  1. Congratulations everyone who's moving forward

We're still waiting for..well anything really, had no news since 11 sept (they received RFE and case was reopened), no touches no nothing, so i'm still twiddling my thumbs..fingers crossed there'll be news soon :)

    2 questions

Which form do I need for the medical? Will the surgeon have them or should I take it filled in for him to complete?

Where do I find out which location to mail everything to I am in VA?

    Thanks

I'm confused. What are filing for? Your timeline indicates a recent CR-1 approval. If that is the case and you did get a CR-1 then you dont have to adjust.

Great to hear your case was transferred, Ellie.

Hopefully this means no interview for you. :)

Thanks! I wouldn't have minded an interview but at least this way (hopefully) David wont have to take a day off work. We are moving again next month so we need all the $'s we can get :)

How do I change that info on me??

We are applying aos I-485 and I-131 as I understand I apply for both? How do I know if I I can apply for I-131?

Everytime I think I have it figured out I get confused again!!!

    Your adjusting from a K1 right? ???

You'll want to apply for AOS (I-485), AP (I-131) and Employment Authorization (I-765)?????

Start here: http://www.visajourney.com/forums/index.ph...mp;page=k1k3aos That is a guide on how to adjust from a K1. You really should read this, it makes the whole thing much more clear. You didn't mention whether you want employment authorization?

re: your medical forms. If you haven't required any additional vaccinations, then you need to submit the vaccination document that Knightsbridge Doctors gave you and nothing else, as long as your medical examination for the K1 is within the last year. If you HAVE or NEED to have vaccinations you have a choice. You can find a local uscis approved Civil Surgeon who will give you any shots you need and fill out the vaccination suppliment for you (although these Dr's often require you to have the whole medical again) or you can use Dr Arnold's services where he will have you fill in certain sections of the form and then you send off proof of the vaccinations you have received, he will transcribe the form and will send it back to you.

To change your timeline information, click on the immigration timelines tab at the top of the page, and click edit/add my entry.

I'm reluctant to help anymore until I know what you are adjusting from, I dont want to give you the wrong information. You really must read that guide I gave you the link too.

You have sort of started to answer my next question about the medical he has had no medical at all. So what does he need to have a full medical? If so what forms for that?

Adjusting from VWP is what we are doing?

He came to visit and owing to a situation where is 80 year old Gfather made it here for his birthday in June we decided (real spur of the moment) that as all his family where coming from UK for his Grandfathers 80th birthday it was just right to get married while all his family where here anyway as what are the chances his grandfather and other elderly family would ever make this trip again.

I think I have now filled in my information correctly on the immigration timelines??

I was not sure on my local office so guessed? I assume there is a way to find out if that is the correct office? I am in VA 90 minutes from DC?

Thanks I will ask the questions there as well if anybody else knows the answers on here I would appreciate the reply!

You're fiance was here on the VWP and you decided to marry?????

Don't quote me on this but i do believe he has to return to his home country and you need to file for K3 (if i have your situation correct) as far as i know you can't marry a foreign citizen while they're here just visiting and allow them to stay!

  2. I found this at the bottom of the page...(i'm terrible for not reading things thoroughly..lol)

    Note on "Last Updated" date:

Your case may have a new "Last Updated" date and you may receive an Email and/or text message notification of your case being updated, without the status of the case changing. This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message.

So i'm guessing all will be well, and status won't be changed until next stage is ready.

    Let's hope it's soon ;)

  3. Welcome back pothegavel ;)

Congrats Magpie on your bio app..i think you're going to get the marmite before me hehe!

Today i got an RFE! Seems they want a copy of our marriage certifcate, i'm not completely insane and sent them an original (we ordered 2 trying to be organised..lol)

The only reason i can think of is i sent in 2 AOS petitions (one for myself and one for my son) all the evidence was submitted with both apllications and fees in the same packet!

Should i have sent duplicate evidence?

  4. A divorce would impact both of you. She would have to wait two additional years to file for citizenship if you separate and get divorced. You would still be obligated to provide support under the Affidavit of Support you filed on her behalf. A divorce would not relieve you from that obligation.

In a divorce settlement, wouldn't this just be rolled into monthly payments of "Spousal Support"?

    ps,

This is why I would never marry overseas and do a CR/1: With a K1, at least you have a 90 day adjustment period before getting married, and not immediately bound under a legal relationship if it proves she is not adjusting to the new country/relationship.

OP, I feel your pain, and really hope things work out for you somehow. Just take a few steps back, take some deep breaths and reevaluate your situation and get a new perspective. Good luck

Excellent advice! though if you think 90 days is long enough to 'adjust' to a new country..oh dear! believe me, it's not.

  5. This is a terrible story, all the effort in bringing a loved one over, getting married and having a child, it's a lot! Is it really that bad? maybe marriage counsilling would be an option? putting any child through this kind of thing can be detremental to them, divorce should be a last resort. Whatever you decide, try and put the childs needs ahead of your own, maybe he WANTS to be with both of you so going for full custody could cause more harm than good!

    I wish you the best!

  6. Went with fiancee to Social Security Office to get a number and was told we first need a work authoriation form to get SS card. I was told that we need to file an I-766 form or I-688 or we could get a Fed ID number at the IRS and then apply for SS card. VJ does not list an I-766 or I-688 what the...Has anyone else had this problem. It could delay bank account and drivers lic. waiting on the process time. I would apreciate any info. moboatman @msn.com

If your fiancee came in on a K1 visa, she is already authorised to work so does not need EAD, read the VJ guides surrounding applying for SS number, there is a form to download to take with you that explains to the SS office that a K1 CAN have a SS number, i'd go back with all the documentation and try again, i had no problems getting a SS number when i entered the US.

    Good luck :)

    Selina.
