200 dollars....pfft) We took my son on friday, handed over all his vaccination records for transcribing, had a brief chat with the doc (no questions were asked about any other area of the form..ie: mental health :hehe: ) we were told he needed a TB skin test (no biggy) and that was it...went back on monday, his arm was checked by the nurse to make sure he had a negative reaction to the test, and the medical form was handed back to us all signed sealed and ready to go! Today we got conformation from the postal service that the letter had arrived and been signed for (let them DARE tell me they can't find this one) so the wait begins AGAIN.

    I have to say i am still furious over the thing, and reading around the forum my son isn't the only K2 to go through this. I really hope someone wakes up pretty soon and sorts all these medical RFE's out...like its not stressful enough filing in the first place...Arrrrgh!!

    Anyway, good luck to all with AOS, Jobs, driving test etc....

LOL...nice post sundrop, couldn't have said it better myself :thumbs: its obvious the people on the phone don't realise that the people on the ground dealing with K1/K2 Aos apps have no clue what they're doing, hence the crappy demands and RFE's...i'm still furious about the whole thing, but we had 30 days from the last notice to comply, and i wasn't going to risk going over that by arguing their own guidelines with them....Grrrrrrrrrrrrrrrrrrrrrrr

  5. my husband was able to talk to a level 2 customer service,, she said that they received lots of calls like we have everyday,,,she instructed my husband to send a letter to USCIS stating that my daughter had completed medical already overseas and have submitted the vaccincation part during the AOS application as per requirements.

    Thats what she told me :) I'd resubmit copies you have of the vaccination supplement and the receipt from the medical if you have it...

  6. My son had gone through them already in the UK, and i submitted all the relevent paperwork at the time of applying for AOS (as i did with my application). Both our medicals were handed in together at the POE in the sealed envelope, but they still said they have no evidence of his medical. They need to pull up your daughters 'A' file and link it to her AOS, i explained this to them in my letter, but they were still adament they had no record of it. I'm keeping my fingers crossed that they find your daughters and this is only a hiccup, i just thought i'd share what we're going through so you can be prepared :)

  7. I am going through exactly the same thing with my son. my application went through and i already have my green card. My son got an RFE for medical, so i called them up and was told just to resend the evidence of his medical in the UK and cover letter stating he does NOT need another medical. We did this and about 2 weeks ago got a 'letter of intent to deny'. We tried contacting our congressman and are still awaiting a reply, so last Friday we took my son to a local civil surgeon here, he completed the medical from for us, my son had to undergo a TB skin test (as at the time of K2 visa app he didn't qualify, but now he does..lol) all his vaccination records were transcribed, and we got back the sealed medical form on monday. We really wanted to argue this with USCIS but as we only had 30 days to respond to this RFE we decided to give them what they want now and argue later. If he'd got denied we would have to reapply for AOS (and pay the fee all over again)....i would suggest you ring around a few civil surgeons in your area, and see if you can find one that'll do it on your insurance (thankfully the fifth one i called did). Yes its a pain in the #######, yes its inconvenient/frustrating and downright annoying AND goes against the procedure stated on the USCIS website, but i wasn't going to take the risk of my son being put on the 'deportation list'. I really hope they pull their finger out their backsides and get this whole medical fiasco sorted!

Thanks nich-nick :) We emailed our congressman last night (had to do something to stop my agitation..lol) will await a reply today, and if i hear nothing will be giving them a call, been feeling a little emotionally wrecked with one thing and another but had a good nights sleep and am in fighting form again today :)

  9. Oh my Gerrard do i wish i never got up this morning :(

    Got a Response of intent to deny this morning on my sons AOS, Due to having no evidence of receieving a medical exam during the K1 process....... i am kinda lost for words, though not surprised.....i sent them receipts and a copy of the vaccination form (twice). So i'm guessing due to some halfwhits incompetence they have lost his entire medical :bonk: We need to submit a full medical report within the next 30 days or he will automatically be denied. The main worry is the section on his 'mental health'. He suffers from aspergers and for the K1 medical we needed to provide written statements from his hospital doc and his school to state that he would not cause harm to himself or others....these documents were faxed direct to the Knightbridge docs, so i never even saw them let alone received a copy. so now we are racking our brains trying to figure whats the best way to go, 30 days isn't alot of time (in the warped world that is immigration), do we contact our congressman or just go for medical and hope for the best! What the bob do we pay the 1 thousand and odd dollars for these people to do?

    Arrrrrrrrrrrrrrrrrrghhhhhhhhhhhhhhhhhhh!!

Just got off the phone with USCIS regarding my son's RFE medical from I-693, they advised me to put a cover letter in and return explaining he doesn't need another medical as he already had one in the UK........i really don't mind sending in copies of our marriage cert again (annoying as it is as they had an ORIGINAL..lol) but i begrudge sending him for another full medical...will see what happens :rolleyes:

  11. That is insane. This is for your son's GC right? Isn't there some way to make them find the file? If they approved your green card, then the papers have to exist. What about an INFOPASS appointment? ARGGHHHHhhhhh!

    I think I'm in a fight-the-bureaucracy mood today. Spent a long time at the medical center (Houston) today. Part of it was waiting forever to speak to a person face-to-face about my bill (armed with my very organized notebook and calculator). Then I find out billing is off-site and there is no way to sit across the table from someone and make the numbers match up. So I gave this man who is a "billing counselor" a rough time, in a nice way. All he could do is send a note to the billing people to audit the account and to call me when they've sorted it out. I left there wanting to write the board of directors of the hospital over some of their billing practices I consider a little bit underhanded. Hahaha...yes I'm ready to fight for the rights of the common folk today.

    ooh god don't they drive you mad? We're not gonna bother with infopass. my sons case was transferred, mine wasn't. I'm guessing some papers have been lost in translation. The only thing nagging me is the fact that it's 2 weeks off being a year since our medical at knightsbridge in London.......i guess time will tell. It makes me chuckle that they have original marriage cert...i got an RFE for a marriage cert..and so has he. ...how many do they need LOL

    Oh well, lets just hope that his case is sorted BEFORE i have to file for lifting of conditions :thumbs:

  12. Sorry about the RFE obbynox, since you already have your GC, they are prob just waiting on your RFE response to issue the GC for your son.

    LOL....We can dream...get this! They need ANOTHER marriage cert, a vaccination/medical doc AND ANOTHER affadavit of support complete with Pay slips etc.....

    OMG, this application went in, in August last year, and they took till now to tell us? What can i say..hahahaha! (gotta laugh or i'd stampede someones face and that won't get us anywhere)

    Well, gathering all that info ready to send AGAIN....fingers crossed they keep hold of this lot.

  13. Hey everyone. I finally received my G.C earlier this week ;)

    THEN 2 days ago, got an email update saying my son's case has an RFE???? Arrrgh! we applied for his AOS in August last year along with mine, his case was transferred before christmas and now they tell me he has an RFE...what the bob? we have no idea what it could be about, i guess we'll have to wait and see....needless to say i am slightly miffed...lol

  14. My wifes NOA checklist states needed I-864 form and supporting evidence to be brought to interview unless already submitted. I submitted one with the AOS package sent to Chicago...should I need to fill another one for the interview or bring the copy of the one I submitted before along with the supporting evidence? Thank you...

    We had our interview earlier this week! All of the items we'd already submitted we didn't take copies of! Except for originals of marriage/birth/divorce certificates etc...

  15. Congratulations to everyone who's moving along :) All you guys with RFE's...hang on in there the end will come ;)

    Our quick update. We went for our interview yesterday at Newark (yeah my head was all over the place...and last time i posted here i was on completely the wrong week...haha) Anyway bottom line is...green card APPROVED!!! Whoop! Thank god there seems to be light at the end of the tunnel at last.

    If its any consolation to you guys waiting on email updates..i think the system is bust. I checked mine this morning, and my AOS still says 'request for evidence' soooo thats not quite right..lol

    Anyway, good luck to all still waiting i hope it's short and pain free.

  16. Oooh so much has been going on, new jobs, new apartments ;) congratulations and the best of luck with...well everything!

    Today i finally recieved my Advanced praole (we only filed in AUGUST) haha, and next week we have our interview. Does anyone have any tips on what other kind of evidence we may need?

    We don't have a joint bank account/rent agreement/car insurance so i'm hoping plenty of pics from various weddings, mail in both our names, and important letters adressed to me at this address will be evidence enough.

    Any thoughts would be greatly appreciated...i'm feeling a little frazzled at the minute.

  17. Sorry about the RFE S'bunnies. It seems like there are dozens and dozens of people getting I-693 medical RFEs all of the sudden. And it seems most were November filers. Not sure if anybody has gotten some official word yet, but the threads indicated most were puzzled as to what to do. The RFE was vague (as usual) saying something like "please submit a properly completed I-693." So people just didn't know what that meant for them to do. And it happened to people who had just sent in the DS-3025 AND also to people who had sent in the civil surgeon (signed and sealed) completed I-693 (which should have been a "properly completed I-693". It's been very widespread and hitting people that have done everything exactly right. So it's very frustrating not knowing what the heck generated these RFEs and how to answer them. I haven't read if anybody actually got to talk to a USCIS person who could explain why the sudden bunch of RFEs for K1s.

    Wonder if this has anything to do with it all, maybe some of the USCIS staff got confused :(

    USCIS to Hold Certain Cases Pending Changes to Vaccination Requirements

    November 28th, 2009 WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) has, since Nov. 13, 2009, temporarily held certain applications to adjust status to lawful permanent residence until new CDC vaccination criteria become effective on Dec. 14, 2009.

    The Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC) announced on Nov. 13, 2009 new criteria for determining which vaccinations will be required for applicants seeking to become lawful permanent residents. Based on these new criteria, and beginning on Dec. 14, 2009, the vaccines for herpes zoster (zoster) and human papillomavirus (HPV) will no longer be required for immigration purposes.

    As a result, since Nov. 13, 2009, USCIS has held any application that would have been denied solely based on the applicant’s failure to show proof of having received the HPV or zoster vaccine. USCIS will resume adjudicating these applications on Dec. 14, 2009, using the new vaccination criteria, which eliminate the need for the HPV and zoster vaccines.
